HomeMy WebLinkAbout1998-01-27 - AGENDA REPORTS - JPA AGMT (2)NEW BUSINESS DATE: SUBJECT: DEPARTMENT: CITY OF SANTA CLARITA AGENDA REPORT City Manager Item to be pre; Paul Zaengle January 27, 1998 JPA OF THE SELF-INSURANCE AUTHORITY City Manager's Office RECOMMENDED ACTION City Council adopt Resolution No. 98-12, APPROVING THE AGREEMENT ENTITLED "JOINT POWERS AGREEMENT OF THE SELF-INSURANCE AUTHORITY FOR EFFECTIVE RISK MANAGEMENT", and appoint Council members to serve as the City's principal appointee and alternate representative on the SAFER Board of Directors. The California Contract Cities Association's (CCCA) Board of Directors, at its meeting of May 7, 1997 approved the establishment of the Self -Insurance Authority For Effective Risk Management (SAFER) and directed continued negotiation with representatives of the County of Los Angeles to implement the SAFER program by finalizing indemnification agreements with the County. The SAFER JPA is being formed to allow the CCCA to directly administer the risk management needs of the Sheriffs Department. This would include overseeing the existing liability trust fund and handling the day to day claims administration duties. Attached for Council review is Resolution 98-12 which provides for the following: 1. Approves the Joint Powers Agreement of SAFER (the SAFER JPA); 2. Appoints a Council Member to serve as Representative to the SAFER Board of Directors; 3. Appoints a Council Member to serve as Alternate Representative to the SAFER Board of Directors; 4. Appoints the CCCA as the City's agent with respect to the negotiations with the County relating to the indemnification agreement in connection with the City's Sheriffs contract. The SAFER program will not go into effect until the indemnification's are approved and executed by each City. ALTERNATIVE ACTIONS 1. Council may choose not to enter into this Joint Powers Agreement. 2. Other direction as determined by Council. FISCAL IMPACT None by this action. ATTACHMENTS RESOLUTION 98-12 PPZ.safercadm RESOLUTION NO. 98-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THAT CERTAIN AGREEMENT ENTITLED "JOINT POWERS AGREEMENT OF THE SELF-INSURANCE AUTHORITY FOR EFFECTIVE RISK MANAGEMENT" WHEREAS, the City of Santa Clarita ("City) is a member of the California Contract Cities Association ("CCCA"); and WHEREAS, the CCCA is -establishing the Self -Insurance Authority For Effective Risk Management ("SAFER"). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve as follows: SECTION 1: The City Council of the City of Santa Clarita does hereby find, determine, and declare as follows: a. Applicable law, including, without limitation, California Government Code Section 6500 et seq. provides that two or more public agencies may by agreement jointly exercise any powers which are common to the contracting parties. b. Applicable law, including, without limitation, California Government Code Section 990.4, permits a local public entity to self -insure; to purchase insurance through an authorized carrier; to purchase insurance through a surplus lines broker, and/or to do any combination of the above. C. The public interest, convenience and necessity will be best served by execution and implementation of the Joint Powers Agreement of the Self -Insurance Authority for Effective Risk Management ("SAFER") (the."Agreement") which will allow parties hereto to pool their self-insured losses; purchase excess insurance and provide for administrative services in connection with a joint protection program; the City Council, based upon staff reports have found that it is economically feasible and practical for the parties to the Agreement to do so. SECTION 2: The City Council hereby approves the Agreement and authorizes the Mayor to execute the Agreement on behalf of the City. SECTION 3: The City Council hereby appoints a Council Member to serve as the City's principal appointee to the SAFER Board of Directors ("Representative"). SECTION 4: The City Council hereby appoints a Council Member to serve as the City's alternate representative to serve on the SAFER Board of Directors in the absence of the principal appointee. SECTION 5: The City Council hereby appoints the California Contract Cities Association to act as its Agent with respect to the negotiations with the County of Los Angeles (the "County") relating to an Indemnification Agreement by and between the City and the County in connection with that certain City -County Law Enforcement Services Agreement. SECTION 6: The City Clerk is hereby directed to transmit an executed copy of the Agreement and a certified copy of this resolution to Sam Olivito, Executive Director, California Contract Cities Association, 10810 Paramount Boulevard, Suite 202, Downey, California 90241. SECTION 7: The City Clerk shall certify to the adoption of this resolution. PASSED, APPROVED, AND ADOPTED THIS 19.
