--4 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE:. September 8, 1998 City Manager Item to be pre; SUBJECT: PROPOSED VERMONT/EVERETT ASSESSMENT DISTRICT 98-1. DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council direct staff to proceed with the formation process of Vermont/Everett Assessment District 98-1and to prepare a formal petition and informational letter to be mailed to all property owners involved describing the district, procedures, and estimated assessments. BACKGROUND In early 1994, residents along Everett Drive and Vermont Drive, south of Lyons Avenue, approached the City regarding the deteriorating condition of their private road due to surface water runoff. Since that time, staffs assessment consultants have prepared preliminary estimates for constructing storm drain, sewer, and road improvements to eliminate the surface water runoff situation. These costs were then presented to the property owners as part of the formation of an assessment district to be formed to fund these improvements. After several attempts by the property owners to gather enough support, the residents have verbally expressed that they will support the assessment district on the condition that the City contribute $200,000 to the district. This was approved by the City Council on March 24, 1998. This amount is included in the Capital Budget. To move forward with the formation process, a formal petition will be prepared and circulated to all property owners along with an informational letter describing the assessment district, in detail. Once the petition is returned, it will be reviewed for the accuracy of the signatures. If there are signatures representing 60 percent or more of the land area to be assessed in favor of the district, the City can proceed with an Engineer's Report and Resolution of Intention initiating.the district. app6°�Oo�'[�D Agenda Item:—I-- PROPOSED VERMONTIEVERETT ASSESSMENT DISTRICT 98-1 September 8, 1998 — Page 2 If there is not enough signature support, the City can still form the district through one of two options:- (a) receiving a letter from the Los Angeles County Department of Health Services declaring the need to install a sewer and storm drain improvements in the area for health reasons, or (b) preparing a 1931.Act Debt Limitation Report. The `31 Act Report is required to show that the amount of the proposed assessments do not exceed the true value of the property assessed. Once the `31 Act Report and the Engineer's Report are presented to the City Council, there will be a call for a public hearing and election to be held a minimum of 45 days later. At that time, all property owners will have a chance to vote on the continuation of the formation process and preparation of actual improvement plans. Citizens in the Vermont/Everett area have expressed a strong desire for the City to increase its financial contribution to the district to assist in defraying improvement costs to the affected property owners. . ALTERNATIVE ACTIONS Increase City contribution. Other action as determined by Council. FISCAL IMPACT To date, approximately $75,000 has been expended by the City in addition to the $200,000 currently budgeted. If successful, additional costs will be borne by the district.
