HomeMy WebLinkAbout1998-06-23 - AGENDA REPORTS - APPROVE ENGINEERING RPT (2)PUBLIC HEARING DATE: June 23, 1998 AGENDA REPORT City Manager Item to be prese SUBJECT: PUBLIC HEARING TO APPROVE THE ENGINEER'S REPORT AND LEVY ANNUAL ASSESSMENTS FOR FISCAL YEAR 1998-99 ZONE NOS. 1 THROUGH 5, Tl THROUGH T10, T17,'123, 729, T30, T42A, T42B, AND T46 DEPARTMENT: Parks, Recreation and Community Services RECOMMENDATION City Council conduct the public hearing, approve the Engineer's Report, and levy the annual assessments for Landscape Maintenance District No 1, Zone Nos. -1 through 5, Tl through T10, T17, T23,129, T30, T42A, T42B, and T46 BACKGROUND The City Council is required by law to annually evaluate and establish rates for.Landscape Maintenance Districts (LMD). As a result, on June 9, 1998, the City Council adopted Resolution 98-73, to set the public hearing for June 23, 1998, to establish rates in Fiscal Year 1998-99. Under current conditions, the rates will remain at their 1997-98 level, and will not change in Fiscal Year 1998-99. The City maintains landscape improvements such as paseos, slopes, and medians within and adjacent to residential areas. These LMD zones were established when the homes were built. The landscaped areas were annexed into the Landscape Maintenance District in order to provide ongoing maintenance. Without the districts in place, the maintenance of the landscaping would be the responsibility of each individual landowner. Upon transfer from the County, the City now has the responsibility for collecting assessments and administering the maintenance for these zones. After careful consideration of the maintenance needs of the districts, no increase in the assessment rate is being proposed. However, the rate will be adjusted either up or down on an FROVE1 Agenda Item: cXV annual basis if necessary based on the Consumer Price Index (CPI) as provided in the formation documents of the district. This is in accordance with Proposition 218, "The Right to Vote on Taxes Act," and is approved by the City Attorney. Additionally, the homeowners associations for Zones 23 and 46 have submitted letters to the City requesting that the CPI be incorporated in the districts assessment rate. Modifications to the Engineer's Report consist of additional maintenance for Zones Tl, T3 through T8 by including areas such as tree wells that are currently in the zone boundaries but not currently maintained by the City. ALTERNATIVE ACTIONS Other action as determined by Council. FISCAL IMPACT Funds for these expenditures have been budgeted in the landscape district Account Nos. 7501 8001 to 7523 8001, pending City Council adoption of the budget. These expenditures are also detailed in the landscape district annual Engineer's Report. Dawson, CMC City Clerk Publish Date: June 10, 1998 BM:swk c:lsteveMmilleAnotice. bm RESOLUTION NO. 98-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ORDERING THE FORMATION OF LANDSCAPE MAINTENANCE DISTRICTS AND THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN SUCH DISTRICTS FOR FISCAL YEAR 1998.99 AND CONFIRMING ASSESSMENTS PURSUANT TO THE PROVISIONS OF PART TWO OF DIVISION FIFTEEN OF THE CALIFORNIA STREETS AND HIGHWAYS CODE AND AS PROVIDED BY ARTICLE 10IID OF THE CALIFORNIA CONSTITUTION WHEREAS, the City Council, by its Resolution No. 98-86 initiated proceedings and by it's Resolution No. 98-86, declared its intention to levy and collect assessments against lots and parcels of land within Santa Clarita Landscape Maintenance District No. 1, Zone Nos. 1 through 5, T1 through T10, T17, 723, T29, T30, T31, T42A, T42B, and T46 (hereinafter referred to as "Zones"), pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section 22500, to pay for the costs and expenses of operating, maintaining and servicing landscaping and appurtenant facilities located within public places within the boundaries of the Zones; and WHEREAS, the Engineer selected by the City Council: has prepared and filed with the City Clerk, and the City Clerk has presented to the City Council, a report in connection with the proposed annual levy and collection of assessments against lots and parcels of land within the Zones and the City Council did by previous resolution approve such report (the "Engineer's Report"); and WHEREAS, the City Council desires to levy and collect assessments against lots and parcels of land within the Zones for the fiscal year commencing July 1, 1998, and ending June 30, 1999, to pay for the costs and expenses of operating, maintaining and servicing landscaping and appurtenant facilities located within public places within the boundaries of the Zones; and NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve, determine and order as follows: SECTION 1. Following notice duly given, the City Council has held a full and fair public hearing regarding its Resolution No. 98-86, the Engineer's Report prepared in connection with the District and the levy and collection of assessments, and considered all oral and written statements, protests, and communications made or filed by interested persons. At the public hearing, the Engineer presented to the City Clerk, and the City Clerk presented to the City Council, certain proposed modifications to the Engineer's Report. The modifications result in no decrease or increase in the amount of the assessments against any parcel within the District or Zones. SECTION 2. With respect to Zone Nos. 1 through 5, Tl through T10, T17, T23, T29, T30, T31, T42A, T42B, and T46, the City Council hereby finds that written protests have not been filed and not withdrawn representing property owners owning less than 50 percent of the area of assessable land within each respective zone. All oral and written protests and objections are hereby overruled by the City Council.The City Council hereby further finds that a majority protest does not exist as defined in Section 4(e) of Article XM of the California Constitution. SECTION 3. The City Council hereby orders the modifications to the Engineer's Report to be made, as presented by the Engineer at the public hearing and now on file in the office of the City Clerk. The City Council hereby further orders the changes in the Engineer's Report to add additional landscaped areas within Zones Tl and T3 through T8. The Engineer is hereby directed to file an Engineer's Report as modified, with the City Clerk. The Engineer's Report, as modified, is hereby approved. SECTION 4. Based upon its review of the Engineer's Report, as modified, a copy of which has been presented to the City Council and which has been filed with the City Clerk, and other reports and information, the City Council hereby finds and determines with respect to each Zone included in the modified Engineer's Report, that: (I) The land within each Zone will be specially benefited by the operation, maintenance and servicing of landscaping, including trees, shrubs, grass and other ornamental vegetation, and appurtenant facilities, including irrigation systems, located in public places within the boundaries of the Zones; and (II) The Zones include all lands so benefited; (III) The net amount to be assessed upon the lots and parcels within the Zones in accordance with the assessment for fiscal year commencing July 1, 1998, and ending June 30, 1999, is apportioned by a formula and method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated special benefits to be received by each lot or parcel from the improvements; and (IV) Only special benefits are assessed and no assessment is imposed on any parcel, which exceeds the reasonable cost of the proportional special benefit conferred on that parcel. SECTION 5. The City hereby orders the proposed improvements to be made as set forth in the Engineer's Report, as modified, which improvements are briefly described as follows: The operation, maintenance and servicing of ornamental structures, landscaping, including trees, shrubs, grass and other ornamental vegetation, and appurtenant facilities, including irrigation devices located in public places within the boundaries of the zone. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of ornamental structures landscaping and appurtenant facilities, including repair, removal or replacement of all or part of any of the ornamental structures, landscaping or appurtenant facilities; providing for the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizer and treating for disease or injury; the removal of trimmings, rubbish,.debris and other solid waste; and the cleaning, sandblasting and painting of walls and other improvements to remove or cover graffiti. Servicing means the furnishing of water and electricity for the irrigation and control of the landscaping and the maintenance of any of the ornamental structures or appurtenant facilities. The maintenance generally consists of regular landscape maintenance, plant replacement and irrigation system repair. The landscape maintenance contracts include weeding, mowing, trimming, edging, fertilizing, turf aeration, trash removal snail baiting and pest spraying. Other landscape district tasks include maintaining the paseo lights and poles, electrical systems, sump pumps and concrete paseo walk repair and replacement. Some of the districts have a significant amount of hardscape such as retaining walls, slough walls, slough curbs, wrought iron fences, concrete benches, play equipment, vita courses and block walls. The district performs maintenance and repair of the hardscape. The district also paints the wrought iron, hand rails, chicane fences, light poles, paseo bridges and tunnels. Weed abatement for fire code compliance and rodent control are also provided by the districts. Districts with paseo bridges pay a structural component for routine structural bridge inspections and major bridge repairs. SECTION 6. Additional District Maintenance Areas - There are a number of areas within the district boundaries and within the City right-of-way which is to be included in the district maintenance areas. The City consents to the inclusion of these areas into the districts maintenance responsibility. Those areas are identified below. Zone TI - This zone currently consists of medians and parkways on the major and secondary highways within the district boundaries. In the cases where the district boundary coincides with a street, the district maintenance is to include the entire median on both sides of the center line and the parkway panels on both sides of the street. The maintenance in the parkway panels include the tree wells and irrigation where applicable. Zone T3 - The parkway panel along the west side of Tournament Road from Vista Hills Drive to Via Candela is proposed to be included within the district maintenance. This area is known as the parkway adjacent to assessors parcels 2851-011-001 to 004. The tree wells along Tournament Road within the district boundary are to be maintained by the district. Zone T4 - The tree wells along Tournament Road and Singing Hills within the district boundary are to be maintained by the district. Zone T5, T6, & T7 - The Edison easement areas are proposed to be annexed into the area of maintenance responsibility. The services provided will be rodent control, weed abatement and maintenance of any facilities within the Edison or City trail areas. Zone T8 - The parkway area along the west side of Singing Hills from McBean to Tide is proposed to be annexed into the maintenance area. This area is currently maintained by the homeowners who back up to this right of way area. Upon approval of a maintenance cost agreement and/or petition with the underlying property owners, the district will install a separate irrigation system, and include this area with the district maintenance. SECTION 7. The City Council hereby confirms the assessments set forth in the Engineer's Report as modified. The maintenance, operation and servicing of the ornamental structures, landscaping and appurtenant facilities shall be performed pursuant to law. The County Auditor of Los Angeles County shall enter on the County Assessment Roll opposite each lot or parcel of land the amount of the assessment, and such assessments shall then be collected at the same time and in the same manner as the County taxes are collected. After collection by the County, the net amount of the assessment after deduction of any compensation due the County for collection shall be paid to the City Treasurer. SECTION 8. The assessments are in compliance with the provisions of the Act and Article XM of the California Constitution, and the City Council has complied with all laws pertaining to the levy of the annual assessments pursuant to the Act and Article XIIID of the California Constitution. SECTION 9. The assessments are levied for the purpose of paying the costs and expenses of the improvements described in Section 5, above, for Fiscal Year 1998-99. SECTION 10. The City Treasurer shall deposit all money representing assessments collected by the County for the District to the credit of a special fund and any such money shall be expended only for the maintenance, operation servicing of the landscaping and appurtenant facilities as described in Section 5. SECTION 11. The adoption of this Resolution constitutes the levy of assessments for the fiscal year commencing July 1, 1998, and ending June 30, 1999. SECTION 12. The City Clerk is hereby authorized and directed to file the assessments, or a certified copy of the assessment, with the County Auditor upon the adoption of this Resolution. SECTION 13. A certified copy of the assessments shall be filed in the office of the City Clerk and shall be open for public inspection. PASSED, APPROVED AND ADOPTED this day of 1998. Method of Assessment ................................... 10 VII Certifications ........................................... 12 Appendices A Assessment Diagram B Assessment Roll C Zone Budgets D Resolutions June 9, 1998 City of Santa Clarita Landscape Maintenance Districts COMBINED ENGINEER'S REPORT CITY OF SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO.1 ZONES 1 through 5, T1 through T10, T17, T23, T23A, T23B, T29, T30, T31, T42A, T4213, and T46 INTRODUCTION This Combined Engineer's Report is prepared in compliance with the requirements of Article 4, Chapter 1, of the Landscaping and Lighting Act of 1972 (hereinafter referred to as the "Act"), which is Part 2, Division 15 of the California Streets and Highways Code. This report considers each: zone as a distinct annexation to Santa Clarita Landscape Maintenance District No. 1 (the "District"). After the formation of Santa Clarita Landscape Maintenance District No. 1 in 1992 there have been eight (8) subsequent individual annexations into the District. Zones 1, 2, 3, 4, 5, 6, 7, and 8 cover developments where the developer of the project was required by the City to annex into the existing District as a condition of approval of their tract or parcel map. As of July 1, 1998 Zones T10 and T30 will be accepted for maintenance. Zones 6, 7, and 8 have not been annexed into the District or accepted for maintenance by the City and are not included in this report for Fiscal Year 1998/99. Zone 1 was annexed into District No. 1 but has not been accepted for maintenance and will continue to receive a credit on their assessments. During the 1996/97 and 1997/98 Fiscal Years, Zones T1 through T10, T17, T23, T23A, T2313, T29, T30, T31, T42A, T428, and T45 were transferred into the City's Landscape Maintenance District No. 1 from the County of Los Angeles. The County, through the Department of Parks and Recreation, had previously administered these areas which had provided for the maintenance and servicing of the landscape improvements located in their particular development for the past several years. As in the previous annexations to the District, these new zones from the County were also established by petition of the developer. As of July 1, 1998, pursuant to the Act, the City Council of the City of Santa Clarita is now the legislative body for the District and may levy annual assessments and act as the governing body for the operations and administration of the District. June 9, 1998 City of Santa Clarita -1- Landscape Maintenance Districts i In addition to the zones transferred to the City from the County, the City also assumed the responsibility for Landscape Maintenance District No. 2 (LMD No. 2). This LMD collects Ad Valorem assessments and is considered a separate district administered under a different Act and is not addressed in this report. For LMD No. 1 the Act provides for the levy of annual assessments after formation of an assessment district for the continued maintenance and servicing of the district improvements. The Act further allows various areas to be classified into separate zones when the territory in the zone receives substantially the same degree of benefit from the improvements. The costs associated with the installation, maintenance, and service of the improvements may be assessed to those properties which are benefitted by the installation, maintenance, and service. This Engineer's Report gives the details on Zones 1 through 5, Ti through T10, T17, T23, T29, T30, T31, T42A, .T42B, and T46. Zones T23A and T23B are addressed under a different Engineer's Report that was presented to the City Council on April 28, 1998. These two zones had an increase in their assessments which required that the increase be approved by a vote of the property owners. The final report and tally of these votes will be at a public hearing on the 23rd of June at the same time as the public hearing on all the remaining zones. RIGHT TO VOTE ON TAXES ACT (PROPOSITION 218) On November 5, 1996, the electorate approved Proposition 218, Right to Vote on Taxes Act, which added articles XIII C and XIII D to the California Constitution. The Proposition affects all assessments upon real property for a special benefit conferred on the property. Assessments imposed under the Landscaping and Lighting Act of 1972 are these types of benefit assessments. However, the Proposition also exempts any assessments imposed when the person(s) owning all of the property agree(s) to the assessment when it was originally imposed if there is no increase from the previous year. Each and every parcel included in these zones were originally part of a development that was conditioned to install landscape improvements before the development could proceed. In order to preserve the investment in the landscape improvements and satisfy the required condition, Landscape Maintenance District No. 1, was formed. Thereafter, each developer who was conditioned to enter into the District, agreed by petition to the formation and the assessments being imposed on their property. Once the development was sold; all subsequent owners of parcels were also made aware through title reports and Department of Real Estate "White Paper" reports that the parcels were in the District and subject to the June 9, 1998 City of Santa Clarita -2- Landscape Maintenance Districts assessments. Purchase of the parcel(s) was also an agreement by the new owners to be subject to the assessments. Therefore, the assessments for Landscape Maintenance District No. 1 including all annexations, are exempt from the provisions of Proposition 218. However, if there are any subsequent increases, they will be subject to the procedures and approval process of Section 4 of Article XIII D. This report is being provided to show no proposed increase in the assessment to pay for costs incurred for the maintenance, servicing, and operation of the District for Fiscal Year 1998/99. The City may initiate proceedings for the continued maintenance and servicing of the improvements by passing a resolution which orders an engineer to prepare and file a detailed report generally describing any proposed new improvements or any substantial changes in existing improvements. The report prepared by the engineer must also include plans and specifications of the improvements, an estimate of the costs of the improvements, including maintenance and servicing of the improvements, a diagram, i.e., map of the assessment district showing the boundary of the district and the parcels or lots which benefit, and an estimate of costs of the improvements, maintenance, and servicing. Once the report is completed it is presented to the City Council (the legislative body) for its review and approval as presented or may be modified and approved. After the report is approved the City adopts a resolution of intention which declares its intent to levy and collect assessments, describes the improvements, including maintenance and servicing, refers to the assessment district by its distinctive designation, refers to the report for the details of the district, and sets a time and place for a public hearing on the levy of the proposed assessments. If authorized, assessments would be placed on the 1998/99 County Tax Roll and be collected with the regular County property taxes. Reserve funds would be used to fund the maintenance and service until assessment funds are distributed by the County Tax Collector in December 1998. PLANS AND SPECIFICATIONS The proposed improvements for the Landscape Maintenance District include, but are not limited to, and may be generally described as follows: The operation, maintenance, and servicing of ornamental structures, landscaping, including trees, shrubs, grass, and other ornamental vegetation, and appurtenant facilities, including irrigation systems, and drainage devices located in public places within the boundaries of the Landscape Maintenance District. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing -of the ornamental structures, landscaping and appurtenant facilities, including repair, removal, or replacement of all or part of any of the ornamental structures, landscaping or appurtenant facilities; providing for the life, growth, health, and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, and treating for disease or injury; the removal of trimmings, rubbish, debris other solid waste; and pest control. Servicing means the furnishing of electricity for the operation of any appurtenant facilities, and water for the irrigation and control of the landscaping and the maintenance of any of the ornamental structures, landscaping, and appurtenant facilities. Plans and Specifications for the improvements for the Landscape Maintenance District are voluminous and are not bound in this report but by this reference are incorporated and made a part of this report. The plans and specifications are on file at the City where they are available for public inspection. RE June 9, 1998 City of Santa Clarita 4- Landscape Maintenance Districts III. ESTIMATED COSTS OF THE IMPROVEMENTS The Act provides that the estimated costs of the improvements shall include the total cost of the improvements for Fiscal Year 1998/99, including incidentals, which may include reserves to operate the District until funds are transferred to the City from the County, around December 10th of the next fiscal year. The Act also provides that the amount of any surplus, deficit, or contribution be included in the estimated cost of improvements. The net amount to be assessed on the lots or parcels within each district is the total cost of installation, maintenance, and servicing with adjustments either positive or negative for reserves, surpluses, deficits, and/or contributions. For Fiscal Year 1998/99, Zones T1 through T8 and T46 will have a reserve account established to cover any major structural repairs to the paseo bridges located in each zone. This will not incur any increase in the assessments in these zones and this account will be kept separate from the annual maintenance account. Currently, annual maintenance of the bridges is already included in the annual assessments. In addition, it is anticipated that any surplus funds available from previous years as of June 30, 1998 will be used during Fiscal year 1998/99 for capital improvement projects in each zone. These expenses are in addition to the projected annual maintenance budget as shown in Appendix "C. Commencing with Fiscal Year 1999/2000, the amount of the assessment for each District is proposed to increase each year, based upon the Consumer Price Index, All Urban Consumers, for the Los Angeles -Anaheim -Riverside Area ("CPP'), as determined by the United States _Department of Labor, Bureau of Labor Statistics, or its successor. The Engineer shall compute the percentage difference between the CPI for March of each year and the CPI for the previous March and shall then adjust the existing assessment by an amount not to exceed such percentage for the following fiscal year. Should the Bureau of Labor Statistics revise such index or discontinue the preparation of such index, the Engineer shall use the revised index or a comparable system as approved by the City Council for determining fluctuations in the cost of living. ASSESSMENT All assessed lots or parcels of real property within the District are listed on the Assessment Roll which is on file at the City and is hereby made a part of this report by reference. The Assessment Roll states the net amount to be assessed upon assessable lands within the District for Fiscal Year 1998/99, shows the Fiscal Year 1998/99 assessment upon each lot and parcel within the District, and describes each assessable lot or parcel of land within the District. These lots and parcels are more particularly described in the County Assessment Roll, which is on file in the office of the Los Angeles County Assessor and by reference is made a part of this report as Appendix "B". METHOD OF ASSESSMENT BACKGROUND The Landscaping and Lighting Act of 1972 provides that assessments may be apportioned upon all assessable lots or parcels of land within an assessment district in proportion to the estimated benefits to be received by each lot or parcel from the improvements. In addition, Proposition 218 requires that a parcel's assessment may not exceed the reasonable cost of the proportional special benefit conferred on that parcel. The Proposition provides that only special benefits are assessable and the City must separate the general benefits from the special benefits conferred on a parcel. A special benefit is a particular and distinct benefit over and above general benefits conferred on the public at large, including real property within the District. The general enhancement of property value does not constitute a special benefit. SPECIAL BENEFIT Each and every parcel within each of the existing zones receives a particular and distinct benefit from the improvements over and above any general benefits conferred by the improvements. First, all of the improvements were conditions of approval for the creation or development of the parcels. In order to create or develop'the parcels the City required the original developer to install and guarantee the maintenance of landscaping, ornamental structures and appurtenant facilities to serve the parcels. Therefore, each and every parcel within each of the existing zones could not have been developed in the absence of the installation and promised maintenance of these facilities. In addition, the improvements continue to confer a particular and distinct special benefit upon parcels within each zone because of the nature of the improvements. The proper maintenance of landscaping and appurtenant facilities specially benefit parcels within each zone by moderating temperatures, providing oxygenation, attenuating noise from adjacent streets and controlling dust for those properties in close proximity to the landscaping, thereby enhancing the environmental quality of the parcels and making them more desirable. Properly maintained landscaping also deters the erosion of slopes and thereby minimizes the risk of instability and the potential destruction of property within each zone. The spraying and treating of landscaping for disease reduces the likelihood of insect infestation and other diseases spreading to landscaping located throughout the properties within the zones. The proper maintenance of the landscaping, ornamental structures, and June 9, 1998 City of Santa Clarita -10- Landscape Maintenance Districts appurtenant facilities reduces property -related crimes (especially vandalism) against properties in the zone through the abatement of graffiti and the screening of properties within the zone from arterial streets. Finally, the proper maintenance of landscaping and ornamental structures improves the attractiveness of the properties within the zone and provides a positive visual experience each and every time a trip is made to or from the property. All of the above-mentioned contributes to a specific enhancement of the property values of each of the parcels within the zone. Since each and every parcel within each of the existing zones receives a particular and distinct benefit from the improvements there is considered no general benefits conferred by the improvements. APPORTIONMENT In single-family residential zones, all the parcels in the zone receive the same special benefit from the improvements due to their similarity in size and use and their similar proximity to the improvements therefore, each parcel is assessed an equal amount. Similarly, in condominium zones, each unit in the zone receives an equal special benefit from the improvements and, therefore, each unit is assessed an equal amount. In the commercial zones the special benefit to each parcel is derived not only from the benefits to the property described above, but also the enhancement of the property's value through the enhanced ability to attract clients, employees, and customers to the parcel. This benefit increases according to the size of the business and the number of people using the parcel, which in turn, generally correlates to the area of the parcel. Therefore, the estimated cost of the improvements in a commercial zone has been divided among the parcels within the zone according to the area of each parcel in the zone. Common areas, schools, Homeowners Association parcels, public utility parcels, City/government/County property, and easements will not be assessed. DESIGNATING SAID DISTRICT AS LANDSCAPE MAINTENANCE DISTRICT NO. 1, DETERMINING THAT THESE PROCEEDINGS SHALL BE TAKEN PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND SETTING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO The City Council of the City of Santa Clarita pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California (the "Act"), desires to initiate proceedings for the Santa Clarita Landscape Maintenance District No. 1 ("the District"), Zones 1 through 8, TI through T10, T17, T23, T29, T30, T31, T42A, T42B, and T46 inclusive, and does hereby resolve as follows: WHEREAS, the improvements to be installed or maintained may include installation, construction or maintenance of any authorized improvements under. the Act, including, but not limited to, one or more of landscaping, statuary, fountains, and other ornamental structures and facilities, park or recreational improvements, and any facilities which are appurtenant to any of the aforementioned, or which are necessary or convenient for the maintenance or servicing thereof; and WHEREAS, Sections 22622 and 22624 of the Act require that the City adopt a resolution generally describing any new improvements or substantial changes in existing improvements within the existing District and any zones therein, and order the assessment engineer to prepare and file a report in accordance with Article 4 of the Act for the existing District; and WHEREAS, said assessment engineer has made and filed with the City Clerk of said City a report in writing as called for by resolution and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that said report, nor any part thereof, requires or should be modified in any respect; and WHEREAS, Proposition 218, "The Right to Vote on Taxes Act," approved by the voters on November 5, 1996, added Articles XHIC and XIIID to the California Constitution which exempts any assessments imposed when persons owning all of the parcels subject to the assessment agreed to being included in the District and subject to the assessment at the time the assessment is initially imposed; and WHEREAS, Santa Clarita Landscape Maintenance District No. 1 Zones 1 through 8, T1 through T10, T17, 723, 729, T30, T31, T42A, T42B, and T46 inclusive, are now entirely located within the territorial boundaries of the City of Santa Clarita (the "City"); and each zone was originally formed by developer petition; NOW, THEREFORE, BE IT RESOLVED: The City Council of the City of Santa Clarita does hereby resolve, determine and declare as follows: Section 1. That the City Council of the City of Santa Clarita hereby determines that the assessments set out in accordance with the Engineer's Report for Landscape Maintenance District No. 1, on file with the City Clerk of the City of Santa Clarita, sets out the reasonable cost of the service provided. Section 2. That the proposed assessments upon the subdivisions of land in said District is in proportion to the estimated special benefit to be received by said subdivisions, respectively, from said work and of the incidental expenses thereof, as contained in said report are hereby preliminarily approved. Section 3. That the assessments shall be levied upon the respective parcels of land in the assessment area and collected for the 1998-99 Fiscal Year on the tax roll in the same manner, by the same persons, and at the same time as together with and separately from thegeneral taxes of the City of Santa Clarita, without further action by this City Council. Section 4. The City Council of said City by Resolution 98-73, has approved the Engineer's Report, which report indicates the amount of the proposed assessments, the boundaries of the District including the annexation territories, detailed description of improvements, and the method of assessment.. Thereport titles "City of Santa Clarita, Engineer's Report, Landscape Maintenance District No. 1 Fiscal Year 1998/99" is on file in the office of the City Clerk of said City, and was prepared for the 1998/99 Fiscal Year in accordance with the Act. Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Section 5. Notice is hereby given that on the 23rd day of June, 1998, at the hour of 7:00 p.m., or as soon thereafter as possible, in the City Council Chambers at 23920, Valencia Boulevard, in the City of Santa Clarita, any and all persons having any objections to the work, annexations, or extent of the assessment district, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. The City Council will consider all oral and written protests. Section 6. All the work herein proposed shall be done and carried through in pursuance of an act of legislature of the State of California designated the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California. Zones T23 and T46 have been carefully evaluated with respect to Proposition 218. These zones have the same rate that was established when the districts were formed. The contract documents, which were part of the district formation process, provide for an increase for the cost of living, based on the consumer price index (CPI). The owner of the property, the developer signed a petition consenting to the formation of the district. These districts will have the same base rate but the rate will be adjusted. up or down on an annual basis based on the CPI as provided in the formation documents. The homeowners associations for the two underlying properties in the Northbridge Zone have submitted letters to the City requesting that the CPI be incorporated in the districts assessment rate. Section 7. Published notice shall be made pursuant to Section 6061 of the Government Code. The publication of notice of hearing shall be completed at least ten (10) days prior to the date of the hearing. Section 8. The foregoing Resolution was on the 9th day of June, 1998, adopted by the City Council of the City of Santa Clarita, and ex -officio the governing body of all other special assessment taxing districts for which said City Council so acts.
