August 25, 1998 SUBJECT: ATAX SHARING RESOLUTION FOR SANITATION DISTRICT ANNEXATION NO. 299 RESOLUTION 98-105 DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Adopt Resolution 98-105, approving and accepting.the negotiated exchanged of property tax revenues resulting from Sanitation District Annexation No. 299. BACKGROUND Los Angeles County Sanitation District Nos. 26 and 32 provide wastewater treatment services cooperatively through the Santa Clarita Valley Joint Sewerage System. To provide wastewater treatment service to property located outside of the District's service area, the service area boundary must be expanded through the annexation process. As part of this process, a tax - sharing resolution to provide the required funding to the Sanitation Districts is adopted by the public agencies responsible for providing services to the subject property. Local agencies receiving an apportionment of property tax from the annexing area must determine the amount of tax revenues to be exchanged between the affected agencies. For this annexation, a total of 1.2607 percent of the annual tax increment attributable to the land area involved in the annexation will be transferred to Sanitation District No. 26. Of this total, the City is contributing 0.1243 percent of its revenues from the annual tax increment for the annexation area. The proposed. annexation area is for 24 multi -family attached residential units on seven acres located north of Soledad Canyon Road and east of Oak Spring Canyon Road. The property is consistent with the City's General Plan land use designation and zoning for the site (RM — Residential Moderate). This project was approved by the Planning Commission in 1990 with a mitigated negative declaration. Adopted:i Agenda ALTERNATIVE ACTIONS Other actions as determined by Council. FISCAL IMPACT As proposed, the annexation to Sanitation District No. 26 should result in no adverse fiscal impact to the City. "ANNEXATION NO. 299" WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies thatreceive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS, the governing bodies of the agencies signatory hereto have made determinations of the amount of property tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 26 entitled Annexation No. 299; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange of property talc revenues resulting from the annexation of territory to County Sanitation District No. 26 in the annexation entitled Annexation No. 299 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 1999, or after the effective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to County Sanitation District No. 26 atotal of 1.2607 percent of the annual tax increment attributable to the land area encompassed within Annexation No. 299. Said percentage has been determined on the basis of the following contributions. No additional transfer of property tax revenues shall be made from any othertaxing agencies to County Sanitation District No: 26 as a result of annexation entitled Annexation No. 299. 4. No transfer of property tax increments from properties within a community redevelopment project which are legally committed to a Community Redevelopment Agency shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board of Directors of County Sanitation DistrictNo. 26 of Los Angeles County, and the governing bodies of City of Santa Clarita, Castaic Lake Water Agency, and Greater Los Angeles County Vector Control District, signatory hereto. Enclosed are new duplicates of resolutions involving your city and others. The applicants have requested, in writing, annexation of their respective property into the County Sanitation Districts in order to receive off --site disposal of sewage. The resolutions are being distributed to all parties for signature in counterpart. Therefore, you will only be receiving signature pages for your city. Please execute the enclosed duplicate resolutions and return all copies to this office as you have in the past.
