SUBJECT: TRANSFER OF STORM DRAINS TO LOS ANGELES COUNTY FLOOD
CONTROL DISTRICT (LACFCD)
TRACT NOS. 43129 AND 36686, PRIVATE DRAIN NO. 1871, UNITS I
AND II
RESOLUTION NO. 97-40
DEPARTMENT: Building and Engineering Services
The construction of Private Drain No. 1871, Units I and II, has been inspected and approved by
the County Director of. Public Works, who has sent Notices of Completion to the City. The
project is located in the Canyon Country area. A detailed description of the facilities is
contained in Exhibit "A." The storm drains were constructed by the developer in accordance
with agreements and the Faithful Performance Bonds on file with the City Clerk (see Exhibit
"B" attached showing the location and extent of improvements). The agreements also provide
that the work shall not be. deemed completed until approved, accepted as. complete, and
transferred to LACFCD for maintenance.
The City and County entered into an agreement on March 14, 1989, recorded as Document
No. 89-1346418; which provides for the transfer of storm drains. The City Council must approve
a resolution authorizing the transfer to complete the process. The transfer is then accepted and
approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm
drains for public use.

and three certified copies of the adopted Resolution to Mr. Steve Dunn at the County of
Los Angeles.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA,
REQUESTING THE BOARD OF SUPERVISORS OF
THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT
OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID
DISTRICT THE TRANSFER AND CONVEYANCE OF THE
STORM DRAIN IMPROVEMENTS KNOWN AS
PRIVATE DRAIN NO. 1871, UNITS I AND II
IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION,
MAINTENANCE, REPAIR AND IMPROVEMENT, AND
AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF
WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm
drain improvements and drainage systems known as Private Drain No. 1871, Units I and II,
described in the corresponding Exhibit "A' attached hereto; and
WHEREAS, the City is authorized and empowered to transfer and convey to the Los
Angeles County Flood Control District any storm drain improvements and drainage systems for
future operation, maintenance, repair, and improvement; and
WHEREAS, the City and the Los Angeles County Flood Control District entered into an
agreement dated March 14, 1989, and recorded August 22, 1989, as Document Number
89-1346418, of the Official Records in the office of the County Recorder for the County of Los
Angeles, whereby the City made certain warranties about its future transfers and conveyances
of Flood Control facilities to the District; and
WHEREAS, the best public interest will be served by transfer and conveyance of the
storm drain improvements and drainage system described in Exhibit "A" attached hereto from
the City to the Los Angeles County Flood Control District for future operation, maintenance,
repair, and improvement.
NOW, THEREFORE, BE IT RESOLVED that the City does hereby request the Los
Angeles County Flood Control District to accept the transfer and conveyance of the storm drain
improvements and drainage system described in said Exhibit "A."

BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of
Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and
ordered to prepare all necessary instruments and documents, including deed, to effectuate said
transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed
and other instruments and documents. District shall have no obligation or responsibility to
maintain said storm drain, improvements, and drainage until all rights-of-way for said drain
now vested in the City and all other necessary rights-of-way therefore have been conveyed to
and accepted by District.
Reference is hereby made to District Drawing Nos. 43-F297.1-.4 and 43-F320.1-.2, the
plans and profile of said storm drain improvements and drainage system on file in the office of
the City Engineer and on file in the office of the Chief Engineer of said District for further data
as to the exact location, extent, and description of said storm drain improvements and drainage
system.
BE IT FURTHER RESOLVED that the transfer and conveyance hereby requested are
subject to each of the warranties described in the Agreement between the City and the District
dated March 14, 1989, and recorded August 22, 1989, as Document Number 89-1346418, of the
Official Records in the office of the County Recorder for the County of Los Angeles. Such
warranties by the City are incorporated here by this reference.
The City Clerk shall certify to the adoption of this Resolution.

filed in Book 1067, pages 62 to 69, and Tract No. 36686 filed in Book 1068, pages 24 to 27,
inclusive, of Maps, Records of the County of Los Angeles, generally described as follows:
Line "A"
Commencing from an existing 42" reinforced concrete pipe (Private Drain No. 1962), Station
25+28.13, approximately 350 feet westerly of the intersection of Golden Triangle Road and
Claudette Street within street right-of-way; thence easterly and southeasterly within Golden
Triangle Road and Rainbow Glen Drive to a catch basin, Station 35+60.92, a distance of 1035
feet, more or less.
