(MASTERCASE NO. 98-183) DEPARTMENT: Planning and Building Services RECOMMENDED ACTION City Council to adopt Resolution No. 99-127 to authorize the City Manager, or his designee, to file an annexation application with the Local Agency Formation Commission (LAFCO) for the North Valencia 2 area. BACKGROUND This action authorizes the City Manager, or his designee, to file an annexation application for the North Valencia 2 annexation consisting of 576 acres of uninhabited land generally known as East Creek, Decoro South, and San Francisquito Creek. The North Valencia 2 annexation application is one of three related components. The other two, the North Valencia 2 Specific Plan and the Stormwater Utility Fee Election, must both occur before annexation. The City has initiated the North Valencia 2 annexation pursuant to a Memorandum of Understanding (MOU) with the Valencia Company that was authorized by the City Council in July 1998. The applicant has agreed to pay the annexation fee and related costs. Filing the application at this time would allow the North Valencia 2 annexation to occur as early as December 1999, in time for the 2000 Census. Adopted; (c;--=� Agenda items,. On January 26, 1999, the City Council took the first step in the annexation process by adopting Resolution No. 99-5 approving a negative declaration for the annexation. Ordinance 99-2 approving Prezone No. 98-002 was adopted on February 9, 1999. A City Council study session on the North Valencia 2 Specific Plan is scheduled for July 6, 1999. The Planning Commission is scheduled to adopt a recommendation on the Specific Plan and entitlements for the project in late July 1999. The City Council is scheduled to consider the Specific Plan in September 1999. The Storm Water Utility fee election for the project area is scheduled to occur prior to annexation, on October 12, 1999. The applicant understands that defeat of the election ballot could result, at the City Council's discretion, in termination of annexation proceedings. Annexation to the City is regulated by the Cortese -Knox Local Government Reorganization Act of 1985 (revised 1994) and the Local Agency Formation Commission (LAFCO). FISCAL IMPACT A fiscal impact analysis has been prepared for the North Valencia 2 annexation. The fiscal impact analysis indicates that this annexation would be marginally positive for the City following a five-year project build out. Property owners must successfully elect to pay the Storm Water Utility fee for annexation to occur.
