RECOMMENDED ACTION
City Council conduct the public hearing and receive results on assessment ballots. If
ballots have a majority of "Yes" votes, adopt Resolution No. 98-87, confirming the
ballot results and levy of the new assessments for the continued maintenance of
Landscape Maintenance District Zone No. T23B for Fiscal Year 1998-99. If the
ballots have a majority of "No" votes, the Council may dissolve the district or adopt
the alternate Resolution No. 98-88 to levy the previous assessment rate.
BACKGROUND
Landscape Maintenance District Zone T23B, Mountain View Courtyards, was
transferred to the City from Los Angeles County on July 1, 1997. The City now has
responsibility for establishing and collecting the assessments and administering the
maintenance for these zones.
Each fiscal year, the City Council must determine the assessments for the parcels
within each zone of each Landscape District. On,April 28, 1998, City Council
adopted a resolution for the preliminary .Engineer's Report for Fiscal Year 1998-
1999, with the recommended assessments for each zone. The resolution also set a
public hearing on the zone for June 23, 1998, and authorized City staff to mail out
assessment ballots to the property owners within each zone.
Zone No. 123B consists of the maintenance of the common areas within the
Mountain View Courtyard townhomes. The rate recommended in the Engineer's
Report for Zone No. T23B is $460 per unit. The recommended rate provides a full

level of landscape maintenance service. This rate is an increase over last fiscal
year's assessment of $176.
In accordance with Proposition 218, "The Right to Vote on Taxes Act," any increase
in the annual assessment requires that all property owners affected must vote on
the new assessment. The assessment ballots were mailed out following the Council's
action, to be returned no later than the time and date of the public hearing.
City staff has attended many Association Board meetings and discussed the
proposed budget and rate extensively with the Board of Directors of the
Associations, the residents, and management companies. The Association wrote a
letter to the City Council in support of the proposed budget and rate. The
Association also mailed out a letter to all of the residents.
The final tabulation of the Assessment Ballots will be done prior to the close of the
public hearing. At least 50 percent "Yes" ballots of those property owners voting are
required for approval of the new annual assessment rate.

FISCAL IMPACT
Funds for these expenditures have been budgeted in the landscape district Account
Nos. 7524-7011 through 7524-9510, pending Council adoption of the budget. These
expenditures are also detailed in the Landscape District annual Engineer's report.

NOTICE OF A PUBLIC HEARING FOR THE ADOPTION OF A RESOLUTION
DETERMINING AND IMPOSING THE ANNUAL
ASSESSMENT FOR ZONE NOS. T23A AND T23B
SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1
PUBLIC NOTICE IS HEREBY GIVEN;
That a Public Hearing will be held before the City Council of the City of Santa Clarita for
the adoption of a resolution preliminarily approving the Engineer's Report and levying the
assessment for Zone Nos. T23A and T23B of Santa Clarita Landscape Maintenance
District No. 1. The Engineer's Report is on file with the City Clerk. The purpose of the
public hearing is to receive and consider public testimony regarding the District
improvements and receive assessable ballots on the proposed assessment for fiscal year
1998-99. The purpose of the District is to provide the maintenance for the landscaping and
landscaped areas within the districts.
The proposed assessment amounts are an increase over last year's assessments. The
rate for the zone T23A condominiums is $545.00 per unit for the maintenance of common
areas. The rate for the zone T23B townhomes is $ 460.00 per unit for the maintenance
of common areas. The total proposed assessment for Zone 23A is $ 208,190 and for Zone
23 B it is $ 72,220
The hearing will be held by the City Council in the City Hall Council Chambers, 23920
Valencia Boulevard, 1" floor, Santa Clarita, the 23rd day of June 1998, at or after 6:30 p.m.
Proponents, opponents, and any interested persons may appear and be heard on this

Landscape District Zone T23A was established for the maintenance of the common area within the
Association. The Board of Directors of the Association is required by law, Davis Sterling Act (DSA), as
well the Associations Covenants, Conditions and Restrictions (CC&Rs), to ensure that the common
areas of the Association are properly maintained. Unfortunately, the funds currently collected by the
City do not adequately cover the necessary expenses involved in maintaining the Association.
City staff members have met with the Board and presented the financial and historic status of the
Associations district. The Board held a special meeting, reviewed and discussed this information and the
options presented by the City.
The DSA and Association CC&Rs place a limit on the percentage increase allowed by the Board to
raise Association dues. Therefore, it is impossible to increase the dues sufficiently to fully fund for the
landscaping needs of the Association through the Association dues.
The Board, believing it would be more beneficial to have the district maintain the common area than
to have the Association maintain it, is in favor of the proposal presented by the City to provide
landscaping services for our Association. However, the Board does not feel comfortable in maldng this
decision on behalf of the Association members, but would rather the members themselves make it.
Therefore, please proceed with the mail out ballot for the members to vote on.

A RESOLUTION OF TBE CITY COUNCIL OF THE CITY OF SANTA
CLARITA, CALIFORNIA, CONFIRMING TBE DIAGRAM, AND TRE LEVY
AND COLLECTION OF ASSESSMENTS WITHIN ZONE T23B FOR
FISCAL YEAR 1998-99 AND CONFIRMING ASSESSMENTS PURSUANT
TO THE PROVISIONS OF PART 2 OF DIVISION 15 OF TBE CALIFORNIA
STREETS AND HIGHWAYS CODE AND AS PROVIDED BY ARTICLE
XIIID OF THE CALIFORNIA CONSTITUTION
WHEREAS, the City Council, by its Resolution No. 98-56 initiated proceedings
and declared its intention, to levy and collect assessments against lots and parcels of land within
Santa Clarita Landscape Maintenance District No. 1, Zone T23B (hereinafter referred to as
"Zone"), pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of
Division 15 of the California Streets and Highways Code, commencing with Section 22500, to
pay for the costs and expenses of operating, maintaining and servicing ornamental structures
landscaping and appurtenant facilities located within association common area within the
boundaries of the Zones; and
WHEREAS, the Engineer selected by the City Council has prepared and filed
with the City Clerk, and the City Clerk has presented to the City Council, a report in connection
with the proposed annual levy and collection of assessments against lots and parcels of land
within the Zone and the City Council did by previous resolution preliminarily approve such
report (the "Engineer's Report"); and
WHEREAS, the City Council desires to levy and collect assessments against lots
and parcels of land within the Zone for the fiscal year commencing July 1, 1998 and ending June
30, 1999, to pay for the costs and expenses of operating, maintaining and servicing ornamental
structures landscaping and appurtenant facilities located within association common area
within the boundaries of the Zone; and
WHEREAS, the City has conducted a mailed ballot election in connection with
the levy of assessments within the Zone in accordance with Article XIIID of the California
Constitution, and has tabulated ballots in accordance with the City of Santa Clarita's procedures
for the completion, return, and tabulation of Assessment Ballots.
NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby
resolve, determine and order as follows:
SECTION 1. Following notice duly given, the City Council has held a full and fair
public hearing regarding its Resolution No. 98-87, the Engineer's Report prepared in connection
with the District and the levy and collection of assessments, and considered all oral and written
statements, protests, and communications made or filed by interested persons, and has
tabulated all ballots. At the public hearing, the Engineer presented to the City Clerk and the
City Clerk presented to the City Council; the Engineer's Report.
SECTION 2. With respect to Zone T2313, the City Council hereby finds that
written protests have not been filed and not withdrawn representing property owners owning
less than 50 percent of the area of assessable land within each respective zone. All oral and
written protests and objections are hereby overruled by the City Council. The City Council
hereby further finds that a majority protest does not exist as defined in Section 4(e) of Article
XIIID of the California Constitution. The final tally of the ballots is to be incorporated in this
Resolution as Exhibit A.
SECTION 3. The City Council hereby orders the Engineer's Report as presented
by the Engineer at the public hearing and now on file in the office of the City Clerk. The City
Council hereby finds and determines with respect to each zone included in the Engineer's
Report, that:
(I) The land within the Zone will be specially benefited by the operation,
maintenance and servicing of ornamental structures, landscaping,
including trees, shrubs, grass and other ornamental vegetation, and
appurtenant facilities, including irrigation systems, located in public
places within the boundaries of the Zones; and
(II) The Zone includes all lands so benefited; and
(III) The net amount to be assessed upon the lots and parcels within the zone
in accordance with the assessment for fiscal year commencing July 1,
1998 and ending June 30, 1999, is apportioned by a formula and method
which fairly distributes the net amount among all assessable lots or
parcels in proportion to the estimated special benefits to be received by
each lot or parcel from the improvements; and
(IV) Only special benefits are assessed and no assessment is imposed on any
parcel, which exceeds the reasonable cost of the proportional special
benefit conferred that parcel.
SECTION 4. The City hereby orders the proposed improvements to be made as
set forth in the Engineer's Report, which improvements are briefly described as follows: The
operation, maintenance and servicing of ornamental structures, landscaping, including trees,
shrubs, grass and other ornamental vegetation, and appurtenant facilities, including irrigation
devices located in public places within the boundaries of the zone. Maintenance means the
furnishing of services and materials for the ordinary and usual maintenance, operation and
servicing of ornamental structures landscaping and appurtenant facilities, including repair,
removal or replacement of all or part of any of the ornamental structures, landscaping or
appurtenant facilities; providing for the life, growth, health and beauty of the landscaping,
including cultivation, irrigation, trimming, spraying, fertilizer and treating for disease or injury;
the removal of trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting
and painting of walls and other improvements to remove or cover graffiti. Servicing means the
furnishing of water and electricity for the irrigation ands control of the landscaping and the
maintenance of any of the ornamental structures or appurtenant facilities.
SECTION 5. The City Council hereby confirms the assessments set forth in the
Engineer's Report. The maintenance, operation and servicing of the ornamental structures,
landscaping and appurtenant facilities shall be performed pursuant to law. The County Auditor
of Los Angeles County shall enter on the County Assessment Roll opposite each lot or parcel of
land the amount of the assessment, and such assessments shall then be collected at the same
time and in the same manner as the County taxes are collected. After collection by the County,
the net amount of the assessment after deduction of any compensation due the County for
collection shall be paid to the City Treasurer.
. SCECTION 6. The assessments are in compliance with the provisions of the Act
and Article Xllm of the California Constitution, and the City Council has complied with all laws
pertaining to the levy of the annual assessments pursuant to the Act and Article XIIID of the
California Constitution.
SECTION 7. The assessments are levied for the purpose of paying the costs and
expenses of the improvements described in Section 4, above, for Fiscal Year 1998-99.
SECTION 8. The City Treasurer shall deposit all money representing
assessments collected by the County for the District to the credit of a special fund and any such
money shall be expended only for the maintenance, operation servicing of the landscaping and
appurtenant facilities as described in Section 4.
SECTION 9. The adoption of this Resolution constitutes the levy of assessments
for the fiscal year commencing July 1, 1998 and ending June 30, 1999.
SECTIONI0. The City Clerk is hereby authorized and directed to file the
assessments, or a certified copy of the assessment, with the County Auditor upon the adoption
of this Resolution.
SECTION 11. A certified copy of the assessments shall be filed in the office of
the City Clerk and shall be open for public inspection.

resolve, determine and order as follows:
SECTION 1. Following notice duly given, the City Council has held a full and fair
public hearing regarding its Resolution No. 98-88, the Engineer's Report prepared in connection
with the District and the levy and collection of assessments, and considered all oral and written
statements, protests, and communications made or filed by interested persons, and has
tabulated all ballots. The majority of the ballots were not in favor of the increase. At the public
hearing, the Engineer presented to the City Clerk and the City Clerk presented to the City
Council, the Engineer's Report.
SECTION 2. With respect to Zone T23B, the City Council hereby finds that
written protests have not been filed and not withdrawn representing property owners owning
less than 50 percent of the area of assessable land within each respective zone. All oral and
written protests and objections are hereby overruled by the City Council. The City Council
hereby further finds that a majority protest at the previously established rate does not exist as
defined in Section 4(e) of Article XIIID of the California Constitution. The final tally of the
ballots is to be incorporated in this Resolution as Exhibit B.
SECTION 3. The City Council hereby orders the modifications to the Engineer's
Report to be made, as presented by the Engineer as the public hearing and now on file in the
office of the City Clerk. The City Council hereby further orders the changes in the Engineer's
Report to delete the increase in assessments. The Engineer is hereby directed to file an
Engineer's Report as modified, with the City Clerk. The Engineer's Report, as modified, is
hereby approved.
SECTION 4. Based upon its review of the Engineer's Report, as modified, a copy
of which has been presented to the City Council and which has been filed with the City Clerk,
and other reports and information, the City Council hereby finds and determines with respect
to the Zone included in the modified Engineer's Report; that:
(I) The land within the Zone will be specially benefited by the operation,
maintenance and servicing of ornamental structures, landscaping,
including trees, shrubs; grass and other ornamental vegetation, and
appurtenant facilities, including irrigation systems, located in public
places within the boundaries of the Zones; and
(II) The Zone includes all lands so benefited; and
(III) The net amount to be assessed upon the lots and parcels within the zone
in accordance with the assessment for fiscal year commencing July 1,
1998 and ending June 30, 1999, is apportioned by a formula and method

Dear Property Owner(s):
In order to comply with proposition 218, Assessment Ballots must be sent to all property
owners within a Landscape Maintenance District. The following information along with the
enclosed attachments will help to answer many of the most commonly asked questions.
COMMONLY ASKED QUESTIONS
What is this ballot for? You are voting to decide as a neighborhood if you want to
increase the amount you pay annually for the maintenance of the landscaping in the
common areas and along parkways, around and within your complex, through a
Landscape Maintenance Assessment District.
What does a "yes" vote mean? If a majority of the property owners decide to vote "yes",
the City will continue to maintain the landscaping around your complex after July 1, 1998
and your assessment will increase to the amount shown on your Assessment Ballot.
What does a "no" mean? If your neighborhood decides to vote "no", the City Council has
two options. After considering the input from the public, they can dissolve the District. The
City would no longer maintain the landscaping. In your complex, your association would
be responsible for collecting funds and maintaining the landscaping; or the City Council
could adopt a resolution for the previously approved rate. Any additional funds required.
to operate the District to the satisfaction of the homeowners will be paid for by the
association. '
Why is an increase being proposed? The City, after assessing administrative duties for
the Landscape Maintenance Districts in April 1998 reviewed the needs of the District
against funding levels provided. The Engineer's Report (an annual review of assessments
in all Districts) indicated a shortage of funds available to continue to try and maintain the
District in it's current state. The proposed increase must be approved by Assessment
Ballot before it can be assessed.

What is the city's position ? The City maintains a neutral position on the outcome of
their process. As the administrators of your District, the City will provide service levels
commensurate with the funding provided by property owners through their Assessment
District. Under this process, property owners decide the level of maintenance they want.
When are Assessment Ballots due? All Assessment Ballots are due by the 5:00 P.M. on
June 23, 1998, the day of the public hearing. A public hearing scheduled by the City
Council will announce the results of the Assessment Ballot election, at which time the City
Council will take public comment and take action on the election results.
Where can l get more Info? Several public information meetings are scheduled for your
area. These meetings will help you fully understand the impact of the Assessment ballot
process to your common landscape areas.

PROCEDURES FOR THE COMPLETION, RETURN, AND TABULATION OF
ASSESSMENT BALLOTS
Completion of Ballots
Who may complete a ballot
An assessment ballot may be completed by the owner of the parcel to be assessed. As
used in these Procedures, the term "owner" includes the owner's authorized
representative.. If the owner of the parcel is a partnership, joint tenancy, or tenancy in
common, a ballot may be completed by any of the general partners, joint tenants, or
tenants in common. Except as set forth below, only one ballot may be completed for each
parcel.
Proportional assessment ballots
If a parcel has multiple owners, any owner may request a proportional assessment ballot.
If the ownership interest of the owner is not shown on the last equalized secured property
tax assessment roll, such request must include evidence, satisfactory to the City, of the
owner's proportional rights in the parcel. The City will provide the proportional ballot to the
owner at the address shown on the assessment roll. Any request for a ballot to be mailed
to another location must be made in writing and must include evidence, satisfactory to the
City, of the identity of the person requesting the ballot. Each proportional ballot will be
marked to show the date on which the ballot was provided, to identify it as a proportional
ballot and to indicate the owners proportional rights in the parcel. The City will keep a
record of each proportional ballot provided to an owner.
Duplicate ballots
If an assessment ballot is lost, destroyed or never received, the City will mail or otherwise
provide a duplicate ballot to the owner upon receipt of a request in writing delivered to the
City Clerk. The duplicate ballot will be marked to show the date on which the ballot was .
mailed or provided and to identify it as a duplicate ballot or a duplicate proportional ballot.
The same procedure applies to duplicate ballots or duplicate proportional ballots which are
lost, destroyed, or never received.
Marking and signing the ballot
To complete an assessment ballot, the owner of the parcel must (1) stamp or mark the
appropriate box supporting or opposing the proposed assessment, and (2) sign under
penalty of perjury, the statement on the ballot that the person completing the ballot is the
owner of the parcel or the owner's authorized representative. Only one box may be
stamped or marked on each ballot. Ballots must be completed in ink.
Only assessment ballots provided by the City will be accepted
The City will only accept ballots mailed or otherwise provided to owners by the City.
Return of Ballots
Who may return ballots
An assessment ballot may be returned by the owner of the parcel or by anyone authorized
by the owner to return the ballot.
Where to return ballots
Ballots may be mailed to the address indicated on the ballot. The City has provided return
postage on the ballot.
Ballots may also be delivered in person the City Clerk at City Hall, 23920 Valencia Blvd.,
Suite #300, Santa Clarita, CA, 91355, or delivered to the City Clerk at the public hearing
on the proposed assessment.
When to return ballots
All returned ballots must be received by the City Clerk prior to the time the City Council
closes the public input portion of the public hearing on the proposed assessment. The
public input portion of the public hearing may be continued from time to time. The City
Clerk will endorse on each ballot the date of its receipt.
The City Clerk will pick up mailed ballots at 5 p m. on the date scheduled for the public
hearing on the proposed assessment. To ensure that mailed ballots are received by the
City Clerk prior to the conclusion of the.public input portion of the public hearing, mailed
ballots must be received by the City prior to that time. Mailed ballots received after 5 p.m.
on the date scheduled for the public hearing will only be counted if the ballots are received
by the City Clerk prior to the conclusion of the public input portion of the public hearing.
The City makes no representation as to whether the public input portion of the public
hearing will be concluded on the.date scheduled for commencement of the public hearing..
or continued to alater date.
Withdrawal of assessment ballots
After returning an assessment ballot to the City, the person who signed the ballot may
withdraw the ballot by submitting a written statement to the City Clerk directing the City
Clerk to withdraw the ballot. Such statement must be received by the City Clerk prior to
the close of the public input portion of the public hearing on the proposed assessment. If
any ballot has been withdrawn, the person withdrawing the ballot may request a duplicate
ballot. The City Clerk will retain all withdrawn ballots and will indicate on the face of such
withdrawn ballots that they have been withdrawn.
Tabulation. of Ballots
Which assessment ballots will counted
Only ballots which are completed and returned in compliance with these procedures will
be counted. Ballots received by the City Clerk after the close the public input portion of the
public hearing on the proposed assessment will not be counted. Ballots which are not
signed by the owner will not be counted. Ballots with no boxes marked, or with more than
one box marked, will not be counted. Ballots withdrawn in accordance with these
procedures will not be counted.
The City will keep a record of each proportional orduplicate ballot mailed or otherwise
provided to an owner and will verify, prior to counting any duplicate ballot, that only one
ballot has been returned for the parcel (or for the owner in the case of proportional ballots).
If a non -duplicate ballot has been returned, the City will count the non -duplicate ballot and
disregard all duplicate ballots. If only duplicate ballots have been returned, the City will
count the earliest provided duplicate ballot and disregard the later provided duplicate
ballots. If an owner returns both a non -proportional ballot and a proportional ballot, the City
will count the proportional ballot and disregard the non -proportional ballot.
When and where ballots will be tabulated
The final tabulation of ballots will be performed, in view of those present, at the public
hearing following the close of the public input portion of the public hearing. The public
hearing may be continued from time to time for the purpose of tabulating ballots.
How ballots will be tabulated
The City may presort and determine the proportionate weight of the returned ballots prior
to tabulating the ballots. Ballots may be counted by hand, by computer or by any other
tabulating device.
Ballots will be tabulated by adding the ballots submitted in opposition to the assessment
and adding the ballots submitted in favor of --the assessment. Ballots shall be weighted
according to the -proportional. financial obligation of the affected property; provided,. _
however, that proportional ballots shall be weighted in accordance with the respective
ownership interests of each proportional ballot submitted. If one or more proportional
ballots are returned for a parcel and a non -proportional ballot is returned for the parcel the
non -proportional ballot will either be disregarded (if the same owner has returned a
proportional ballot) or treated as a proportional ballot (if the same owner has not returned
a proportional ballot).
Who will tabulate ballots
Ballots may be tabulated by the City Clerk, her designee, or by any of the staff and
consultants of the City.
Results of tabulation
The results of the tabulation will be announced following the completion of the tabulation
and entered in the minutes of the City Council meeting. If ballots submitted in opposition
to the proposed assessment exceed the ballots submitted in favor of the proposed
assessment (as tabulated above), the assessment will not be imposed.
Resolution of disputes
In the event of a dispute regarding whether the signer of a ballot is the owner of the parcel
to which the ballot applies, the City will make such determination from the last equalized
assessment roll and any evidence of ownership submitted to the City prior. to the
conclusion of the public hearing. The City will be under no duty to obtain or consider any
other evidence as to ownership of property and its determination of ownership will be final
and conclusive.
In the event of a dispute regarding whether the signer of a ballot is an authorized
representative of the owner of the parcel, the City may rely on the statement on the ballot
signed under penalty of perjury that the person completing the ballot is the owner's
authorized representative and any evidence submitted to the City prior to the conclusion
of the public hearing. The City will be under no duty to obtain or consider any other
evidence as to whether the signer of the ballot is an authorized representative of the owner
and its determination will be final and conclusive.

The City of Santa Clarita is currently conducting proceedings to form a landscape maintenance
assessment district in your neighborhood under the Landscaping and Lighting Act of 1972 (Division 15, Part 2
of the California Streets and Highways Code).. The City Council proposes to levy an assessment against
parcels in your complex, including your parcel, for fiscal year 1998/99. Assessment revenues will be used to
pay for the cost of maintaining and servicing landscaping, and appurtenant facilities in your complex.
Background
In past years, the City has annually levied assessments to pay for landscape maintenance within various
neighborhoods in the City.
California voters approved Proposition 218 in November 1996. Proposition 218 provides for property
owners to determine by ballot whether or not the City may continue to levy landscape maintenance assessments
for fiscal year 1998199. To give each neighborhood greater control over its own landscaping, the City again
proposes to form individual assessment districts for each of the City's neighborhoods. This way, property
owners in each neighborhood can decide whether they want the City to continue levying assessments to pay for
landscape maintenance in their neighborhood.
Proposed Assessment
The total proposed assessment for your assessment district (City of Santa Clarita Landscape
Maintenance Assessment District No. 1, Zone No. T23A for fiscal year 1998/99 is $208,190.00. The proposed
1998/99 assessment against your parcel is $545.00. This amount was calculated by dividing the total cost of
maintaining the landscaping within your assessment district by the number of assessable parcels within the
assessment district.
The Engineer's Report sets forth the total cost of the improvements to be made for fiscal year 1998199. If the
proposed assessment is approved, in subsequent fiscal years the City Council may thereafter impose the
assessment at any rate or amount that is less than or equal to the net assessment amount for fiscal year 1998199
(increased each year based upon the Consumer Price Index, All Urban Consumers, for the Los Angeles -
Anaheim -Riverside Area) without conducting another mailed ballot election.
