RECOMMENDED ACTION
Adopt Resolution No. 98-128.
BACKGROUND
The County is proposing to decrease the Developer Fee for the benefit of the Consolidated Fire Protection
District by 0.9%, from $.1930 per square foot to $.1913 per square foot of construction. The County of Los
Angeles Fire Department annually updates its Consolidated Fire Protection District Developer Fee Program.
This includes the adoption of the updated Detailed Fire Station Plan (Capital Improvement Plan). The. program
and plan began in 1992 with the approval of a joint agreement between the City and the County. The fee is
imposed on building permits. It has been adjusted annually, (sometimes decreased) as the needs change for
fire facilities. In accordance with the above agreement, it is appropriate for the City to decrease the fee
accordingly.
ALTERNATIVE ACTIONS
There are no alternative actions as identified by staff. The agreement requires the City's participation.
FISCAL IMPACT
Minor administrative expense to collect the fee and transmit it to the County.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARTTA
AMENDING RESOLUTION NO. 92-152 PERTAINING TO
DEVELOPER FEES FOR FUNDING OF FIRE PROTECTION FACILITIES
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby make the following findings of fact:
a. On July 14, 1992, the Council adopted Resolution No. 92-152 which established a
financing plan to fund fire protection facilities in.the benefit area designated as the Santa
Clarita Valley, as part of the Consolidated Fire Protection District of Los Angeles County.
b. On August 25, 1992, the Council adopted Ordinance 92-15 which authorized the
establishment of a fee to fund fire protection facilities.
C. On April, 13, 1993, the Council adopted Resolution No. 93-48 to amend Resolution No.
92-152, raising the fire fees to $.1937 per square foot of the new floor areas of buildings
for FY 93-94.
d. On September 14, 1993, the Council adopted Resolution No. 93-110 to amend Resolution
No. 93-48, lowering the fire fees to $.1876 per square foot of the new floor areas of
buildings for FY 93-94.
C. On July 7, 1994, the County of Los Angeles Board of Supervisors adopted a fire fee of
$.1868 per square foot.
f. On August 23, 1994, the Council adopted Resolution No. 94-93 amending Resolution No.
92-152 lowering the fire fees to $.1868 per square foot of the new floor areas of buildings
for FY 94-95.
g. On August 22, 1995, the Council adopted Resolution No. 95-102 amending Resolution
No. 94-93, lowering the fire fees to $.1820 per square foot of the new floor area of
buildings for FY 95-96.
h. On January 14, 1997, the Council adopted Resolution No. 97-3, increasing the fire fees to
$.1884 per square foot of the new floor area of buildings for FY 96-97.
On January 13, 1998, the City Council adopted Resolution No. 98-5, increasing the fire
fees to $.1930 per square foot of the new floor area of buildings for FY 97-98.
SECTION 2. The City Council does hereby determine and declare as follows:
Paragraph "h" of Section 3 of Resolution No. 92-152 is hereby amended to read as follows:
"h. The developer fee is based on a determination by the District of the required
service provision. During the City's sixth year of the program (1998-99), fees will
be $.1913 per square foot of the new floor area of buildings."
SECTION 3. The City Clerk shall certify to the adoption of this Resolution.

IT IS RECOMMENDED THAT YOUR BOARD, ACTING AS THE GOVERNING
BODY OF THE CONSOLIDATED FIRE PROTECTION DISTRICT:
At the conclusion of the public hearing to update the developer fee capital facilities plan,
decrease the developer fee for 1998-99 to $.1913 per square foot from the 1997-98 fee
of $.1930 to reflect current average costs associated with land acquisition, fire station
construction, equipment and administrative costs associated with fee collection and
project and facilities management, (a) find that the project is exempt from the California
Environmental Quality Act (CEQA) in that it approves fees for capital projects necessary
to maintain services within existing service areas (CEQA Guidelines Section 15273(a)4),
(b) find that the project will have no adverse effect on wildlife resources and authorize
the Consolidated Fire Protection District to complete and file a Certificate of Fee
Exemption for the, project with the County Clerk; and (c) adopt the attached resolution to
update the Developer Fee Program (Attachment A).

PURPOSE OF RECOMMENDED ACTION -
On July 12, 1990, your Honorable Board adopted a resolution establishing a County of Los
Angeles Developer Fee Program (Program) for the benefit of the Consolidated Fire
Protection District (District). The Program was implemented August 1, 1990 to fund the
acquisition, construction, improvement, and equipping of fire station facilities in the high-
growth, urban -expansion areas of the District. Two components of the Program, the
Developer Fee Detailed Fire Station Plan (capital facilities plan) and the fee amount, are
updated annually upon conclusion of a public hearing.
JUSTIFICATION
_. Pursuant to Government Code Section 66000, et. seq., the District has updated the developer
fee capital facilities plan to reflect fire station requirements based upon the most current
growth projections in the areas of benefit. In the next five years it is anticipated that 19
additional facilities will be needed within the areas of benefit at a cost of $24 million. The
need for these facilities is directly related to development in the areas of benefit.
The developer fee amount has been updated for Fiscal Year 1998-99 to $.1913 per square
foot, a decrease from the 1997-98 Fiscal Year fee of $:1930. The updated fee reflects
current average costs of land acquisition for a fire station site, fire station construction,
equipment, and administrative costs associated with fee collection and project and facilities
management. The Auditor -Controller has reviewed the updated fee amount and found it to
be reasonable. A summary of the fee calculation is attached (Attachment B).
FISCAL IMPACT
As of March 31, 1998, the total cumulative developer fee collections in the three areas of
benefit are as follows:

A final report detailing the total revenue collected and expended in Fiscal Year 1997-98 will
be submitted for review by your Board subsequent to the close of the fiscal year, pursuant to
Government Code requirements.
FINANCING
The developer fee update requires no funding to implement.
FACTS AND PROM IONS/LErAL REQUIREMENTS
Pursuant to Government Code Sections 66002 and 66018, notice of the public hearing to
update the capital improvement plan and the developer fee amount must be published in a
newspaper of general circulation in the three areas of benefit. The developer fee is exempt
from the provisions of Proposition 218.
County Counsel has approved as to form the attached resolution updating the capital facilities
plan and developer fee amount.

Not applicable.
1MEACT ON CURRENT SERVICES (OR PROJECTS):
The updated fee amount of $.1913 will be imposed in the unincorporated areas in the three
developer fee areas of benefit effective August 1, 1998. The updated developer fee amount
will not be imposed in the cities of Calabasas, Malibu, Santa Clarita, Lancaster, or Agoura
Hills until such time as the cities adopt resolutions updating the fee amount..

NEGATIVE DECLARATION/ENVIRONMENTAL IMPACT REPORT:
This project is statutorily exempt per Section 15273a(4) of the California Environmental
Quality Act, guidelines developed by the State Office of Planning Research. A Notice of
Exemption is attached.
CONCLUSION:
Upon conclusion of the public hearing, please instruct the Executive Officer of the Board to
return two (2) copies of this letter with the adopted Resolution to the Consolidated Fire
Protection District.

CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY
WHEREAS, on July. 12, 1990, the Board of Supervisors of the County of Los Angeles
approved and adopted a County of Los Angeles Developer Fee Program for. the benefit of the
Consolidated Fire Protection District of Los Angeles County (Developer Fee Program) in
Area of Benefit 1, Malibu/Santa Monica Mountains, Area of Benefit 2, Santa Clarita Valley,
and Area of Benefit 3, Antelope Valley, (collectively, "areas of benefit") effective August 1,
1990, which is to be updated annually thereafter; and
WHEREAS, once each year thereafter, the Board of Supervisors of the County of Los
Angeles has approved and adopted an annual update to the Developer Fee Program; and
WHEREAS, the County of Los Angeles desires to update the Developer Fee
Program, which includes the amount of the fee and the Developer Fee Detailed Fire Station
Plan in accordance with Government Code Sections.66000, et seq.; and
WHEREAS; the need for increased fire service resources to maintain services is
generated by the progress of development; and
WHEREAS, proposed developments in areas which are designated in the Los Angeles
County General Plan as urban expansion areas and areas identified as emerging expansion
areas require additional fire protection resources to maintain service; and
WHEREAS, without additional fire stations and equipment, there .will be insufficient
resources to maintain an adequate level of fire protection services in areas of rapid
development in Los Angeles County; and
WHEREAS, the areas of benefit of Antelope Valley, Santa Clarita Valley, and the
Malibu/Santa Monica Mountains are experiencing rapid expansion; and
WHEREAS, funding of fire protection services to accommodate development in the
existing areas of benefit of Antelope Valley, Santa Clarity Valley, and the Malibu/Santa
Monica Mountains is inadequate and will continue to be inadequate without an additional
funding source; and
WHEREAS, property tax revenues are generated after development occurs and are not
available when needed, nor are sufficient to implement and operate fire protection facilities to
address service demands in emerging urban expansion areas.
NOW, THEREFORE, the Board of Supervisors resolves, finds, and determines that:
1. The Developer Fee Program is for the purpose of obtaining funds for capital projects
necessary to maintain service within the existing service areas of the District, and as
such is statutorily exempt per Section 15273 a(4) of the California Environmental
Quality Act guidelines developed by the State Office of Planning and Research.
2. On ; 1998, a public hearing was held to update the
Developer Fee Program and to consider 1) the updated Developer Fee Detailed Fire
Station Plan dated April 1998 (Fire Station Plan), which serves as the capital
improvement plan and describes the acquisition, construction, installation, and
equipping of fire stations, attached hereto and incorporated herein; and 2) the updated
developer fee amount to be levied among the parcels within the areas of benefit.
3. It is determined that there are reasonable relationships between: 1) the developer
fee's use and the type of development projects on which the developer. fee is imposed,
2) the need for public facilities, fire stations and facilities, and the type of
development project on which the developer fee is imposed, and 3) the amount of the
developer fee and the cost of the public facilities, fire stations and facilities, or a
portion of the public facilities attributable to the development on which the developer
fee is imposed.

4. The Board of Supervisors approves and adopts the updated Los Angeles County
Developer Fee Program for the benefit of the Consolidated Fire Protection District of
Los Angeles County as follows: a) the updated developer fee amount will be based
on $.1913 per square foot of the new floor areas of buildings effective August 1,
1998; b) the updated Fire Station Plan is approved and adopted; and c) all other terms
and provisions of the Developer Fee Program as adopted by resolution of the Board
of Supervisors of the County of Los Angeles shall remain unchanged and in full force
and effect.

PREFACE
The Developer Fee Detailed Fire Station Pian (Plan) reflects fire service requirements as of April 1998 based upon
growth projections by the Los Angeles County Regional Planning Department and contacts by the Consolidated
Fire Protection District (District) with cities and developers who have shared their development plans with the
District.
The, Plan identifies 19 additional fire stations, 1 temporary facility, and the necessary capital equipment that will
be required from 1998-99 through 2002-03 in the areas of benefit, the funding requirements and time frames
provided that development occurs as anticipated. The Plan identifies any funding the District has advanced
from sources other than developer fees; these advances will be repaid when sufficient developer fee revenue is
generated.
The Plan, the Developer Fee Program, and the development economic environment will be reviewed annually
for modifications and updates.
DEVELOPER FEE DETAILED FIRE STATION PLAN
TERMS USED IN PLAN EXPLANATION
TIMING The fiscal year that the land purchase or construction of the fire station is
anticipated to begin. The availability of the facility (i.e. when it will be operational)
would be approximately one to two years from the actual start of construction.
FIRE STATION/LOCATION In most cases a site has not yet been purchased; the locations are therefore
approximate.
ANTICIPATED CAPITAL Based upon current land (one -acre site), construction and equipment costs.
Where appropriate, credit was given for the sale of an existing site, donation of
a site by the developer, etc. Where developers have already made contributions
to help offset the effect of their developments on the District, an appropriate,
pre -designated credit will be given towards the developer fee.
Apparatus includes the full cost of one engine and prorated costs of a truck,
unless otherwise noted.
No District overhead costs nor an inflation factor have been applied; all figures
are based on 1997-98 dollars.
AMOUNT BUDGETED Advances made by the District, to be repaid when developer fee revenues are
sufficient, are indicated. If no amount is budgeted, the Timing of the station may
be delayed until developer fee revenues are sufficient to fund the site acquisition
and/or construction of the station.

CONSOLIDATED FIRE PROTECTION DISTRICT
DEVELOPER FEE PLAN
I. DESCRIPTION OF PROJECT
The Developer. Fee Plan would continue to impose a developer fee on those lands (see
"Location of Project") which will benefit from the acquisition, construction, improvement,
and equipping of fire stations. The fee is needed because existing revenues are not adequate
to provide for the acquisition, construction, improvement, and equipping of fire stations.
The developer fee will fund public improvements when new developments require additional
fire facilities and related equipment.
An equitable fee of $0.1913 per square foot of floor area of improved property, with
provisions for periodically adjusting the fees based upon cost increases, would be collected
on new development within rapidly expanding areas.
2. LOCATION OF PROJECT
The Developer Fee Plan would cover designated areas of benefit, those geographical areas
!mown as the Malibu/Santa Monica Mountains, Santa Clarita Valley, and the Antelope
Valley. (See Exhibit 1 to the Initial Study attached).
3. MITIGATION MEASURES INCLUDED IN THE PROJECT TO AVOID POTENTIALLY
SIGNIFICANT EFFECTS _
No mitigation measures are necessary. Project is statutorily exempt per Section 15273 a(4)
and 14284 d(1) of the CEPA guidelines developed by the State Office of Planning and
Research.
4. FINDING OF NO SIGNIFICANT EFFECT
Based on the attached Initial Study, it has been determined that the project will not have a
significant effect on the physical environment.
INITIAL STUDY
DEVELOPER FEE PLAN
This Initial Study on the Developer Fee Plan was prepared by the Consolidated Fire Protection
District of Los Angeles County pursuant to the California Environmental Quality Act (Division
13, California Public Resources Code), the State Environmental Impact Report Guidelines
(Division 6, California Code of Regulations), and the County's Environmental Document and
Reporting Procedures.
1. LOCATION AND DESCRIPTION OF PROJECT
Location:
The Developer Fee Plan is applicable to the Antelope Valley, Santa Clarita Valley, and the
Malibu/Santa Monica Mountains. (See Exhibit A.)
Description:
The project consists of a developer fee for the acquisition, construction, improvement, and
equipping of fire stations in the location described above. The fee would defray the costs
of additional fire stations and equipment in these areas of rapid growth.
I COMPATIBILITY WITH GENERAL PLAN
The developer fee is consistent with the County General Plan as it implements. Plan policy
regarding the provision of adequate infrastructure to serve urban growth.
The developer fee is also consistent with Ordinance No. 86-0024 which established Chapter
22.68 of the Los Angeles County Code, providing for the establishment of fees to be paid
by subdividers or building permit applicants. It is thus consistent with the intent of proper
development.
3. ENVIRONMENTAL` SETTING
The .three areas of Las Angeles County in which a developer fee would continue to be
established are growing rapidly. The Antelope Valley lies in the northern desert, the Santa
Clarita Valley in the central mountains, and the Malibu/Santa Monica Mountains in the
coastal lowlands.
The Antelope Valley consists of desert plains, hills, buttes, and dry lake beds. The major
urban centers consist of Lancaster and Palmdale and several smaller unincorporated areas.
The majority of the area is gently sloping to the north and contains scattered vegetation..

The central mountains consist of the rugged San Gabriel and Santa Susana Mountain ranges.
Within this area exists several broad valleys, including the Santa Clarita Valley. These
valleys are covered with numerous plant species including Valley and Coastal Live Oak
trees.
The coastal lowlands are mostly urbanized except for some smaller valleys associated with
the Malibu and Santa Monica Mountains. Hillside vegetation consists of both hard and soft
chaparral species. The valleys to the north of these mountains are also covered with soft
chaparral and oak woodland species.
4. IDENTIFICATION OF ENVIRONMENTAL EFFECTS
Introduction:
As stated earlier, the developer fee is consistent with and implements the County General
Plan. The General Plan identifies areas suitable for urban development and sets policy for
appropriate infrastructure. The certified Environmental Impact Report prepared for the
General Plan analyzes the impact of potential growth. The proposed fee should be
considered a mitigation measure to minimize adverse impacts on fire service.
The County of Los Angeles and the Consolidated Fire Protection District of Los Angeles
County recognize that the developer fee will provide only the funding necessary to provide
the existing level of fire protection facilities. The increased tax base as a result of
development will provide funds for personnel, services, and supplies.
Natural Hazards:
No significant impacts will result from the continued implementation of a developer fee.
Eachdevelopment will be subject to its own initial study and environmental impact
documentation. Existing local codes and ordinances will apply to all development projects.
The developer fee will not result in noise impact.
Natural Resources:
No significant impact on biological resources or on open space areas designated, in the
Conservation and Open Space Element of the County General Plan will result from the
creation of a developer fee.
A developer fee will not result in air or water quality problems. Developer fees will
provide financial resources for fire protection facilities in designated areas of benefit.

Cultural Resources/Visual Qualities:
No impacts will result from these factors. Current California Environmental Quality Act
(CEQA) requirements will be applicable to new projects.
Services:
No adverse impacts on services—traffic/access, sewage disposal, education, utilities, and
fire. Fire facilities will be provided in areas of benefit by the creation of the developer fee,
thereby maintaining the existing level of service in developing areas.
Summary:
On the basis of this initial study, the developer fee for fire facilities and equipment will not
have a significant impact on the physical environment since it'will not:
07) conflict with existing adopted ordinances or environmental plans;
(b) have a substantial, demonstrable negative aesthetic effect;
(c) substantially affect any rare or endangered species of plant or animal or the habitat of
these species;
(d) interfere substantially with the movement of any resident fish or wildlife species, or
migratory fish or wildlife species;
(e) breach published national, state, or local standards relating to solid waste or litter
control;
(f) substantially degrade water quality;
(g) contaminate a public water supply;
(h) substantially degrade or deplete ground water recharge;
(i) interfere substantially with ground water recharge;
(j) disrupt or adversely affect prehistoric or historic archaeological sites, or a property
of historic or cultural significance to a community or ethnic or a social group; or a
paleontological site except as part of a scientific study of the site;
(k) induce substantial growth or concentration of population;
(1) cause an increase in traffic which is substantial in relation to the existing traffic
load and capacity of the street system;
(m) displace a large number of people;
0
(n) encourage activities which result in the use of large amounts of fuel, water, or energy;
(o) use fuel, water, or energy in a wasteful manner;
(p) increase substantially the ambient noise levels for adjoining areas;
(t) cause substantial flooding, erosion or siltation;
(r) expose people or structures to major geological hazards;
(s) extend a sewer trunk line with capacity to serve new development;
(t) substantially diminish habitat for fish, wildlife, or plants;
(u) disrupt or divide the physical arrangement of an establishing community;
(v) create a potential public health or safety hazard; or involve the use, production, or
disposal of materials which pose a hazard to people or animals or plant population in
the area affected;
(w) conflict with established recreational, educational, religious, or scientific uses of the
area.
5.. DISCUSSION OF WAYS TO MITIGATE SIGNIFICANT EFFECTS
No mitigation measures are necessary because the continued adoption of a developer fee will
not have a significant impact on the environment and such fees are categorically exempt.

At its meeting held June 23; 1998, the Board, acting as the governing body of the
Consolidated Fire Protection District, took the following action:

At the time and place regularly set, notice having been duly given, the following
item was called up for consideration:
Hearing on proposed update to the Developer Fee Program for
Fiscal Year 1998-99 to: 1) decrease Developer Fee from
$.1930 per sq, ft. to $.1913 per sq. ft. of new development, to reflect
(A current average costs associated with land acquisition, fire station
"� construction, equipment and administrative costs associated with
fee collection and project and facilities management, to be imposed
on three areas of benefit within the Consolidated Fire Protection
District of Los Angeles County: Malibu/Santa Monica Mountains,
Santa Clarita Valley and Antelope Valley (3 and 5), to be effective
August 1, 1998; and 2) approve the updated Developer Fee Detailed
Fire Station Plan, which serves as the capital improvement plan, to
reflect fire station requirements based upon the most current growth
projections in the areas of benefit; also approval of Categorical
Exemption and determination of exemption from provisions of the
California Environmental Quality Act, as further described in the
attached letter dated May 13, 1998 from the Fire Chief.
Barbara Herrera, representing the Fire Department, was duly swam and tested.
Opportunity was given for opponents and proponents to address the Board. No
interested persons addressed the Board.

On motion of Supervisor Antonovich, seconded by Supervisor Yaroslaysky,
unanimously carried (Supervisors Molina and Knabe being absent), the hearing was
closed and the Board took the following actions:
a. Made a finding that the project is exempt from the California
Environmental Quality Act, in that it approves fees for capital
projects necessary to maintain services within the existing
service areas (CEQA Guidelines Section 15273(a)(4);
b. Made a finding that the project will have no adverse effect on
wildlife. resources and authorized the Fire Chief to complete
and file a Certificate of Fee Exemption for the project with the
Registrar-Recorder/County Clerk; and
c. Adopted the attached resolution updating the Developer Fee
Program for Fiscal Year 1998-99 in the Malibu/Santa Monica
Mountains, Santa Clarita Valley and Antelope Valley for the
benefit of the Consolidated Fire Protection District of
Los Angeles County, which includes an updated Developer
Fee Detailed Fire Station Plan.
