A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA CLARITA, CALIFORNIA
AMENDING THE AGREEMENT BETWEEN THE
CITY OF SANTA CLARITA AND ATLAS REFUSE REMOVAL,
BLUE BARREL DISPOSAL AND SANTA CLARITA DISPOSAL FOR
INTEGRATED WASTE MANAGEMENT FOR RESIDENTIAL AREAS
WHEREAS, the City of Santa Clarita has adopted Resolution No. 91-27 relating to the granting
of exclusive franchises for the collection, recycling and disposal of solid wastes, green wastes and
recyclables within the city limits; and
WHEREAS, the City Council has entered into an agreement with Atlas Refuse Removal
Company, Santa Clarita Disposal Company and Blue Barrel Disposal Company to collect, pick
up, remove, recycle and dispose of solid wastes, green wastes and recyclables from all single
family residences and multi -family residences in the City of Santa Clarita; and
WHEREAS, the City of Santa Clarita is required by the California Integrated Waste
Management Act of 1989 to reduce waste being sent to local landfills by fifty (50) percent by the
year 2000; and
WHEREAS, the City of Santa Clarita is committed to reducing dependence on urban landfills
and opposed to the development of the proposed Elsmere Canyon Landfill; and
WHEREAS, the City Council has determined that increasing curbside recycling service to once
per week from twice per month will enhance customer service and increase the City's diversion
rate in compliance with the California Integrated Waste Management Act of 1989; and
WHEREAS, the City Council held a public hearing on January 13, 1998 to provide residents
with an opportunity to publicly express their level of satisfaction with the service performance
and to discuss other issues related to the franchises; and
WHEREAS, residents expressed concern over several issues including billing residents two to
three months in advance of the service being provided and lack of public knowledge of the
availability of extra services; and
WHEREAS, the franchised haulers have agreed that notification will be provided to residents
on all billing statements that payments can be made on a monthly basis if desired; and
WHEREAS, the franchised haulers have agreed to provide public education regarding the
services available to residential customers in a billing statement once at the beginning of the
calendar year and will provide similar public education information three times per year in
April, July and October, unless otherwise directed by the City, through advertising in local
newspapers; and
WHEREAS, Resolution 98-13, hereinafter superseding Resolution 97-38, authorizing fees
._, necessary for collection services of solid wastes, yard trimmings and recyclables to all Santa
Clarita residents;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA does resolve
as follows:
SECTION 1: The frequency of curbside recycling services to single family and multi -family
residences are increased from twice per month to once per week, beginning July 1, 1998. The
attached amendment of the Franchise Agreements between the City of Santa Clarita and Atlas
Refuse Removal, Blue Barrel Disposal and Santa Clarita Disposal Companies reflecting this
service are adopted in accordance with this paragraph. Update Exhibit A-97-1 Schedule of
Rates, hereinafter referred to as Exhibit A-98. Update Exhibit C-97-1 Recycling Programs,
hereinafter referred to as Exhibit C-98.
SECTION 2: Single family and multi -family refuse service rates will remain unchanged for
a period of twelve (12) months beginning on January 1, 1998.
The attached amendment of the Franchise Agreement between the City of Santa Clarita and
Atlas Refuse Removal, Blue Barrel Disposal and Santa Clarita Disposal Companies suspending
the rate adjustment provisions in those agreements until January 1, 1999 are prepared in
accordance with this paragraph.
SECTION 3: All refuse billing statements that collect payments for more than one month at
a time will include a statement indicating that payment of the bill can be made on a monthly
basis.
SECTION 4: Public education information regarding the services available (including
discounts, recycling tags and stickers and any other special services available) to residential
customers will be included in a billing statement once at the beginning of the calendar year.
Similar public education information will be provided three times per year in April, July and
October, unless otherwise directed by the City, through advertising in local newspapers. Each
franchised hauler, on a rotational basis, shall assume responsibility for the costs, payable
directly to each designated newspaper, in which advertisements are placed by the City of Santa
Clarita.
SECTION 5: The City Clerk shall certify to the adoption of this resolution.

A. Grantee will cause at least twenty-five percent (25 %) of the waste stream to be collected under
this Franchise Agreement to be diverted from ultimate deposit in landfills or transformation facilities by January
1, 1995, in accordance with the regulations implementing the California Integrated Waste Management Act of 1989
(as amended) (also known as AB 939). In the event this Agreement remains in effect, grantee will cause at least
fifty percent (50%) of the waste stream, to be collected under this Franchise Agreement to be diverted from deposit
in landfills or transformation facilities by January 1, 2000.
B. Grantee shall upon execution of this agreement continue the twice per month commingled curbside
recycling collection program until June 30, 1998 and begin once per week collection on July 1, 1998 and weekly,
yard trimmings/green waste collection program for City households.
The Grantee shall furnish the curbside recycling services to the franchise area described in Exhibit A at
w cost to the City or to the program participant during the term of the program.
The Grantee shall purchase sufficient numbers of containers at its sole cost and distribute one (1) curbside
recycling container and one (1) yard trimmings/green waste container to each applicable household. Each curbside
recycling contairter shall be a minimum of 34 gallons in size, have a cover, be provided with wheels, color, bright
green, as approved by the City. Each yard trimmings/green waste recycling container shall be a minimum of 64
gallons in size, have a cover, be provided with wheels, color, charcoal -gray, as approved by the City. No initial
deposit will be charged to customers for the yard trimmings/green waste recycling container. Containers must be
compatible with a fully, or semi -automated collection system.
Households requesting additional containers for curbside recycling or tags for extra yard trimmings
collection will be provided by the Grantee annually in accordance with the rate provided in Exhibit A 9q 1 Exhibit
A-98. Grantee shall also collect all recyclables deposited in any approved container identified by an approved City
of Santa Clarita recycling sticker. Stickers shall be provided at Grantee's expense. Households requesting
additional containers for yard trimmings/green waste recycling will he charged a fee in accordance with Exhibit
A 99 1 Exhibit A-98.
From time to time a household may damage or destroy the recycling, or yard trimmings/green waste
container supplied by the Grantee. Grantee shall replace the recycling container at the expense of the household.
The Grantee shall make the replacement recycling containers available to any program participant at the fee, plus
delivery as set forth in Exhibit Ot 94-1 Exhibit A-98.
All recyclable materials collected through the program must be transported to a properly permitted
diversion facility, yard trimmings/green waste collected through the program must be delivered to a properly
permitted compost or mulching facility or material end-user. Recyclables or yard trimmings/green waste materials
that have been collected for the express purpose of diversion will not be taken to a landfill, unless the landfill
possesses other diversion facilities on site. The transport and disposal of recyclable materials and/or yard
trimmings/green waste in unauthorized facility, i.e., landfill, will constitute a material breach of agreement.
C. Exemption from the yard trimmings recycling program is subject to the rules outlined in the City
of Santa Clarita Integrated Waste Management Code.
D. Grantee will provide City with written reports in a form adequate to meet City's reporting
requirements to the California Integrated Waste Management Board, and to the County of Los Angeles throughout
.— the term of this Franchise Agreement wherein its performance under this program is set forth in detail.
AMENDMENT TO AGREEMENT BETWEEN

This amendment ("Amendment") entered into this _ day of January, 1998, is to the franchise
agreement for the collection, transportation, recycling, composting and disposal of solid waste,
yard trimmings/green wastes and recyclables ("Franchise Agreement") entered into between the
City of Santa Clarita ("City") and Atlas Refuse Removal ("Grantee") which was executed by the
parties on February 20, 1991.
The Franchise Agreement is therefore amended as follows:

amended as follows (new language is italicized, deleted language is stricken).
Once each week Grantee shall collect from Single -Family Residences solid
waste and yard trimmingalgreen waste (except bulky wastes and special
wastes) which have been placed, kept or accumulated in approved
containers, or bags or bundles, at curbside prior to Grantee's normal
weekly collection time. Recyclables placed in containers designated for
recyclables shall be collected on the first and third or second and fourth
pickup days of each month depending on the route schedule through June
30, 1998 and will begin weekly curbside collection of recyclables on July 1,
1998. Recycling programs shall be operated in accordance with
requirements outlined in EMIlBiT G 97 1 EXHIBIT C-98.
Grantee shall provide public education information, in a format mutually agreed
upon, regarding the services available (including discounts, recycling tags and
stickers and any other special services available) to residential customers in a
billing statement once at the beginning of the calendar year. Similar public
education information will be provided three times per year in April, July and
October, unless otherwise directed by the City, through advertising in local
newspapers. On a rotational basis, each Grantee, shall assume responsibility for the
costs, payable directly to each designated newspaper, in which advertisements are
placed by the City of Santa Clarita. Newspaper advertising costs shall not exceed
$500 per quarter. Grantee and City shall agree on the information contained in the

with the rates fixed by the City from time to time, all as described below and set forth in
the "Schedule of Rates", which is attached as EXHIBIT A-98.

Franchise Agreement shall be suspended for a period of 12 months beginning on January 1, 1998.

RECYCLING PROGRAMS of the Franchise Agreement will be deleted and replaced with
EXHIBIT A-98 SCHEDULE OF RATES and EKHIBIT C-98 RECYCLING PROGRAMS. The

separate items on customer's bills. Billings may be made monthly, in advance, for
all bin service customers, and may be made three (3) months in advance for all
residential customers. The following statement shall appear on all multiple month
billings: Payment can be made on a monthly basis if desired."
