HomeMy WebLinkAbout1998-04-28 - AGENDA REPORTS - SC LMD 1 (2)AGENDA REPORT City Manager Item to be pres CONSENT CALENDAR DATE: April 28, 1998 SUBJECT: SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1 DECLARING INTENTION TO LEVY, BY BALLOT, ANNUAL ASSESSMENTS FOR ZONE NOS. 123A AND T23B, AND TO SET A DATE FOR A PUBLIC HEARING WITHIN THE MOUNTAIN VIEW/SECO CANYON LANDSCAPE DISTRICTS, RESOLUTION NO. 98-56 DEPARTMENT: Parks, Recreation, and Community Services City Council adopt Resolution No. 98-56, initiating proceedings for Santa Clarita Landscape Maintenance District No. 1, Zone Nos. T23A and T23B for Fiscal Year 1998-99. This resolution approves the preliminary Engineer's Report, declares the City's intent to collect annual assessments for Zones T23A & T23B, and sets a public hearing date for June 23, 1998. BACKGROUND For Fiscal Year 1997-1998, Landscape Maintenance District No. 1, Zones T23A and T23B were transferred to the City from Los Angeles County. The City now has responsibility for establishing and collecting the assessments and administering the maintenance for these zones. Each fiscal year, the City Council must determine the assessments for the parcels within each zone of each Landscape District. A resolution must be adopted which orders the preparation of a final Engineer's Report for Fiscal Year 1998-99; preliminarily approves the Engineer's Report which is on file with the City Clerk; and approves the Resolution of Intention and the recommended assessments for each zone. The resolution also sets a public hearing on the District for June 23, 1998, and authorizes City staff to mail out assessment ballots to the property owners within each zone. After careful consideration of Zones T23A and T23B, City staff has determined that adequate funding is not available to provide continuation of current service levels (see Attachment A). Pursuant to discussions with the homeowners' associations of both districts, it was determined that residents should decide on whether to: 1) increase the annual assessments; 2) dissolve the districts; or 3) keep the existing rate and substantially reduce service levels. In accordance with Proposition 218, The Right to Vote on Taxes Act©, any increase in the annual assessments requires that all property owners affected must have the opportunity to vote on the new assessment. The assessment ballots will be mailed out following the Council's action, to be returned no later than the time and date of the public hearing. A simple majority of ballots cast will be required for approval of the increased annual assessment. ALTERNATIVE ACTIONS Other direction as determined by the City Council. T23A AND T23B OF SANTA CLARITA LANDSCAPE.MAINTENANCE DISTRICT NO. 1 FOR FISCAL YEAR 1998-99; AND ESTABLISHING- JUNE 23, 1998 AS THE DATE FOR A PUBLIC HEARING AND uFARIING OBJECTIONS THERETO: WHEREAS, the City Council, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California (the "Act ), desires to initiate proceedings for the Santa Clarita Landscape Maintenance District No. 1 (the "District"), Zone Nos. T23A and T23B, and for the levy and collection of annual assessments within Zone NOS. T23A and T23B for the Fiscal Year 1998-99, for the purposes and provided therefore, in the Act; WHEREAS, the improvements to be installed or maintained may include installation, construction or maintenance of any authorized improvements under the Act, including, but not limited to, one or more of landscaping, statuary, fountains, and other ornamental structures and facilities, park or recreational improvements and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or serving thereof, WHEREAS, Sections 22622 and 22624 of the Act require that the City adopt a resolution generally describing any new improvements or substantial changes in existing improvements within the existing District and any zones therein and order the assessment engineer to prepare and file a report in accordance with Article 4 of the Act for the existing District; 13 WHEREAS, the Assessment Engineer has filed with the City Clerk the Engineer's Report required by Article 4 of the Act (the Engineer's Report). The report is incorporated by reference as part of this resolution. All interested persons are referred to the Engineers Report for a full and detailed description of the proposed boundaries of the existing District and any zones therein, the improvements, and the proposed assessments upon the assessable lots and parcels of land within the existing Zone Nos. T23A and T23B within the District; _ WHEREAS, Santa Clarita LIVID District No. 1, Zone Nos. T23A and 723B, which were administered by the County are now entirely located within the territorial boundaries of the City of Santa Clarita (the "City"); and each zone was originally formed by developer petition; NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve, determine and declare as follows: SECTION 1. RECITALS. The above recitals are true and correct, SECTION 2. Santa Clarita LMD District No. 1, Zone Nos. T23A and T23B are generally described as including, but not limited to: Landscaping and maintenance of the common areas within the condominiums and townhomes within the Mountain View/Seco Canyon annexation. The rate for Zone No. 723A is $545 per unit. The rate for Zone No. 723B is $460 per unit. These rates are an increase over last year's rates of $260 for T23A and $176 for T23B. SECTION 3. ENGINEER'S REPORT. The City hereby finds that each and every part of the Engineer's Report is sufficient and the City hereby preliminarily approves, passes on and adopts the Engineer's Report as submitted to the City Council and filed with the City Clerk. The report shall stand as .the Engineer's Report for the purpose of all subsequent proceedings. The City Council does hereby make reference to the Engineer's Report, which indicates the amount of the proposed assessments, the zone boundaries, detailed description of improvement, and the method of assessments. The report titled Engineer's Report for Santa Clarita Landscape Maintenance District No. 1 and Assessment Levy for Fiscal Year 1995-99 is on file in the office of the City Clerk and reference to said report is hereby made for all particulars and the report shall be incorporated as part of this resolution. 4 SECTION 4. DESCRIPTION OF THE DISTRICT. The City Council hereby makes the expense of said work chargeable upon all the property within Zone Nos. T23A and 723B of the existing District, known as the Santa Clarita Landscape Maintenance District No. 1, which property is included within the exterior boundary line shown upon that certain map entitled "Diagram of the Landscape Maintenance District No. 1," indicating by said boundary lines the extent of the territory included within the existing District and which maps are on file in the office of the City Clerk. Reference is hereby made to said maps for further, full and a more particular description of the existing District, and said maps so on file shall govern for all details as to the extent of the District. SECTION 5. DESCRIPTION OF WORK. The public interest and convenience require, and it is the intention of the City Council to levy and collect annual assessments within existing Zone Nos. T23A and T23B within the District for the Fiscal Year 1998-99 within which the following work is to be done, to wit: The installation of landscape and irrigation improvements within the area to be maintained by the district, maintenance of the landscaping and any authorized improvements under the Act, including, but not limited to, landscaping, of turf areas, annuals and shrub areas and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation. This includes all work described in the Engineer's Report. SECTION 6. LOCATION OF WORK The foregoing described work is to be located within streets and easements of certain areas, all as more particularly described on the maps and the Engineer's Report on file with the City Clerk and incorporated in this resolution. SECTION 7. TIME AND PLACE OF PUBLIC HEARING. Notice of a public hearing is hereby given that on June 23, 1998, at the hour of 6:30 p.m., in the Council Chambers of the City Council in City Hall, at 23920 Valencia Boulevard, First Floor, Santa Clarita, California, any and all persons having any objections to the levy of assessment, may appear and show cause why said levy of assessment or work should not be approved in accordance with this Resolution of Intention. The City Clerk shall consider all oral and written protest. Written protests must be filed with the City Clerk prior to the conclusion of the hearing and shall state all grounds of objection and description sufficient to identify the property. The City Clerk is hereby directed to give notice of such public hearing pursuant to the Streets and Highways Code by causing a copy of this resolution to be published once in a newspaper of general circulation for the City of Santa Clarita not less than 21 days before the public hearing. The City Clerk is hereby directed to mail notice of the public hearing not less than 45 days before the public hearing, and to include assessment ballots to all property owners within Zone Nos.723A and T23B. T23A AND T23B, MOUNTAIN VIEW/SECO CANYON L INTRODUCTION This report is prepared in compliance with the requirements of Article 4, Chapter 1, of the Landscaping and Lighting Act of 1972, (hereinafter referred to as the "Act") which is Part 2, Division 15 of the California Streets and Highways Code. This report considers the two Zones, Nos. 723A and T23B as two distinct areas of Zone 723, of Santa Clarita Landscape Maintenance District No. 1 Last year the Landscape Maintenance District No. 1, Zones T23A and T23B were transferred into the City's Landscape Maintenance District No. 1. The County, through the Department of Parks and Recreation, had previously administered Landscape Maintenance District No. 1, Zone No. 23 (of which Zones 23A and 23B are a part) (Mountain View/Seco Canyon) which had provided for the maintenance and servicing of the landscape improvements located in the Mountain View/Seco Canyon area for the past several years. Pursuant to the Act, the City Council is the legislative body for the District and may levy annual assessments and act as the governing body for the operations and administration of the District. The Act provides for the levy of annual assessments after formation of an assessment district for the continued maintenance and servicing of the district improvements. The Act further allows various areas to be classified into separate zones when the territory in the zone receives substantially the same degree of benefit from the improvements. The costs associated with the installation, maintenance, and service of the improvements may be assessed to those properties which are benefited by the installation, maintenance, and service. RIGHT TO VOTE ON TAXES ACT (PROPOSITION 218) On November 5, 1996, the electorate approved Proposition 218, Right to Vote of Taxes Act, which added articles XIII C and XIII D to the California Constitution. The Proposition affects all assessments upon real property for a special benefit conferred on the property. Assessments imposed under the Landscaping and lighting Act of 1972 are these types of benefit assessments. However, the Proposition also exempts any assessments imposed when the person(s) owning all of the property agree(s) to the assessment when it was originally imposed if there is no increase from the previous year. Each and every parcel included in this zone (Zone T23AandT23B) were originally conditioned to install landscape improvements before the development could proceed. In order to preserve the investment in the landscape improvements and satisfy the required condition, Landscape Maintenance District No. 1, Zone Nos. T23A and T23B were formed. Each developer who owned all of the parcels subject to the assessment, agreed by petition to the formation and the April 28, 1998 City of Santa Clarita assessments being imposed. Subsequent owners of parcels were also made aware through title reports and Department of Real Estate "White Paper" reports that the parcels were in the district and subject to the assessments. Purchase of the parcel(s) was also an agreement by the new owners to be subject to the assessments. Therefore, the assessments for Landscape Maintenance District No. 1, Zones 23A and 23B are exempt from the provisions of Proposition 218. However, subsequent increases, if any, will be subject to the procedures and approval process of Section 4 of Article XIII D. This report is being provided to show a proposed increase in the collection o Me assessment to pay for costs incurred for the maintenance, servicing, and operation of the District. The City may initiate proceedings for the continued maintenance and servicing of the improvements by passing a resolution which generally describes any proposed new improvements or any substantial changes in existing improvements and order an engineer to prepare and file a detailed report. The report prepared by the engineer must include plans and specifications of the improvements, an estimate of the costs of the improvements, including maintenance and servicing them, a diagram, i.e., map of the assessment district showing the boundary of the district and the parcels or lots which benefit, and an estimate of costs of the improvements, maintenance, and servicing. Once the report is completed, it is presented to the City Council (the legislative body) for its review and approval as presented, or may be modified and approved. After the report is approved, the City adopts a resolution of intention which declares its intent to levy and collect assessments, describes the improvements, including maintenance and servicing, refers to the assessment district by its distinctive designation, refers to the report for the details of the district, and sets a time for a public hearing on the levy of the proposed assessment. Following the initial Council Meeting, the City will send a notice of the public hearing and an assessment ballot with which the property owners can vote on the increased assessment. At the public hearing, the City will count the ballots and considers public testimony in favor and/or opposing the assessment. The City Council may adopt a resolution confirming and levying the assessments to fund the maintenance and servicing of the improvements. Assessments, if authorized, would be placed on the 1998/99 County Tax Roll, and be collected with the regular County property taxes. Reserve funds would be used to fund the maintenance and service until assessment funds are distributed by the County Tax Collector in:December 1998. April28.1998 City of Santa Clarita ✓oL IL PLANS AND SPECIFICATIONS The proposed improvements for the Landscape Maintenance District include, but are not limited to, and may be generally described as follows: The operation, maintenance, and servicing of ornamental structures, landscaping, including trees, shrubs, grass, and other ornamental vegetation, and appurtenant facilities, including irrigation systems, devicesJocated in public places within the boundaries of the Landscape Maintenance District. Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of the ornamental structures, landscaping and appurtenant facilities, including repair, removal, or replacement of all or part of any of the ornamental structures, landscaping or appurtenant facilities; providing for the life, growth, health, and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, and treating for disease or injury; the removal of trimmings, rubbish, debris other solid waste; and pest control. Servicing means the furnishing of electricity for the operation of any appurtenant facilities, and water for the irrigation and control of the landscaping and the maintenance of any of the ornamental structures, landscaping, and appurtenant facilities. Plans and Specifications for the improvements for the Landscape Maintenance District are voluminous and are not bound in this report but by this reference are incorporated and made a part of this report. The plans and specifications are on file at the City. III. ESTIDIATED COSTS OF THE Il1IPRAVEMENTS The Act provides that the estimated costs of the improvements shall include the total cost of the improvements for Fiscal Year 1998/99, including incidentals, which may include reserves to operate the District until funds are transmitted to the City from the County, around December 10 of the next fiscal year. The Act also provides that the amount of any surplus, deficit, or contribution be included in the estimated cost of improvements. The net amount to be assessed on the lots or parcels within each district is the total cost of installation, maintenance, and servicing with adjustments either positive or negative for reserves, surpluses, deficits, and/or.contributions. Estimated costs of improvements for the Landscape Maintenance District are voluminous and are not bound in this report but by this reference are incorporated and made a part of this report. The estimated costs are on file at the City where they are available for public inspection. ASSESSMENT DIAGRAM The boundary map/diagram is included herein as Appendix B is part of this report. C 7010011 All assessed lots or parcels of real property within the district are listed on the Assessment Roll which is on file at the City, and is hereby make a part of this report by reference. The assessment roll states the net amount to be assessed upon assessable lands within the District for Fiscal Year 1998/99, shows the Fiscal Year 1998/99 assessment upon each lot and parcel within the District, and describes each assessable lot or parcel of land with the District. These lots and parcels are more particularly described in the County assessment roll, which is on file in the office of the Los.Angeles County Assessor and by reference is made a part of this report as Appendix A. Commencing with Fiscal Year 1998/99, the amount of the assessment for the District includes a yearly increase, based upon the Consumer Price Index, All Urban Consumers, for the Los Angeles -Anaheim -Riverside Area ("CPI"), as determined by the United States Department of Labor, Bureau of Labor Statistics, or its successor. The Engineer shall compute the percentage difference between the CPI for March of each year and the CPI for the previous March, and shall then adjust the existing assessment by an amount not to exceed such percentage for the following fiscal year. Should the Bureau of Labor Statistics revise such index or discontinue the preparation of such index; the Engineer shall use the revised index or a comparable system as approved by the City Council for determining fluctuations in the cost of living. VI. METHOD OF ASSESSMENT "Me ffCOOM91"Wol The Landscaping and Lighting Act of 1972 provides that assessments may be apportioned upon all assessable lots or parcels of land within the district or zone therein in proportion to the estimated benefits to be received from the improvements. SPECIAL BENEFIT Since landscaped areas are basic to the creation of the subdivision, the requirements for the improvements and the maintenance of the improvements were established as a prerequisite to the existence of the specific lot or parcel. The improvements were installed by the developer, subdivider of the land, and the continued maintenance was guaranteed through the establishment of a Landscape Maintenance District. If the installation of the improvements and the guaranteed maintenance did not occur, the lots would not have been established and could not have been sold to any distinct and separate owner. The establishment of each distinct and separate lot is a special benefit which permits the construction of a building or structure on the property and the ownership and sale of the distinct lot in perpetuity. April28, 1998 6 City of Santa Clan ta I& All the lots are established at the same time once the conditions regarding the improvements and the continued maintenance are guaranteed As a result, each lot within the district receives a special and distinct benefit from the improvements and to the same degree. Two areas receive landscape maintenance services which benefit those areas only. They are designated Zones T23A and T23B. The area outside of and surrounding the residential structures are landscaped areas which are owned in common by all the owners of the residential structures. These common as have landscaping improvements which are maintained by the District. Since these improvements are for the benefit of and the owners benefit from the maintenance of these improvements, only the owners of property within the sub -area are assessed for this benefit and its costs. T23AAND T23B, SECO CANYON/MOUNTAIN VIEW The assessment roll for the Landscape Maintenance District is hereby incorporated and made a part of this report. The Assessment Rolls are on file in the City, where they are available for public inspection. Reference is made to the Los Angeles County Assessment Roll for a description of the lots or parcels in each of the Assessment Districts. T23A AND T23B SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1 PUBLIC NOTICE IS HEREBY GIVEN; That a Public Hearing will be held before the City Council of the City of Santa Clarita for the adoption of a resolution preliminarily approving the Engineer's Report and levying the assessment for Zone Nos. T23A and T23B of Santa Clarita Landscape Maintenance District No. 1. The Engineer's Report is on file with the City Clerk. The purpose of the public hearing is to receive and consider public testimony regarding the District improvements and receive assessable ballots on the proposed assessment for fiscal year 1998-99. The purpose of the District is to provide the maintenance for the landscaping and landscaped. areas within the districts. The proposed assessment amounts are an increase over last year's. The rate for the zone T23A condominiums is $545 per unit for the maintenance of common area. The rate for the townhomes within the District Zone T23B is $460 per unit for the maintenance of common area.
