HomeMy WebLinkAbout1997-04-08 - AGENDA REPORTS - TAX SHARING RESO (2)AGENDA REPORT City anag PP M er Approval Item to be presented by: Amelia Rietzel CONSENT CALENDAR DATE: April 8, 1997 SUBJECT: TAX SHARING RESOLUTIONS FOR SANITATION DISTRICT ANNEXATION NOS. 294 AND 296 RESOLUTION NOS. 97-34 AND 97-36 DEPARTMENT: Building and Engineering Services Los Angeles County Sanitation District Nos. 26 and 32 provide wastewater treatment services cooperatively through the Santa Clarita Valley Joint Sewerage System. To provide wastewater treatment service to property located outside of the Districts' service area, the service area boundary must be expanded through the annexation process. As part of this process, a tax - sharing resolution to provide the required funding to the Sanitation Districts is adopted by the public agencies responsible for providing services to the subject property. Local agencies receiving an apportionment of the property tax from the annexing area must determine the amount of tax revenues to be exchanged between the affected agencies. For Annexation No. 294, a total of 1.2676 percent of the annual tax increment attributable to the land area involved in the annexation will be transferred to Sanitation District No. 26. Of this total, the City of Santa Clarita is contributing 0.1235 percent of its revenues from the annual tax increment for the area of Annexation No. 294. For Annexation No. 296, a total of 1.2665 percent of the annual tax increment attributable to the land area involved in the annexation will be transferred to Sanitation District No. 26. Of this total, the City of Santa Clarita is contributing 0.1235 percent of its revenues from the annual tax increment for the area of Annexation No. 296. The area of Annexation No. 294 is property of approximately 0.602 acres fronting on the west side of Sierra Highway and north of Soledad Canyon Road. Annexation would provide for sewage disposal for uses at the site, which is currently classified under the City's General Plan land use designation and zoning as Community Commercial (CC). The area of Annexation No. 296 is property of approximately 6.359 acres at the northeast corner of the intersection of Via Princessa and Weyerhaeuser Way. Annexation would provide for sewage disposal for uses at the site, which is currently classified under the City's General Plan land use designation and zoning as Business Park (BP). As proposed, these annexations to Sanitation District No. 26 should result in no adverse fiscal impact to. the City. "ANNEXATION NO. 294't WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution, and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 26 entitled Annexation No. 294. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS I . The negotiated exchange of property tax revenues resulting from the annexation of territory to County Sanitation District No. 26 in the annexation entitled Annexation No. 294 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 1998 or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to County Sanitation District No. 26 a total of 1.2676 percent of the Annual Tax Increment attributable to the land area encompassed within Annexation No. 294. Said percentage has been determined on the basis of the following contributions. AGENCY PERCENT Los Angeles County General Fund 0.5305 Los Angeles County Library 0.0444 Los Angeles County Flood Control 0.0210 Los Angeles County Fire Protection District 0.3952 Los Angeles County Fire - FFW 0.0265 City of Santa Clarita 0.1235 Castaic Lake Water Agency 0.1247 Greater Los Angeles County Vector Control District 0.0007 Antelope Valley Resource Conservation District 0.0011 TOTAL 1.2676 3. No additional transfer of property tax revenues shall be made from any other taxing agencies to County Sanitation District No. 26 as a result of annexation entitled Annexation No. 294. 4. No transfer of property tax revenues from properties within a community redevelopment project shall be made during the period that the entire tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation District.No. 26 and the governing bodies of City of Santa Clarita, Castaic Lake Water Agency, Greater Los Angeles County Vector Control District, and Antelope Valley Resource Conservation District signatory hereto.
