SUBJECT: DECLARATION OF INTENTION TO VACATE LUTHER DRIVE
RESOLUTION NO. 98-38
DEPARTMENT: Transportation and Engineering Services
City Council adopt Resolution No. 98-38, declaring its intention to vacate that portion of Luther
Drive shown on Exhibit "A," and direct the. City Clerk to give notice of a public hearing to be
held on April 28, 1998. Notices will be published and posted as required by the Street Vacation
Act.
A portion of Luther Drive is being realigned as part of the development at the abandoned school
site in Canyon Country. The portion that is being realigned is no longer needed. Therefore,
it is in the City's interest to vacate the street to allow a parking lot to be shared by McDonalds
and the new theater.
The procedure governing the vacation of streets, alleys, and easements is set forth in the
Government Code. Briefly, the procedure calls for the Council to first adopt a Resolution of
Intention and set a date for a public hearing. The hearing may be held not less than 15 days
following the adoption of the Resolution of Intention. The hearing date of April 28, 1998 is
specified in the Resolution. Prior to the hearing, a notice will be posted along the right-of-way.
Utility easements will be reserved for gas and sewer facilities along the existing segment of
road to be vacated.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARITA, CALIFORNIA
DECLARING ITS INTENTION TO ORDER THE. VACATION OF
LUTHER DRIVE IN THE CITY OF SANTA CLARITA
WHEREAS, Luther Drive extending 350 feet south of Soledad Canyon Road is being
realigned and is no longer needed; and
WHEREAS, sewer and gas facilities will retain easements over the portion to be vacated;
and
WHEREAS, the proposed street vacation is determined to be a project and was reviewed
pursuant to the provisions of the California Environmental Quality Act.
THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being
Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City
Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as
follows:
SECTION 1. That it is the intention of the City Council of the City of Santa Clarita,
California, to order the vacation of Luther Drive as shown on Exhibit "A," located within the
City of Santa Clarita, proposed to be vacated under Resolution No. 98-38, which is on file and
open to public inspection in the office of the City Clerk of the City of Santa Clarita, California,
located at 23920 Valencia Boulevard, Suite 300, and referred to and by this reference
incorporated herein as part of this Resolution.
SECTION 2. The City Council of the City of Santa Clarita finds that the Planning
Commission has reviewed, considered, and adopted the Negative Declaration prepared for
Master Case 95-246 (Edwards Theater) which included the vacation of Luther Drive. The
Planning Commission certified the Negative Declaration on April 2, 1996.
SECTION 3. That the hour of 6:30 p.m. on Tuesday, April 28, 1998 at City Hall,
23920 Valencia Boulevard, within the City of Santa Clarita, is the time and place all persons
interested in or objecting to the proposed vacation of this public street may appear before the
City Council to be heard, offer testimony, and submit evidence in relation thereto.
SECTION 4. That the City Clerk of the City of Santa Clarita, California, is hereby
directed to cause "NOTICE OF STREET VACATION OF LUTHER DRIVE WITHIN THE CITY
OF SANTA CLARITA, CALIFORNIA, AND PUBLIC HEARING THEREON" to be published
and posted as required by the "Street Vacation Act of 1941," being Part 3 of Division 9 of the
Streets and Highways Code of the State of California; and the City Council of the City of Santa
Clarita hereby elects to proceed under the provisions of that Act.
SECTION 5. The City Clerk shall certify to the passage of this Resolution and shall
cause it to be published and posted in the manner prescribed by law.
