AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, RELATING TO SKATEBOARD PARKS AND ROLLER SKATING ON
PUBLIC PROPERTY AND ADDING SECTIONS 12.54.030 AND 12.54.040 TO THE SANTA
CLARITA MUNICIPAL CODE
WHEREAS, recent amendments to State law, including California Health & Safety Code
Section 115800 (a), provide that no operator of a public or private skateboard park shall permit
any person to ride a skateboard within the park, unless that person is wearing a helmet, elbow
pads, and knee pads; and,
WHEREAS, with respect to a skateboard park owned or operated by a local public
agency, including City of Santa Clarita, Health & Safety Code Section 115800 (b), provides that
the requirement imposed in Health & Safety Code Section 115800 (a) may be satisfied if the
local agency:
(1) adopts an ordinance requiring any person riding a skateboard at a public
skateboard park facility to wear a helmet, elbow pads, and knee pads; and,
(2) posts signs at the facility affording reasonable notice that any person riding a
skateboard at the facility must wear a helmet, elbow pads, and knee pads, and that
the failure to do so will subject the person to citation under the relevant local
ordinance; and
WHEREAS, California Health & Safety Code Section 115800.1 deems in-line skating by
an adult to be a hazardous recreational activity within the meaning of Section 831.7 of the
California Government Code if the following conditions are met:
(1) the local public agency has, by legislative action, designated specific public property
such as a recreational area, boardwalk, or park, in which in-line skating is
permitted; and,
(2) the designated area, boardwalk, or park is adequately posted with notices advising
the public that in-line skating in the designated area by adults is a hazardous
recreational activity and that the public entity may not be liable for injuries
incurred by persons participating in the hazardous recreational activity; and,
WHEREAS, the City Council finds that adoption of this Ordinance pursuant to its police
power is necessary to protect the public peace, safety, and general welfare.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, DOES HEREBY FIND AND ORDAIN AS FOLLOWS:
SECTION I. Section 12.54.030 is hereby added to the Santa Clarita Municipal Code
to read as follows:
"12.54.030. Protective Eauivment Reauired. All persons skateboarding, or roller
skating, including in-line skating, at a skateboard park owned or operated by the City
of Santa Clarita shall wear protective equipment including, at a minimum, a helmet,
knee pads, and elbow pads."
SECTION 2. Section 12.54.040 is hereby added to the Santa Clarita Municipal Code
to read as follows:
"12.54.040. Roller skating, including in-line skating, shall be permitted within
designated areas, including the City of Santa Clarita Trail System and any skatepark
owned and operated by the City of Santa Clarita."
SECTION 3. Severability. If any section, subsection, sentence, clause, phrase, or
portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall not affect the validity of the remainder
of this ordinance. The City Council hereby declares that it would have adopted this ordinance,
and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact
that any one or more sections, subsections, phrases, or portions have been declared invalid or
unconstitutional.
SECTION 4. The City Clerk of the City of Santa Clarita shall hereby certify the
adoption of this ordinance as required by law.
