Brad Therrien SUBJECT: TRANSFER OF STORM DRAINS TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) TRACT NO. 48117, MTD NO, 1360 RESOLUTION NO. 97-49 DEPARTMENT: Building and Engineering Services :� [N :[I`I : f/111►117 The construction of MTD No. 1360 has been inspected and approved by the Los Angeles County Director of Public Works, who has sent Notices of Completion to the City. The project is located in the Friendly Valley area. A detailed description of the facilities is contained in Exhibit "A." The storm drains were constructed by the developer in accordance with agreements and the Faithful Performance Bonds on file with the City Clerk (see Exhibit "B" attached showing the location and extent of improvements). The agreements also provide that the work shall not be deemed completed until approved, accepted as complete, and transferred to LACFCD for maintenance. The City and County entered into an agreement on March 14, 1989, recorded as Document No. 894346418, which provides for the transfer of storm drains. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm drains for public use. 1. City Council adopt Resolution No. 97-49 for the transfer and conveyance of the storm drain improvements known as MTD No. 1360 to the Los Angeles County Flood Control District for purposes of operation, maintenance, repair; and improvements; 2. City Council authorize the Mayor to execute the attached Quitclaim Deed for the easements to.the LACFCD on behalf of the City; and Adopted: TRANSFER OF STORM DRAINS May 13, 1997 - Page 2 3. City Council direct the City Clerk to transmit a copy of this report indicating the date and action taken, three certified copies of the recorded Quitclaim Deed properly executed and acknowledged, and three certified copies of the adopted Resolution to Mr. Steve Dunn at the County of Los Angeles. By ASSISTANT DEPUTY DIRECTOR Mapping & Property Management Division RESOLUTION NO. 97-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS MTD NO. 1360 IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage systems known as MTD No. 1360, described in the corresponding Exhibit "A" attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit "A' attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit "A." BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way therefore have been conveyed to and accepted by District. Reference is hereby made to District Drawing Nos. 137-F2.1 through 137-F2.3, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. Such warranties by the City are incorporated herein by this reference. The City Clerk shall certify to the adoption of this Resolution.
