RECOMMENDED ACTION
The City Council receive the report and provide direction to staff.
The Downtown Newhall Merchants Association has planned and organized the Fourth of July
Parade in the past. The City co-sponsors this event by paying for the street and lane closures,
traffic control and security costs, which are provided jointly by the City's Field Services
Department and the Sheriffs Department. The total costs for these services are estimated at
between $18,000 and $20,000 for the event.
In order to receive a Parade Permit from the City to hold an event of this type, the organizers
are required to provide liability insurance naming the City as additionally insured in the
amount of $1 million. However, this year the organizers are unable to provide insurance for
the event, and have asked that the City waive this requirement.
ALTERNATIVE ACTIONS
1. The City provides the insurance for the event.
Pros:
• The event, which is well attended and enjoyed by the community, will continue to
be held.
Cons:
• In effect, the City would become the sponsor of the event, accepting liability for all
claims arising as a result. This puts the City in a precarious position, because the
City would be responsible for claims, but would have no control over the
organization of the event. Since the City is self insured up to $250,000, any loss
would be paid directly out of this fund.
2. Encourage the sponsors to seek an umbrella agency, other than the City, to provide the
insurance.
