Cushman DATE: May 26, 1998 SUBJECT: TRANSFER OF STORM DRAIN TO LOS ANGELES COUNTY FLOOD CONTROL DISTRICT (LACFCD) TRACT NO. 32365, P.D. 2089 RESOLUTION NO. 98-63 DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council adopt Resolution No. 98-63 for the transfer and conveyance of the storm drain improvements . to the LACFCD for purposes of operation, maintenance, repair, and improvements; authorize the Mayor to execute the attached Quitclaim Deed for the easements to the LACFCD on behalf of the City; and direct the City Clerk to transmit a copy of this report indicating the date and action taken, three copies of the unrecorded Quitclaim Deed properly executed and acknowledged, and three certified copies of the adopted Resolution to the Building & Safety/Land Development Division at the County of Los Angeles, Department of Public Works. BACKGROUND The construction of Private Drain (P.D.) No. 2089 has been completed. The County has authorized that the transfer processing and resolution be accomplished before the final inspection and final notice of completion of the storm drain. The project is. located at Dockweiler Drive and Valle del Oro in the Newhall area. A detailed description of the facilities is depicted on Los Angeles County Flood Control District Drawing Nos. 340-F21.1 through 340-F21.15 on file with the Director of Los Angeles County Department of Public Works. The storm drains were constructed by the developer, Westcreek Properties, in accordance with agreements and the Faithful Performance Bonds on file with the City (see attached Exhibit "A" showing the location of improvements). The agreements also provide that the work shall not be deemed completed until approved, accepted as complete, and transferred to LACFCD for maintenance. The City Council must approve a resolution authorizing the transfer to complete the process. The transfer is then accepted and approved by the Board of Supervisors for the LACFCD, who operates and maintains the storm drains for public use ALTERNATIVE ACTIONS Other direction as determined by City Council. FISCAL IMPACT No negative fiscal impact. EXHIBIT "A" CLV:cly/Pd2089 RESOLUTION NO. 98-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT THE TRANSFER AND CONVEYANCE OF THE STORM DRAIN IMPROVEMENTS KNOWN AS PRIVATE DRAIN NO. 2089 IN THE CITY OF SANTA CLARITA FOR FUTURE OPERATION, MAINTENANCE, REPAIR, AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE THEREOF WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Private Drain (P.D.) No. 2089, depicted on Los Angeles County Flood Control District Drawing Nos. 340-F21.1 through 340-F21.15.on file with the Director of Los Angeles County Department of Public Works; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County -Flood Control District any storm drain improvements and drainage systems for future operation, maintenance, repair, and improvement; and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated March 14, 1989, and recorded August 22, 1989, as Document No. 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles, whereby the City made certain warranties about its future transfers and conveyances of flood control facilities to the District; and WHEREAS, the best public interest will be served by transfer and conveyance of said storm drain improvements and drainage system from the City to the Los Angeles County Flood Control District for future operation, maintenance, repair, and improvement. NOW, THEREFORE, BE IT RESOLVED, that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system depicted on Los Angeles County Flood Control District Drawing Nos. 340-F21.1 through 340-F21.15 on file with the Director of Los Angeles County Department of Public Works. BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said documents and other instruments. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights-of-way for said drain now vested in the City and all other necessary rights-of-way have been conveyed to and accepted by District. RESOLUTON NO. 98-63 May 26, 1998 — Page 2 Reference is hereby made to District Drawing Nos. 340-F21.1 through 340-F21.15, the plans and profile of said storm drain improvements and drainage system on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for further data as to the exact location, extent, and description of said storm drain improvements and drainage system. BE IT FURTHER RESOLVED, that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated March 14, 1989, and. recorded August 22, 1989,. as Document No. 89-1346418, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated herein by this reference. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this day of ,19_.
