HomeMy WebLinkAbout1999-05-11 - AGENDA REPORTS - ADVERTISING BAN TOBACCO PROD (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE: May 11, 1999 City Manager Approval Item to be presented by Kevin Tonoian SUBJECT: OUTDOOR ADVERTISING BAN ON TOBACCO PRODUCTS — RESOLUTION 99-75 DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Adopt Resolution No. 99-75 BACKGROUND As a result of the December 1998 National Association of Attorney Generals Master Settlement Agreement with the Tobacco Industry, the practice of promoting tobacco products through the use of outdoor advertising billboards was banned in 46 states in the nation, including California. Proposed Resolution No. 99-75 supports this important settlement agreement and acknowledges the City's substantial interest in protecting and promoting the general welfare of minors exposed to advertising of tobacco products. While there are several key provisions to this agreement, including a $206 billion dollar settlement that provides funds for public education efforts and reimbursements to medicare, staff would like to take a moment to discuss a few of the public health provisions in greater detail. The settlement agreement imposes a variety of restrictions on the tobacco industry including banning certain types of outdoor advertisements and the use of cartoon characters, and limiting the distribution of tobacco gear and free samples. Specifically, the settlement: Prohibits most outdoor advertising such as billboards, signs and placards for tobacco products (as of April 23, 1999); Bans the use of cartoons and cartoonlike qualities in tobacco advertising such as the "Joe Camel" campaign. Requires the tobacco industry to make billboards formally used for tobacco advertising available for anti-smoking messages The adoption of Resolution No. 99-75 is consistent with both the December 1998 Master Settlement Agreement, as well as Section 22961 of the California Business and Professions Code which already prohibits tobacco advertising on any billboard within 1,000 feet of a public Adopted: -5-o-44. Furthermore, the adoption of this resolution also supports Santa Clarita's long-standing philosophy of putting the interests and the well being of our youth first. Finally, the adoption of Resolution No. 99-75 is an appropriate action of the City Council, as it advances issues that Community Services Division seeks to address through a grant from the County of Los Angeles Department of Health Services Tobacco Control Program. This grant provides approximately $220,000 in funding to the City, and will be utilized to educate and inform the community about tobacco control issues. ALTERNATIVE ACTIONS Other action as determined by the City Council FINANCIAL IMPACTS There are no financial impacts to the City associated with the adoption of this resolution.
