SUBJECT: APPROVAL OF AGREEMENTS WITH THE METROPOLITAN
TRANSPORTATION AUTHORITY FOR FACILITIES WITHIN THE
RAILROAD RIGHT-OF-WAY

RECOMMENDED ACTION
City Council approve the five supplemental agreements and the two additional license
agreements between the Metropolitan Transportation Authority (MTA) and the City of
Santa Clarita, and authorize the City Manager to sign these agreements on behalf of the
City of Santa Clarita.
BACKGROUND
The conditions of approval for Tentative Tract Map No. 42670 (Santa Clarita Business
Park) required the construction of storm drain and sewer facilities. Some of these facilities
are to be constructed within the railroad right-of-way and cross under the railroad tracks
along Soledad Canyon Road between Golden Oak Road and Ruether Avenue. A license
agreement is required prior to approval by the MTA.
In a separate matter, at the August 28, 1990 regular meeting of the City Council, five
agreements were approved and signed between the Southern Pacific Transportation
Company (SPTC) and the City of Santa Clarita to create easements for the construction,
operation, and maintenance of storm drain facilities within the limits of their right-of-way.
Since that initial approval, MTA has become the successor in interest for the railroad
right-of-way, and requires that supplemental agreements be signed between the City of
Santa Clarita and MTA. The purpose of the supplemental agreements is to modify the
original agreements to replace SPTC with MTA and to incorporate standard MTA
encroachment requirements.

ALTERNATIVE ACTIONS
No alternative action is proposed, as the modification of the original agreements does not
alter previously agreed to conditions. The two new agreements will facilitate the
construction of desired improvements.
FISCAL IMPACT
A check for $7,000 to cover the MTA processing fee has been provided by the developer.
Although maintenance costs will result from the construction of the proposed facilities, this
action does not increase costs to the City beyond those already anticipated within the
original agreements with SPTC and the developer. Some of the drainage facilities will be
transferred to the Los Angeles County Flood Control District for maintenance, the
remainder of the drainage facilities will be maintained by the City as local road drains, and
the sewer main will be owned by the City and maintained by Los Angeles County
Consolidated Sewer Maintenance District.
