SUBJECT: RAILROAD AVENUE IMPROVEMENTS - PROJECT NO. 95-065
BID AWARD

On June 11, 1996, the City Council approved the Newhall Downtown Revitalization Plan in
concept. A major part of this program is reconstructing Railroad Avenue from San Fernando
Road south of 4th Street to San Fernando Road at 11th Street. On July 9, 1996, Council
awarded the design contract to HDR Engineering, Inc.
On March 11, 1997, the City Council authorized the advertisement of the subject project. This
project proposes to realign and widen Railroad Avenue from an existing 60 -foot right-of-way
width to 85 feet. It will provide two travel lanes, one two-way left -turn lane, parking, sidewalks,
landscaping, irrigation, and street lighting on the east.and west sides of the street.
The improvements on the east side of Railroad Avenue would accommodate service to a future
Newhall Metrolink Station. This project will also upgrade the Market Street railroad crossing,
interconnect the Market Street railroad crossing signals with the intersection of San Fernando
Road and Market Street, and relocate an existing spur track adjacent to Railroad Avenue.
The.Engineer's Estimate to complete construction of this project is $2,295,502.40 which includes
a 20% contingency. The funds allocated for this project total $5,134,700 and are identified as
follows:

On July 1, 1997, bids were received by the City (see Bid Results, Exhibit A). Staff recommends
that the project be awarded. to the lowest bidder, Gueno Development Company, Inc., of
Los Angeles, California. Gueno Development Company, Inc. possesses a State Contractors
License and is in good standing with the State Contractors License Board. This contractor is

currently performing a public works contract with the City and has performed similar work for
other agencies. The references indicated that this contractor has performed work to their
satisfaction. The bid of $1,941,691.00 was reviewed for accuracy and conformance to the
contract documents and found to be complete. A form deficiency in the proposal of the low bid
has been noted. The low bidder designated the subcontractors who will perform work on this
contract, but failed to identify which subcontractors were DBE (Disadvantaged Business
Enterprise) certified subcontractors at the time of bid. The day after the bid opening, the low
bidder identified which of the listed subcontractors were DBE certified. The DBE goal listed in
the specifications is 11%. The low bidder exceeded this goal by providing 18.18% DBE
subcontractors to this contract. The second low bidder has challenged the low bid based on the
form deficiency and the failure to identify the DBE at the time of bid. Council should find that
the low bidder substantially complied with the designated DBE requirement, waive the minor
irregularity, and award the contract to the low bidder.
Los Angeles County Department of Public Works will be supplying professional construction
engineering, inspection, surveying, and geotechnical services during the construction of this
project. Due to the time available to construct this project, there is not sufficient procurement
time (90 days minimum) to order the traffic signal controllers, cabinets, and poles through -a bid
procurement process. Los Angeles County keeps these items in stock and is able to supply them
for the Railroad Avenue Project. Therefore, it is recommended that Council authorize
Los Angeles County to supply the traffic signal equipment and waive the bid requirement.
RECOMMENDATION
1. Council award the contract for Project No. 95-065 to Gueno Development Co., Inc. for
$1,941,691.00, and authorize a 20 percent contingency expenditure, should any change
orders to the contract become necessary.
2. Council authorize the City Manager or his designee to approve all documents relating to
this contract.
3. Council approve a purchase order to Los Angeles County for professional construction
engineering, inspection, surveying, geotechnical services; traffic signal controllers, cabinets
and poles for the Railroad Avenue Project in the amount not to exceed $300,000 from
Account No. 72015104 and waive the bid requirement.
4. Council approve the purchase of street light equipment and concrete poles for the Railroad
Avenue Project from Southern California Edison Company in the amount of $75,000 from
Account No. 72015104.
