HomeMy WebLinkAbout1998-10-13 - AGENDA REPORTS - LACFCD GVR (2)CONSENT CALENDAR CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by DATE: October 13, 1998 SUBJECT: TRANSFER OF STORM DRAIN TO THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD), GOLDEN VALLEY ROAD ASSESSMENT DISTRICT, M.T.D. NO. 1428 RESOLUTION NO. 98-115 DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council adopt Resolution No. 98-115 for the transfer and conveyance of the storm drain improvements to the LACFCD for purposes of operation, maintenance, repair, and improvements; and direct the City Clerk to transmit a copy of this report indicating the date and action taken, and three certified copies of the adopted Resolution to the Building & Safety/Land Development Division at the County of Los Angeles, Department of Public Works. BACKGROUND The construction of Miscellaneous Transfer Drain (M.T..D.) No. 1428 has been completed. The County has authorized that the transfer processing and resolution be accomplished before the final inspection and final notice of completion of the storm drain. The project is located at - Golden Valley Road, east of Green Mountain Drive in the Canyon Country area. A detailed description of the facilities is depicted on Los Angeles County Flood Control District Drawing Nos. 137-F143.1 through 137-F143.2 on file with the Director of Los Angeles County Department of Public Works. The storm drains were constructed by the City of Santa Clarita Assessment District No. 92-2 (Golden Valley Road), in accordance with the plans on file with the City (see attached Exhibit "A" showing the location of improvements). The agreements also provide that the work shall not be deemed completed until approved, accepted as complete, and transferred to LACFCD for maintenance. The City and County entered into an agreement on March 14, 1989, recorded as Document No. 89-1346418, which provides for the transfer of storm drains. City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm drains for public use. NO. 1428 October 13, 1998 - Page 2 ALTERNATIVE ACTIONS Do not transfer the storm drain to LACFCD and the City of Santa Clarita assume future maintenance responsibilities. As there is no special funding source for this maintenance, this would impact the general fund. Other direction as determined by City Council. FISCAL IMPACT No negative fiscal impact as recommended. RESOLUTION NO. 98-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. 1428 IN THE CITY OF SANTA CLARITA, FOR FUTURE OPERATION, MAINTENANCE, REPAIR, AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Miscellaneous Transfer Drain (M.T.D.) No. 1428, depicted on Los Angeles County Flood Control District Drawing Nos. 137-F143.1 through 137-F143.2 on file with the Director of Los Angeles County Department of Public Works; and WHEREAS, the City is authorized and empowered to, transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, recorded August 22, 1989, as Document No. 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of flood control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of said storm drain improvements and drainage system from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED, that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system depicted on Los Angeles County Flood Control District Drawing Nos. 137-F143.1 through 137-F143.2 on file with the Director of Los Angeles County Department of Public Works. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said documents and other instruments. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way have been conveyed to and accepted by District. RESOLUTION NO. 98-115 October 13, 1998 — Page 2 Reference is hereby made to District Drawing Nos. 137-F143.1 through 137-F143.2, the plans and profile of said storm drain improvements and drainage system on file in the office of. the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED, that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and recorded August 22, .1989, as Document No. 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated herein by this reference. The City Clerk shall certify to the adoption of this Resolution.
