Brad Therrien SUBJECT: RIGHT-OF-WAY AND EASEMENT ACQUISITION FOR GOLDEN VALLEY ROAD DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION Authorize the City Manager to negotiate with various property owners and purchase property for the acquisition of right-of-way and easements necessary for the construction of Golden Valley Road. BACKGROUND The City Council has entered into a development agreement with Santa Clarita Business Park for the development of Tract No. 42670 located south of Soledad Canyon Road between Ruether Avenue and Golden Oak. Included in that development agreement are provisions for the construction of Golden Valley Road from Golden Triangle Road southerly to Sierra Highway. The agreement requires the developer to pursue the acquisition of the necessary easements and rights-of-way and indicates that if the developer is unsuccessful, the City will pursue the necessary acquisitions. The developer has sent at least two letters and attempted to contact all affected property owners. To date, only two private property owners have agreed to sell two small parcels that are within the proposed right-of-way of the road. In order to meet established schedules for the construction of the road and the new high school, it is necessary for the City to assist in the necessary acquisitions. Cutler and Associates, a land acquisition consulting firm, is under contract with the developer to assist in the acquisitions. Appraisals of the affected properties are being finalized and the consultant is continuing to contact owners in an attempt to obtain their cooperation. Due to the number of separate parcels and owners involved, it is necessary to simplify the negotiation and acquisition process by allowing City staff to work directly with the property owners to finalize the purchases. This procedure will result in extending the acquisition time and construction schedules will not be met. 2. Appoint a special committee of Councilmembers to work with staff to acquire the needed property and easements. Although this will take less time than dealing with the entire Council at regularly scheduled meetings, there will still be problems in scheduling the necessary meetings due to the number of property ownerships involved. FISCAL IMPACT There should be no additional fiscal impact to the City from the action requested. The right-of-way and easements necessary to construct Golden Valley Road are being paid for by funds collected from new development within the Eastside Bridge and Thoroughfare District. Other fiscal impacts have been previously addressed during the processing of the development agreement for Santa Clarita Business Park.
