SANITATION DISTRICT ANNEXATION NO. 292 - RESOLUTION NO. 97-111 DEPARTMENT: Planning, Building, and Environmental Services RECOMMENDED ACTION City Council adopt Resolution No. 97-111, approving and accepting the negotiated exchange of property tax revenues resulting from Sanitation District Annexation No. 292. Los Angeles County Sanitation District Nos. 26 and 32 provide wastewater treatment services cooperatively through the Santa Clarita Valley Joint Sewerage System. To provide wastewater treatment service to property located outside of the Districts' service area, the service area boundary must be expanded through the annexation process. As part of this process, a tax -sharing resolution to provide the required funding to the Sanitation Districts is adopted by the public agencies responsible for providing services to the subject property. The proposed annexation area is a developed property consisting of two single family dwellings on approximately 0.321 acres. The site is located fronting on the west side of Camp Plenty Road, south of Calla Way. Annexation would allow the Sanitation District to provide off-site sewage disposal service for the two existing dwellings on the annexation site. ALTERNATIVE ACTIONS 1. Council may determine that off-site sewage disposal may not be appropriate for the subject site area and oppose this proposed annexation. 2. Other direction as determined by the City Council. Adopted: 16-16-11-7 TAX SHARING RESOLUTION FOR SANITATION DISTRICT ANNEXATION NO. 292 October 15, 1997 Page 2 FISCAL IMPACT Local agencies receiving.an apportionment of property tax from the annexing area must determine the amount of tax revenues to be exchanged between the affected agencies. For this annexation, a total of 1.2607 percent of the annual tax increment attributable to the land area involved in the annexation would be transferred to Sanitation District No. 26. Of this total, the City would contribute 0.1243 percent of its revenues from the annual tax increment for the annexation area. As proposed, the annexation to Sanitation District No. 26 should result in no adverse fiscal impact to the City. Whereas the goals and policies of the plan establish the general framework for future growth and development, actual realization of the plan can only be accomplished through the specific implementing actions that the City subsequently undertakes. "ANNEXATION NO. 292" WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution, and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 26 entitled Annexation No. 292. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS 1. The negotiated exchange of property tax revenues resulting from the annexation of territory to County Sanitation District No. 26 in the annexation entitled Annexation No. 292 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 1998 or afterthe effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to County Sanitation District No. 26 a total of 1.2607 percent of the Annual Tax Increment attributable to the land area encompassed within Annexation No. 292. Said percentage has been determined on the basis of the following contributions. AGENCY PERCENT Los Angeles County General Fund 0.5369 Los Angeles County Library 0.0444 Los Angeles County Flood Control 0.0213 Los Angeles County Consolidated Fire Protection District 0.3812 Los Angeles County Fire - FFW 0.0269 City of Santa Clarita 0.1243 Castaic Lake Water Agency 0.1250 Greater Los Angeles County Vector Control District 0.0007 TOTAL 1.2607 3. No additional transfer of property tax revenues shall be made from any other taxing agencies to County Sanitation District No. 26 as a result of annexation entitled Annexation No. 192. 4. No transfer of property tax revenues from properties within a community redevelopment project shall be made during the period that the entire tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District No. 26 and the governing bodies of City of Santa Clarita, Castaic Lake Water Agency, and Greater Los Angeles County Vector Control District signatory hereto.
