HomeMy WebLinkAbout1998-06-09 - AGENDA REPORTS - VACATION OF DUPONT PLACE (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: DATE: JUNE 9,1998 SUBJECT: SUMMARY VACATION OF DUPONT PLACE AND A PORTION OF WESTINGHOUSE PLACE RESOLUTION NO. 98-72 DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council adopt Resolution No. 98-72 for the summary vacation of Dupont Place and a portion of Westinghouse Place; and direct the City Clerk to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles. BACKGROUND Due to a change in the proposed development of the lands included in Parcel Map Nos. 18400 and 18789, these portions of public street, as dedicated on said parcel maps, are no longer needed for the proper development of the site. On March 3, 1998, the Planning Commission adopted Resolution P98-07 and accompanying mitigated negative declaration for a conditional use permit for this site. Under. Section 8334 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes, or a portion of a street or highway that lies within property under one ownership and that does not continue through such ownership or end touching another property. The property included within these parcel maps has not previously been developed, and there are no public or private utilities within the street right-of-way proposed to be vacated. ALTERNATIVE ACTIONS No alternative actions identified by staff, as this action is consistent with approvals by the Planning Commission for the development of the site. FISCAL IMPACT None. ATTACHMENTS Resolution No. 98-72 Exhibit"P'— Vicinity Map and Site Map LPC lklei2.doc Mo ga: Agenda Item: RESOLUTION NO. 98-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA VACATING DUPONT PLACE AND A PORTION OF WESTINGHOUSE PLACE IN THE CITY OF SANTA CLARITA WHEREAS, Dupont Place and Westinghouse Place north of Avenue Stanford are not required for the proper development of the property within Parcel Map Nos.18400 and 18789; and WHEREAS, under Chapter 4, Summary Vacation, of Part 3 of Division 9 of the Streets and Highways Code of the State of California, no public hearing is required and no public hearing was held. THEREFORE, pursuant to the provisions of Section 8334 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That it is hereby found and determined that Dupont Place and Westinghouse Place, as described on Exhibit "A" and shown on Exhibit `B" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, are no longer needed for present or prospective use based on the following facts: That this right-of-way is considered to be excess.right-of-way and is not required for street or highway purposes; and that this right- of-way lies within property under one ownership and does not continue through such ownership or end touching another property. SECTION 2. That within the right-of-way of Dupont Place and Westinghouse Place to be vacated, no public utility facilities exist that would be affected by the vacation. SECTION 3. The City Council of the City of Santa Clarita finds that the Planning Commission has reviewed, considered, and adopted the Mitigated Negative Declaration prepared for Master Case No. 98-007 (American Assets), which included the vacation of Dupont Place and a portion of Westinghouse Place. The Planning Commission certified the Mitigated Negative Declaration on March 3, 1998 by adoption of Resolution No. P98-07. SECTION 4. That the City Clerk of the City of Santa Clarita be instructed to record the certified original resolution, in the .office of the Registrar -Recorder of the County of Los Angeles, at which time the streets vacated will no longer be public streets.
