If ballots have a majority of "Yes" votes, adopt Resolution No. 98-80, confirming the ballot results and levy of the new assessments for the continued maintenance of Landscape Maintenance District Zone No. T23A for Fiscal Year 1998-99. - If the ballots have a majority of "No" votes, the Council may dissolve the district or adopt the alternate Resolution No. 98-81 to levy the previous assessment rate. Landscape. Maintenance District Zone T23A, Mountain View Courtyards, was transferred to the City from Los Angeles County on July 1, 1997. The City now has responsibility for establishing and collecting the assessments and administering the maintenance for these zones. Each fiscal year, the City Council must determine the assessments for the parcels within each zone of each Landscape District. On April 28, 1998, City Council adopted a resolution for the preliminary Engineer's Report for Fiscal Year 1998- 1999, with the recommended assessments for each zone. The resolution also set a public hearing on the zone for June 23, 1998, and authorized City staff to mail out assessment ballots to the property owners within each zone. Zone No. 723A consist of the maintenance of the common areas within the Mountain View Courtyard townhomes. The rate recommended in the Engineer's Report for Zone No. T23A is $545 per unit. The recommended rate provides a full level of ,. ►111 t t t., r". 4 landscape maintenance service. This rate is an increase over last fiscal year's assessment of $260. In accordance with Proposition 218, "The Right to Vote on Taxes Act," any increase in the annual assessment requires that all property owners affected must vote on the new assessment. The assessment ballots were mailed out following the Council's action, to be returned no later than the time and date of the public hearing. City staff has attended many Association Board meetings and discussed the proposed budget and rate extensively with the Board of Directors of the Associations, the residents, and the management companies. The Association wrote a letter to the City Council in support of the proposed budget and rate. The Association also mailed out a letter to all of the residents. The final tabulation of the Assessment Ballots will be done prior to the close of the public hearing. At least 50 percent "Yes" ballots of those property owners voting are required for approval of the new annual assessment rate. ALTERNATIVE ACTIONS Other action as determined by Council. FISCAL IMPACT Funds for these expenditures have been budgeted in the landscape district Account No. 7525-7011 through 752579510, pending Council adoption of the budget. These expenditures are also detailed in the Landscape District annual Engineer's report. The City currently manages our Landscape District Zone T23A, this district covers the common area landscaping for our Association. The district was developed in 1988 by the developer and was administered until last year by the County, The City took over the maintenance last year. When the County maintained the area the Association was never involved in any decision making or informed of the status of the District. Since the City took over we now understand how things work, and the property has never looked better. However, the property needs were not established well by the developer nor the County. No money was allowed for plant replacement, tree trimming, etc. Nancy Delange with the City and Penny Henson with Greenplace have worked very diligently on our behalf informing us of our choices and investigating other options. They have met with our Board on numerous occasions and have presented the financial and historic information on our District Our Board of Directors has reviewed the options presented by the City. In addition, we have obtained our own bids for work and they support the figures the City has presented. The CC&R's and the State Civil Codes place a limit on the percentage of increase in the monthly assessment which the Board sets annually; therefore, making it impossible to increase our assessments sufficiently to collect what is currently being collected— let alone the money needed for full funding. We as a Board unaniniously believe it is more beneficial to have the district maintain the areas than to have our Association maintain it. The Board is in favor of the proposal to provide an adequate level of landscape service for our common area. The Board does not want to take the responsibility upon themselves to make this decision for the property owners. The Board would like the residents to have the opportunity to make this decision. Please proceed with the mail out ballot for the residents to vote for the full level of service which our community needs. For your information the Homeowners have already been informed of this pending issue at last weeks Annual Meeting and in our monthly newsletters. We already have meetings planned in the community to answer questions concerning this issue. OF PART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE AND AS PROVIDED BY ARTICLE XIlID OF THE CALIFORNIA CONSTITUTION WHEREAS, the City Council, by its Resolution No. 98-56 initiated proceedings and declared its intention, to levy and collect assessments against lots and parcels of land within Santa Clarita Landscape Maintenance District No. 1, Zone T23A (hereinafter referred to as "Zone"), pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section 22500, to pay for the costs and expenses of operating; maintaining and servicing ornamental structures landscaping and appurtenant facilities located within association common area within the boundaries of the Zones; and WHEREAS, the Engineer selected by the City Council has prepared and filed with the City Clerk, and the City Clerk has presented to the City Council, a report in connection with the proposed annual levy and collection of assessments against lots and parcels of land within the Zone and the City Council did by previous resolution preliminarily approve such report (the "Engineer's Report"); and WHEREAS, the City Council desires to levy and collect assessments against lots and parcels of land within the Zone for the fiscal year commencing July 1, 1998 and ending June 30, 1999, to pay for the costs and expenses of operating, maintaining and servicing ornamental structures landscaping and appurtenant facilities located within association common area within the boundaries of the Zone; and WHEREAS, the City has conducted a mailed ballot election in connection with the levy of assessments within the Zone in accordance with Article XIIID of the California Constitution, and has tabulated ballots in accordance with the City of Santa Clarita's procedures for the completion, return, and tabulation of Assessment Ballots. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve, determine and order as follows: SECTION 1. Following notice duly given, the City Council has held a full and fair public hearing regarding its Resolution No. 98-80, the Engineer's Report prepared in connection with the District and the levy and collection of assessments, and considered all oral and written statements, protests, and communications made or filed by interested persons, and has tabulated all ballots. At the public hearing, the Engineer presented to the City Clerk and the City. Clerk presented to the City Council, the Engineer's Report. SECTION 2. With respect to Zone T23A, the City Council hereby finds that written protests have not been filed and not withdrawn representing property owners owning less than 50 percent of the area of assessable land within each respective zone. All oral and written protests and objections are hereby overruled by the City Council. The City Council hereby further finds that a majority protest does not exist as defined in Section 4(e) of Article XIIID of the California. Constitution. The final tally of the ballots is to be incorporated in this Resolution as Exhibit B. SECTION 3. The City Council hereby orders the Engineer's Report as presented by the Engineer at the public hearing and now on file in the office of the City Clerk. The City Council hereby finds and determines with respect to each zone included in the Engineer's Report, that: (I) The land within the Zone will be specially benefited by the operation, maintenance and servicing of ornamental structures, landscaping, including trees, shrubs, grass and other ornamental vegetation, and appurtenant facilities, including irrigation systems, located in public places within the boundaries of the Zones; and (II) The Zone includes all lands so benefited; and (III) The net amount to be assessed upon the lots and parcels within the zone in accordance with the assessment for fiscal year commencing July 1, 1998 and ending June 30, 1999, is apportioned by a formula and method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated special benefits to be received by each lot or parcel from the improvements; and (IV) Only special benefits are assessed and no assessment is imposed on any parcel, which exceeds the reasonable cost of the proportional special benefit conferred that parcel. SECTION 4. The City hereby orders the proposed improvements to be made as set forth in the Engineer's Report, which improvements are briefly described as follows: The operation, maintenance and servicing of ornamental structures, landscaping, including trees, shrubs, grass and other ornamental vegetation, and appurtenant facilities, including irrigation devices located in public places within the boundaries of the zone. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of ornamental structures landscaping and appurtenant facilities, including repair, removal or replacement of all or part of any of the ornamental structures, landscaping or appurtenant facilities; providing for the life, growth, health and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizer and treating for disease or injury; the removal of trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting and painting of walls and other improvements to remove or cover graffiti. Servicing means the furnishing of water and electricity for the irrigation ands control of the landscaping and the maintenance of any of the ornamental structures or appurtenant facilities. SECTION 5. The City Council hereby confirms the assessments set forth in the Engineer's Report. The maintenance, operation and servicing of the ornamental structures, landscaping and appurtenant facilities shall be performed pursuant to law. The County Auditor of Los Angeles County shall.enter on the County Assessment Roll opposite each lot or parcel of land the amount of the assessment, and such assessments shall then be collected at the same time and in the same manner as the County taxes are collected. After collection by the County, the net amount of the assessment after deduction of any compensation due the County for collection shall be paid to the City Treasurer. SECTION 6. The assessments are in compliance with the provisions of the Act and Article XHID of the California Constitution, and the City Council has complied with all laws pertaining to the levy of the annual assessments pursuant to the Act and Article XIIID of the California Constitution. SECTION 7. The assessments are levied for the purpose of paying the costs and expenses of the improvements described in Section 4, above, for Fiscal Year 1998-99. SECTION 8. The City Treasurer shall deposit all money representing assessments collected by the County for the District to the credit of a special fund and any such money shall be expended only for the maintenance, operation servicing of the landscaping and appurtenant facilities as described in Section 4. SECTION 9. The adoption of this Resolution constitutes the levy of assessments for the. fiscal year commencing July 1, 1998 and ending June 30, 1999. SECTION 10, The City Clerk is hereby authorized and directed to file the assessments, or a certified copy of the assessment, with the County Auditor upon the adoption of this Resolution. SECTION 11. The following information along with the enclosed attachments will help to answer many of the most commonly asked questions. COMMONLYASKED QUESTIONS What is this ballot for? You are voting to decide as a neighborhood if you want to increase the amount you pay annually for the maintenance of the landscaping in the common areas and along parkways, around and within your complex, through a Landscape Maintenance Assessment District. What does a "yes" vote mean? If a majority of the property owners decide to vote' yes", the City will continue to maintain the landscaping around your complex after July 1, 1998 and your assessment will increase to the amount shown on your Assessment Ballot. What does a "no" mean? If your neighborhood decides to vote "no", the City Council has two options. After considering the input from the public, they can dissolve the District. The City would no longer maintain the landscaping. In your complex, your association would be responsible for odllecting funds and maintaining the landscaping; or the City Council could adopt a resolution for the previously approved rate. The City, after assessing administrative duties for the Landscape Maintenance Districts in April 1998 reviewed the needs of the District against funding levels provided. CITY OF SANTA CLARITA LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT PROCEDURES FOR THE COMPLETION, RETURN, AND TABULATION OF ASSESSMENT BALLOTS Completion of Ballots Who may complete a ballot An assessment ballot may be completed by the owner of the parcel to be assessed. As used in these Procedures, the term "owner' includes the owner's authorized representative. If the owner of the parcel is a partnership, joint tenancy, or tenancy in common, a ballot may be completed by. any of the general partners, joint tenants, or tenants in common. Except as set forth below, only one ballot may be completed for each parcel. Proportional assessment ballots If a parcel has multiple owners, any owner may request a proportional assessment ballot. If the ownership interest of the owner is not shown on the last equalized secured property tax assessment roll, such request must include evidence, satisfactory to the City, of the owner's proportional rights in the parcel. The City will provide the proportional ballot to the owner at the address shown on the assessment roll. Any request for a ballot to be mailed to another location must be made in writing and must include evidence, satisfactory to the City, of the identity of the person requesting the ballot. Each proportional ballot will be marked to show the date on which the ballot was provided, to identify it as a proportional ballot and to indicate the owner's proportional rights in the parcel. The City will keep a record of each proportional ballot provided to an owner. Duplicate ballots If an assessment ballot is lost, destroyed or never received, the City will mail or otherwise provide a duplicate ballot to the owner upon receipt of a request in writing delivered to the City Clerk. The duplicate ballot will be marked to show the date on which the ballot was- . mailed or provided and to identify it as a duplicate ballot or a duplicate proportional ballot. The same procedure applies to duplicate ballots or duplicate proportional ballots which are lost, destroyed, or never received. Marking and signing the ballot To complete an assessment ballot, the owner of the parcel must (1) stamp or mark the appropriate box supporting or opposing the proposed assessment, and (2) sign under penalty of perjury, the statement on the ballot that the person completing the ballot is the owner of the parcel or the owner's authorized representative. Only one box may be stamped or marked on each ballot. Ballots must be completed in ink. Only assessment ballots provided by the City will be accepted The City will only accept ballots mailed or otherwise provided to owners by the City. Withdrawal of assessment ballots After returning an assessment ballot to the City, the person who signed the ballot may withdraw the ballot by submitting a written statement to the City Clerk directing the City Clerk to withdraw the ballot. Such statement must. be received by the City Clerk prior to the close of the public input portion of the public hearing on the proposed assessment. If any ballot has been withdrawn, the person withdrawing the ballot may request a duplicate ballot. The City Clerk will retain all withdrawn ballots and will indicate on the face of such withdrawn ballots that they have been withdrawn. Tabulation of Ballots Which assessment ballots will counted Only ballots which are completed and returned in compliance with these procedures will be counted. Ballots received by the City Clerk afterthe close the public input portion of the public hearing on the proposed assessment will not be counted. Ballots which are not signed by the owner will not be counted. Ballots with no boxes marked, or with more than one box marked, will not be counted. Ballots withdrawn in accordance with these procedures will not be counted. When and where ballots will be tabulated The final tabulation of ballots will be performed, in view of those present, at the public hearing following the close of the public input portion of the public hearing. The public hearing may be continued from time to time for the purpose of tabulating ballots. How ballots will be tabulated The City may presort and determine the proportionate weight of the returned ballots prior to tabulating the ballots.
