Conduct the public hearing, review the evidence presented, including this staff report and public comments, and close the hearing; 2. Adopt Resolution No. 99-17 of Necessity, authorizing the commencement of eminent domain proceeding so as to acquire the interests of the partial takes of Assessor Parcel Nos. 2831-011-039 and 2831-011-040 required for the construction of the Jan Heidt Newhall Metrolink Station; 3. Direct the City Attorney to file the actions expeditiously; 4. Authorize the City Manager or his designee to execute all documents necessary for the acquisition; 5. Authorize the City Manager or his designee to make deposits of funds from Account No. 52001206-8001, amounts totaling approximately $334,900.00 made payable to the Superior Court Clerk, to obtain Orders of Immediate Possession for the purposes of acquisition of the land required for the Jan Heidt Newhall Metrolink Station; 6. Appropriate $50,000.00 from the General Fund Council Contingency Fund Account No. 1240-7401 to Account No. 4321-8028 for the preparation of studies to evaluate potential property uses and to determine the whole property value of the Anawalt Lumber Company property located north of Market Street east of the railroad tracks. BACKGROUND This item is a public hearing to consider the adoption of a Resolution of Necessity to acquire private property for public purposes. On April 8, 1997, City Council approved the Metrolink station site and adopted a Negative Declaration as Resolution No. 97-33. The City has had an appraisal prepared for the portion -,,pied:^ JAN HEIDT NEWHALL METROLINK STATION, PROJECT NO, 52001 January 12, 1999 - Page 2 of property to be acquired that is necessary to construct the station. An Offer to Purchase Real Property was made to the property owner on October 15, 1998. Staff is still in negotiation with the property owner; however, due to time constraints for this project, staff recommends continuing the eminent domain process for acquiring the parcels in the event that future negotiations fail and it is necessary to obtain Orders of Immediate Possession. An Order of Immediate Possession is a procedure available to a public agency to obtain the use of property prior to a court's final determination of property value. The project necessitates the acquisition of two partial -takes of real property (Assessor Parcel Nos. 2831-011-039 and 2831-011-040, collectively referred to as 'Property") for public transportation purposes and all uses appurtenant thereto. A Negative Declaration for the project was prepared and adopted as Resolution No. 97-33, pursuant to Section 15070 of the California Environmental Quality Act (CEQA), on April 8, 1997. The Property to be acquired is described and depicted on the exhibits attached to Resolution No. 99-17. An appraisal has been obtained for the partial takes of each parcel. Submitted with this staff report is a copy of the Offer to Purchase, which the City has made to the property owner. Such offers are required pursuant to applicable law. In addition, submitted herewith are copies of the Notice of Hearing, which were delivered to the property owner by first class mail in accordance with the applicable statutes. An amended Notice of Hearing with an additional legal description for a reciprocal access easement to be acquired is also included with this report. The City Council is required to conduct a public hearing to consider the adoption of the Resolution of Necessity, which would authorize the filing of condemnation proceedings to acquire the Property. Notice of this hearing was timely and given in the manner prescribed by law. If the City Council finds that the public necessity so requires, after conducting the public hearing, the City Council should adopt the Resolution of Necessity authorizing condemnation proceedings for the purpose of acquiring the parcels described in the draft of said Resolution, which is attached. (Note: A 4/5 vote is required to adopt the Resolution of Necessity.) The findings that need to be made are as set forth in a draft of the said Resolution of Necessity and further described below: A. The public interest, convenience, and necessity require the acquisition by said City of certain real property, which is located in the City for public transit and street purposes and all uses appurtenant to the project. The Jan Heidt Newhall Metrolink Project is required by Southern California Regional Rail Authority guidelines to have a minimum number of 230 parking JAN HEIDT NEWHALL METROLINK STATION, PROJECT NO, 52001 January 12, 1999 - Page 3 spaces as proposed by the Project. In order to satisfy this requirement, additional property adjacent to the project site must be acquired by the City, as the current size of the City -owned property and right-of-way is inadequate for the project. B. The project is planned and located in a manner that will be most compatible with the greatest public good and least private injury. The project is centrally located within the Newhall area to benefit local users of the mass transit system. As Newhall is over 100 years old, there is very little undeveloped property available for acquisition. The adjacent properties to the proposed Metrolink station are currently developed at capacity with the exception of the Anawalt Lumber site, which is directly adjacent to the project site. Partial acquisition of this property will involve relocation of businesses within the existing parcels where they are currently operating. C. The taking of the Property is necessary for the stated Project and such taking is authorized by Section 19, Article I of the California Constitution, Section 37350 et seq., of the California Government Code, and other applicable law. The taking of the property is necessary to provide the required parking for the Jan Heidt Newhall Metrolink Station. D. The offer to purchase required by California Government Code Section 7267.2 has been made to the owner of the Property proposed to be acquired by the City. The offer to purchase was made to the property owner on October 15, 1998. The City's acquisition representative, Hamner, Jewell & Associates, has also had contact with the property owner since that date to negotiate the terms of the sale. Questions relating to value should not be considered at this meeting, as negotiations are ongoing. If the Council adopts the Resolution of Necessity after the hearing, staff will contact the property owner and continue to attempt to reach agreement on the value to be paid for the Property. A settlement can be made at any time during this process. After the adoption of the Resolution of Necessity, the City then files an action and seeks an Order of Immediate Possession from the court. A deposit in the amount of the probable compensation based upon the City's appraisal must be made in court to obtain an order as to each property sought. The partial -take acquisition requires the relocation of three existing businesses. Staff has retained the services of Hamner, Jewell & Associates to assist with the property acquisition and the relocation of the three existing tenants. Contact has been made with the tenants that are to be relocated, and relocation negotiations are in process. Two of the three tenants will be relocated to another location on the same parcel. The Notice should be given this month, to allow the businesses to relocate by April 1999. Construction of the Jan Heidt Newhall Metrolink Station is scheduled to begin in February 1999. The City has the option to give Notice to Proceed on this site on May 1, 1999 should the relocation of the existing tenants take the full 90 days. Discussions that the City's representative has had to date with the property owner involve the owner's request that the City purchase the property in its entirety. The City may have possible uses for the remainder property for additional parking and other projects, such as a community center. Staff would need to further evaluate the site to see if the size, location, and configuration of the property could meet the City's potential needs for future projects. The property is also located within a floodway, necessitating studies to determine the costs to mitigate potential flooding, etc. A detailed estimate of these costs would be necessary to determine the value of the remaining property in order for the City to make an offer to purchase for any future projects on this site. Additional funds would need to be appropriated by Council in order to perform these studies. ALTERNATIVE ACTIONS 1. Continue the public hearing to a date certain. 2. Other action as determined by the City Council. FISCAL IMPACT Funds in the amount of $334,900.00 are available in Account No. 52001206-8001 and have been budgeted in Fiscal Year 1998/99 for this project. The City Council Contingency balance is currently $1,226,100.00.
