PUBLIC HEARING DATE: January 13, 1998 SUBJECT: INCREASE IN THE DEVELOPER FEES FOR FIRE PROTECTION FACILITIES IN ACCORDANCE WITH THE JOINT COLLECTION AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY RESOLUTION NO. 98-5 DEPARTMENT: Planning and Building Services Receive testimony and adopt Resolution No. 98-5. ' 11►!l The County is proposing to increase the Developer Fee for the benefit of the Consolidated Fire Protection District by 2.4%, from $.1884 per square foot to $.1930 per square foot of construction. The County of Los Angeles Fire Department annually updates its Consolidated Fire Protection District Developer Fee Program. This includes the adoption of the updated Detailed Fire Station Plan (Capital Improvement Plan). The program and plan began in 1992 with the approval of a joint agreement between the City and the County. The fee is imposed on building permits. It has been adjusted annually, (sometimes decreased) as the needs change for fire facilities. In accordance with the above agreement, it is appropriate for the City to increase the fee accordingly. ALTERNATIVE ACTIONS There are no alternative actions as identified by staff. Developer Fee Detailed Fire Station Plan (available for review in the City Clerk's reading file) sAcd\c ndhfeesfrs.m Adopted: -�a Agrenda gym: CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING INTENTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA TO INCREASE THE DEVELOPER FEE FOR THE BENEFIT OF THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY PUBLIC NOTICE IS HEREBY GIVEN: A public hearing will be held before the City Council of the City of Santa Clarita to consider and receive protests relating to the intention of the Council to increase the City of Santa Clarita Developer Fee for the benefit of the Consolidated Fire Protection District by approximately two and four tenths (2.4 %) percent from $.1884 to $.1930 per square foot of new building floor area for FY 97-98. This approximate 2.4% increase is based on information received by the Fire Department which reflects current average costs associated with land acquisition for a fire station site, fire station construction, equipment, and administrative costs associated with fee collection and project and facilities management. The public hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, First Floor, the 13th day of January, 1998, at or after 6:30 p.m. Proponents, opponents and any interested persons may be heard on this matter at this time. Further information may be obtained by contacting the City Clerk's office, Santa Clarita City Hall, 23920 Valencia Boulevard, Suite 300, Santa Clarita, CA' 91355. Any property owner within an area of benefit may file a written protest delivered to the City Council at, or prior to, the public hearing. The property owner may protest against any or all of the developer fee amount proposed to be levied. All protests must be in writing, signed by the property owner, and must contain a description of the property to clearly identify it. If the signer is not shown on the last equalized assessment roll as the property owner, the protest must have written evidence that the signer is the property owner. If you wish to challenge the action taken on this matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City of Santa Clarits. at, or prior to, the public hearing. Dawson, CMC City Clerk Publish Dates: Saturday, January 3, 1998 md Thursday, January 8, 1997 s: \council\fees&-a.mar RESOLUTION NO. 98-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA AMENDING RESOLUTION NO. 92-152 PERTAINING TO DEVELOPER FEES FOR FUNDING OF FIRE PROTECTION FACILITIES THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby make the following findings of fact: a. On July 14, 1992, the Council adopted Resolution No. 92-152 which established a financing plan to fund fire protection facilities in the benefit area designated as the Santa Clarita Valley, as part of the Consolidated Fire Protection District of Los Angeles County. b. On August 25, 1992, the Council adopted Ordinance 92-15 which authorized the establishment of a fee to fund fire protection facilities. C. On April, 13, 1993, the Council adopted Resolution No. 93-48 to amend Resolution No. 92-152, raising the fire fees to $.1937 per square foot of the new floor areas of buildings for FY 93-94. d. On September 14, 1993, the Council adopted Resolution No. 93-110 to amend Resolution No. 93-48, lowering the fire fees to $.1876 per square foot of the new floor areas of buildings for FY 93-94. e. On July 7, 1994, the County of Los Angeles Board of Supervisors adopted a fire fee of $.1868 per square foot. f. On August 23, 1994, the Council adopted Resolution No. 94-93 amending Resolution No. 92-152 lowering the fire fees to $.1868 per, square foot of the new floor areas of buildings for FY 94-95. g. On August 22, 1995, the Council adopted Resolution No. 95-102 amending Resolution No. 94-93, lowering the fire fees to $.1820 per square foot of the new floor area of buildings for FY 95-96. h. On January 14, 1997, the Council adopted Resolution No. 97-3, increasing the fire fees to $.1884 per square foot of the new floor area of buildings for FY 96- 97. SECTION 2. The City Council does hereby determine and declare as follows: Paragraph "h" of Section 3 of Resolution No. 92-152 is hereby amended to read as follows: "h. The developer fee is based on a determination by the District of the required service provision. During the City's fifth year of the program (1997-98), fees will be $.1930 per square foot of the new floor area of buildings." SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
