Receive staff report, open the public hearing, accept public testimony and written protests, close the public hearing and the protest period. 2. Adopt Resolution No. 98-31, maldng findings regarding written protest, then direct staff to transmit the resolution and appropriate fees to LAFCO for final review and certification; or 3. If the hearing results in a sufficient number of written protests, continue the hearing to a date certain to take appropriate action. BACKGROUND The purpose of a protest hearing is to offer property owners within an area proposed for annexation, a final opportunity to protest the annexation. This annexation is termed an "uninhabited" annexation, meaning that no registered voters reside within its boundary. Therefore, by State law, the City Council must approve the annexation unless written protests have been filed by owners of land who own 50% or more of the total assessed value of land within the affected territory. If the percentage of opposition is 50% or greater, the City Council must deny the annexation. In this event, a minimum of one year must lapse before the annexation could resume. Mopted: 3" D - en / a f 7— The action before the Council is a resolution to approve findings on written protests and to approve and order Annexation No. 1995-06 (North Valencia). The annexation consists of approximately 858 acres of uninhabited land located south of Newhall Ranch Road, east of Avenue Anza, north of Magic Mountain Parkway and the Auto Center and west of Valencia Blvd. and Bouquet Canyon Road adjacent to the existing city limits in the North Valencia area (a map is attached to Resolution 98-31). The City Council adopted a Resolution of Application (No. 96-84) for this proposal on June 11, 1996 requesting that the Local Agency Formation Commission (LAFCO) initiate annexation proceedings. Portions of the property were prezoned on April 16, 1996 in accordance with the City's General Plan land use designations. With the Council adoption of the North Valencia Specific Plan, portions of the property were re -prezoned on January 13, 1998 to conform to the North Valencia Specific Plan. On February 11, 1998, the LAFCO held a public hearing and adopted a resolution that directs the City to proceed with a duly noticed public hearing and sets forth the reasons for the annexation and the terms and conditions established for the annexation by the LAFCO. If the annexation proceeds as scheduled, it will be complete within the next 10 days. FISCAL IMPACT The fiscal impact analysis prepared for the North Valencia annexation indicates that, after five years, the annexation and build -out of the associated North Valencia Specific Plan entitlements will result in a positive net fiscal benefit to the City of $160,000 per year.
