Brad Therrien DATE: November 24, 1998 SUBJECT: RESOLUTION OF INTENTION TO VACATE A PORTION OF SOLEDAD STREET, WEST OF OAK STREET, OFF OF SOLEDAD CANYON ROAD RESOLUTION NO. 98-139 DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council adopt Resolution No. 98-139, which declares its intent to vacate a portion of Soledad Street, and by order sets January 12, 1999 as the date of the'public hearing. BACKGROUND On March 18, 1998, the City received a request to vacate a portion of Soledad Street from Oak Street to a point approximately 306 feet westerly of Oak Street in the Canyon Country area. This request was made by Ojai Oil Company, the owners of Golden State Self Storage. This portion of Soledad Street lies between Golden State Self Storage and a parcel which Ojai Oil intends to purchase and develop as another. storage facility. This vacant portion of Soledad Street, which dead ends at the Los Angeles Department of Water and Power right-of-way, is required neither for street nor highway purposes, nor for general public access. There are utilities along the street for which easements will be reserved. The procedure governing the vacation of streets, alleys, and easements is set forth in the Government Code. Briefly, the procedure calls for the Council to first adopt a Resolution of Intention and set a date for a public hearing. The hearing may be held not less than 15 days following the adoption of the Resolution of Intention. The hearing date of January 12, 1999 is specified in the Resolution. Prior to the hearing, a notice will be posted along the right-of-way. ALTERNATIVE ACTIONS No alternative action identified by staff. FISCAL IMPACT None. There are utilities along the street for which easements will be reserved; and WHEREAS, the City Council of the City of Santa Clarita wishes to declare its intent to vacate a portion of Soledad Street, and order the time and place for the public hearing on this matter. NOW, THEREFORE, Pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, does resolve, declare, determine, and order as follows: SECTION 1. That the City Council of the City of Santa Clarita declares its intent to vacate that portion of Soledad Street, west of Oak Street off Soledad Canyon Road. That portion of Soledad Street to be vacated is described on Exhibit "A" and shown on Exhibit"B," attached hereto, and incorporated herein by this reference, which real property is located in the City of Santa Clarita, in the County of Los Angeles, State of California. SECTION 2. That the public hearing on this matter will be held at the regular City Council meeting in the City Council Chambers,- at City Hall, 23920 Valencia Boulevard, Santa Clarita California 91355, at 6:30 p.m., on January 12, 1999. At this time and place, all persons interested in or objecting to the proposed vacation of this public street may appear before the City Council to be heard, offer testimony, and submit evidence in relation thereto. SECTION 3. That the City Clerk of the City of Santa Clarita, California, is hereby directed to cause a "Notice of Street Vacation of Soledad Street, within the City of Santa Clarita, California, and Public Hearing Thereon" to be published and posted as required. SECTION 4. The City Clerk shall certify to the passage of this Resolution and shall cause it to be published and posted in the manner prescribed by law.
