HomeMy WebLinkAbout1999-11-30 - AGENDA REPORTS - SCE JT USE AGMT (2)CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: DATE: November 30, 1999 SUBJECT: SOUTHERN CALIFORNIA EDISON COMPANY JOINT USE AGREEMENT DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council approve a Joint Use Agreement between the Southern California Edison Company and the City of Santa Clarita for property located in the public right-of-way at the .northwest corner of Magic Mountain Parkway and McBean Parkway. The Assessor's Parcel Number is 2811-002-900. Southern California Edison Company is requesting a Joint Use Agreement with the City of Santa Clarita for property located in the public right-of-way at the northwest corner of Magic Mountain Parkway and McBean Parkway. The Assessor's Parcel Number is 2811-002-900. Most of the existing right-of-way of Magic Mountain Parkway lies within state controlled Highway 126. As a requirement of the development of the adjacent properties, the developer, Newhall Land and Farming Company, was conditioned to dedicate additional property outside of the state right-of-way. This dedication to the City of Santa Clarita is entirely outside of the future curb line of Magic Mountain Parkway. The City is also requesting that the Southern California Edison Company underground their existing facilities in this area. Edison has a pre-existing easement in this area for their overhead facilities and as such, they hold a senior position in regard to "Prior Rights" related to this facility. They have agreed to our request to remove the overhead lines and place them underground; however, they desire to maintain their seniority. The issue of prior rights is directly related to who pays for relocation of facilities should future need arise. In most cases, utility companies are required to move their facilities at their expense should the City have a need to perform improvements in the area. In cases where utilities hold a superior position to the City, the City pays for such relocation costs. The location outside of the street was chosen to minimize future conflicts. The safety and esthetic benefit of removing the poles and wires from overhead and placing them underground is significant, while the potential of future conflict is minor.
