HomeMy WebLinkAbout1998-04-28 - RESOLUTIONS - LMD T23A T23B (2)RESOLUTION NO. 98-56 A RESOI.L=QbLOF THE CITY COUNCIL OF TEE CITY OF SANTA CLARTTA, CALIFORNIA, INITIATING PROCEEDINGS FOR THE LEVY AND COLLECTION OF ANNUAL ASSESSMENTS FOR SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1, ZONE NOS. T23A AND T23B FOR FISCAL YEAR 1998-99, AND ORDERING THE PREPARATION AND FILING OF AN ENGINEER'S REPORT IN CONNECTION THEREWITH; PRELIMINARILY APPROVING THE ENGINEER'S REPORT FOR ZONE NOS. T23A AND 12313 OF THE SANTA CLARITA LANDSCAPE MAINTENANCE DISTRICT NO. 1 AND THE LEVY AND COLLECTION OF ANNUAL ASSESSMENTS FOR THE DISTRICT FOR FISCAL YEAR 1998-99. DECLARING ITS INTENTION TO LEVY AND COLLECT ANNUAL ASSESSMENTS FOR ZONE NOS. T23A AND T23B OF SANTA CLARITA -- LANDSCAPE MAINTENANCE DISTRICT NO. 1 FOR FISCAL YEAR 1998.99; AND ESTABLISHING JUNE 23, 1998 AS THE DATE FOR A PUBLIC REARING AND HEARING OBJECTIONS THERETO: WHEREAS, the City Council, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California (the "Act"), desires to initiate proceedings for the Santa Clarita Landscape Maintenance District No. 1 (the "District"), Zone Nos. T23A and T23B, and for the levy and collection of annual assessments within Zone Nos. T23A and 723B for the Fiscal Year 1998-99, for the purposes and provided therefore, inAhe Act; WHEREAS, the improvements to be installed or maintained may include installation, construction or maintenance of any authorized improvements under the Act, including, but not limited to, one or more of landscaping, statuary, fountains, and other ornamental structures and facilities, park or recreational improvements and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or serving thereof; WHEREAS, Sections 22622 and 22624 of the Act require that the City adopt a resolution generally describing any new improvements or substantial changes in existing improvements within the existing District and any zones therein and order the assessment engineer to prepare and file a report in accordance with Article 4 of the Act for the existing District; I WHEREAS, the Assessment Engineer has filed with the City Clerk the Engineer's Report required by Article 4 of the Act (the Engineer's Report). T8e report is incorporated by reference as part of this resolution. All interested persons are referred to the Engineers Report for a full and detailed description of the proposed boundaries of the existing District and any zones therein, the improvements, and the proposed assessments upon the assessable lots and parcels of land within the existing Zone Nos. T23A and T23B within the District; _ -- - WHEREAS, Santa Clarita LMD District No. 1, Zone Nos. 723A and T23B, which were administered by the County are now entirely located within the territorial boundaries of the City of Santa Clarita (the "City"); and each zone was originally formed by developer petition; NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve, determine and declare as follows: SECTION 1. RECITALS. The above recitals are true and correct, SECTION 2. Santa Clarita LbID District No. 1, Zone Nos. T23A and T23B are generally described as including, but not limited to: Landscaping and maintenance of the common areas within the condominiums and townhomes within the Mountain View/Seco Canyon annexation. The rate for Zone No. T23A is $545 per unit. The rate for Zone No. T23B is $460 per unit. These rates are an increase over last year's rates of $260 for T23A and $176 for T23B. SECTION 3. ENGINEER'S REPORT. The City hereby finds that each and every part of the Engineer's Report is sufficient and the City hereby preliminarily approves, passes on and adopts the Engineer's Report as submitted to the City Council and filed with the City Clerk. The report shall stand as the Engineer's Report for the purpose of all subsequent proceedings. The City Council does hereby make reference to the Engineer's Report, which indicates the amount of the proposed assessments, the zone boundaries, detailed description of improvement, and the method of assessments. The report titled Engineer's Report for Santa Clarita Landscape Maintenance District No. 1 and Assessment Levy for Fiscal Year 1998-99 is on file in the office of the City Clerk and reference to said report is hereby made for all particulars and the report shall be incorporated as part of this resolution. DESCRIPTION OF THE DISTRICT The City Council hereby makes the expanse of said work chargeable upon all the property within Zone Nos. T23A and T23B of the existing District, known as the Santa Clarita Landscape Maintenance District No. 1, which property is included within the exterior boundary line shown upon that certain map entitled "Diagram of the Landscape Maintenance District No. 1," indicating by said boundary lines the extent of the territory included within the existing District and which maps are on file is the office of the City Clerk. Reference is hereby made to said maps for further, full and a more particular description of the existing District, and said maps so on file shall govern for all details as to the extent of the District. SECTION 5. DESCRIPTION OF WORK. The public interest and convenience require, and it is the intention of the City Council to levy and collect annual assessments within existing Zone Nos. T23A and T23B within the District for the Fiscal Year 1998-99 within which the following work is to be done, to wit: The installation of landscape and irrigation improvements within the area to be maintained by the district, maintenance of the landscaping and any authorized improvements under the Act, including, but not limited to, landscaping, of turf areas, annuals and shrub areas and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof, including irrigation. This includes all work described in the Engineer's Report. SECTION 6. LOCATION OF WORK. The foregoing described work is to be located within streets and easements of certain areas, all as more particularly described on the maps and the Engineer's Report on file with the City Clerk and incorporated in this resolution. -FMOUN 7. TIME AND PLACE OF PUBLIC HEARING. Notice of a public hearing is hereby given that on June 23, 1998, at the hour of 6:30 p.m., in the Council Chambers of the City Council in City Hall, at 23920 Valencia Boulevard, First Floor, Santa Clarita, California, any and all persons having any objections to the levy of assessment, may appear and show cause why said levy of assessment or work should not be approved in accordance with this Resolution of Intention. The City Clerk shall consider all oral and written protest. Written protests must be filed with the City Clerk poor to the conclusion of the hearing and shall state all grounds of objection and description sufficient to identify the property. The City Clerk is hereby directed to give notice of such public hearing pursuant to the Streets and Highways Code by causing a copy of this resolution to be published once in a newspaper of general circulation for the City of Santa Clarita not less than 21 days before the public hearing. The City Clerk is hereby directed to mail notice of the public hearing not less than 45 days before the public hearing, and to include assessment ballots to all property owners within Zone Nos.T23A and T23B. SECTION 8. The City Clerk shall certify the adoption of the resolution. PASSED, APPROVED AND ADOPTED this 28th day of April . 1998/.
