This year ten properties located in the City are included in that sale. They include vacant land, several single family homes, and an apartment building. The City can purchase any of the parcels prior to the auction sale for an amount equal to the back taxes plus an administrative fee. However, the owner of the land can redeem their property until the auction date. The parcels could then be used for public facilities or open space. This year's auction date is February 10, 1997. In reviewing the available parcels, staff identified one lot that could be used for a public facility. This lot is located on the north side of Soledad Canyon Road between Oak and Ruether Street. This 4,850 square foot site (97'X 50') is currently vacant, with neighboring businesses occasionally parking vehicles on the property. The parcel is located in the IC (Industrial/Commercial) zone and is surrounded by auto related uses. Staff has identified this site as a location for a possible Compressed Natural Gas (CNG) fueling station. It is large enough to accommodate the improvements needed for the station. The cost of the property is $12,075, plus an administration fee. Staff, including the City Attorney, is still reviewing all the aspects of the purchase of land. Due to the timing of the auction, this is the last scheduled City Council meeting where the Council could authorize the funds for the purchase of the land. The Planning Commission would also be required to make a finding that the acquisition of the land is consistent with the General Plan prior to the purchase. Adopted: Agenda Item: 13 RECOMMENDATION Authorize $15,000 (purchase price plus a contingency if needed) from the City Council Contingency account (#1240-7401) fund for the purchase of land and direct the City Manager to purchase the land after the City Attorney's review. RESOLUTION NO. 97-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY COMPEL THE PURCHASE OF CERTAIN VACANT PROPERTY FOR PUBLIC PURPOSES SECTION 1. The City Council of the City of Santa Clarita ("City") hereby finds, determines, and declares as follows: A. The public interest, convenience, and necessity compel the purchase of certain vacant property ("Property") by said City, located in the City of Santa Clarita, County of Los Angeles; State of California for the purpose of providing a site for the construction of a compressed natural gas facility ("Facility") for use by the general public, and all other interested parties thereto; and B. The Facility, which will be located along one of the City's major traffic thoroughfares, is located in a manner that will be most compatible with the greatest public good; and C. The purchase of the Property as above described is necessary to provide the public with a fuel facility for alternative fuel vehicles, consistent with the goal of the South Coast Air Quality Management District's Air Quality Management Plan to reduce noxious air emissions; and D. Prior to the final purchase of said Property, the Planning Commission of the City will be required to state a finding that the acquisition of the land is consistent with the General Plan. SECTION 2. The City Council of the City hereby declares that it is its intention to purchase said Property in its name in accordance with all applicable provisions of the laws of the State of California. SECTION 3. That if any of the Property has been appropriated to some public use, that the public use which will be applied by the City, as described above, is a more necessary and paramount public use. SECTION 4. Said Property hereinabove referred to, the purchase of which is compelled by said public interest, convenience and necessity for the purposes set forth in Section 1 hereof, is located in the City of Santa Clarita, County of Los Angeles, State of California, and is more particularly described on the Los Angeles County Tax Assessor's Map ("Exhibit A") attached hereto and incorporated herein by this reference, as set forth in fall. SEC ON The City Attorney and the firm of Burke, Williams & Sorensen, as special counsel, under the direction of the City Attorney, are authorized and directed to prepare, institute, and prosecute in the name of the City such proceedings in the proper Court having jurisdiction thereof as may be necessary for the purchase of said Property described in Section 4. SECTION 6. The City Clerk shall certify the adoption of this Resolution. SECTION 7. This Resolution shall be effective immediately upon its adoption. PASSED, APPROVED AND ADOPTED this day of 19_.
