SUBJECT: SANTA CLARA RIVER TRAIL PHASE III — PROJECT NO. 99-047-02
PROJECT ACCEPTANCE
DEPARTMENT: Parks, Recreation, and Community Services
RECOMMENDED ACTION
City Council authorize that $18,600 be withheld from final payment to Gueno Development
Company for asphalt pavement non -conformances, and accept Santa Clara River Trail Phase
HI - Project No. 99-047-02. Direct the City Clerk to file the attached Notice of Completion and
release the project retention as provided for by law.
Direct staff to release the $18,600 funds withheld from final payment, provided the Contractor
ensures to the Departments satisfaction within 90 days that the expected service life of the trail
pavement has not been compromised.
Direct staff to adjust the following revenue and expenditure budgets to reflect the increase in
discretionary grant funding secured for the project:

BACKGROUND
On June 24, 1997, City Council awarded Project 99-047-02 to Gueno Development Company, Inc.
This project, which forms part of a regional trail system called the Santa Clara River Trail (see
attached project map), consisted of the construction of an off-road pedestrian and bicycle path
starting at the Valencia Boulevard bicycle bridge (near Creekside Road) and ending on Soledad
Canyon Road across from the Metrolink Station. The project, with the exception of the
rubberized asphalt pavement, was completed to the satisfaction of the Director of Parks,
Recreation, and Community Services on February 12, 1998.

The rubberized asphalt pavement for the project, as constructed, did not meet a number of
specification requirements. When reviewed independently, these non -conformances might be
considered minor in nature; however, staff is concerned that their cumulative effect may
adversely affect the 20 -year expected service life of this $92,000 bid item.
Staff has offered the Contractor three options since this issue was first brought the Contractor's
attention in October of 1997:
Option 1: Retain the services of an expert in the field of rubberized asphalt pavements and
implement the expert's recommendations (if any); or
Option 2: Apply a rubberized asphalt emulsion slurry to the asphalt pavement, and re -stripe
the trail; or
Option 3: Have the City withhold the estimated cost ($18,600) of the rubberized asphalt
emulsion slurry and trail re -striping, and accept the project as is.
The Contractor has made a good faith effort to have the pavement subcontractor resolve this
issue, but has been unable to do so. Since invoicing of grant funds for the completed project
must be submitted before the end of the fiscal year, staff recommends that Option 3 be
implemented at this time. Staff requests Council authorization to release the funds withheld
should one of the first two options be satisfied within 90 days.
In addition, and as a housekeeping matter, the appropriate revenue and expenditure accounts
for the project should be adjusted prior to the project audit to reflect increased discretionary
grant funds identified by staff. Staff recommends that the account adjustments described in the
Recommended Action section of this report be made at this time.
ALTERNATIVE ACTIONS
Other direction as determined by the City Council.
FISCAL IMPACT
The Council -authorized construction budget for the project was $1,136,906. The total cost for
construction, including the portion of work in dispute, was $1,132,543.71. Work was completed
approximately three weeks ahead of schedule.
This portion of the regional trail system was funded through a combination of Petroleum
Violation Escrow Account (PVEA), Public Facilities Act (PFA), Proposition C transportation
discretionary grant, Proposition 116 parks discretionary grant, and Developer fees.

NOTICE OF COMPLETION
The City of Santa Clarita, a municipal corporation, is the owner in fee, except for the right-of-way
and property easements upon which it has been constructed, of a certain public improvement
known as: Santa Clara River Trail Phase III - Project No. 99-047-02,
2. The City's address is: 23920 Valencia Boulevard, Suite 300, Santa Clarita, CA 91355-2196.
3. The general location of said public improvement is: along Valencia Boulevard and Soledad Canyon
Road, between Creekside Road and Commuter Way, in the City of Santa Clarita, County of Los
Angeles, State of California.
4. On June 24, 1997, a contract to construct said public improvement was awarded to: Gueno
Development Company, Inc., 714 W. Olympic Boulevard, Suite 1120,'Los Angeles, California
90015.
5. Work. under said contract was completed on February 12, 1998 to the satisfaction of the
Director of Parks, Recreation and Community Services, and was accepted by the City on
May 26, 1998.
