HomeMy WebLinkAbout1999-11-09 - AGENDA REPORTS - SOLID WASTE FRANCHISE ANNEX (2)AGENDA REPORT CONSENT CALENDAR DATE: November 9, 1999 City Manager Approi Item to be presented Amelia Rietzel SUBJECT: ESTABLISH A MECHANISM FOR ADDING NEWLY ANNEXED AREAS TO THE SOLID WASTE FRANCHISES AND AMEND RESIDENTIAL SOLID WASTE FRANCHISE AGREEMENTS WITH ATLAS TRANSPORT, INC., THE BLUE BARREL DISPOSAL COMPANY, AND THE SANTA CLARITA DISPOSAL COMPANY TO INCLUDE THE NORTH VALENCIA 1 AND HUNTERS GREEN ANNEXATION AREAS INTO THE SOLID WASTE FRANCHISE AGREEMENTS DEPARTMENT: Planning & Building Services RECOMMENDED ACTION Adopt resolutions approving amendments to Section 4 of residential solid waste franchise agreements with Atlas Transport, Inc., Blue Barrel Disposal Company and Santa Clarita Disposal Company, respectively, to establish a mechanism for the allocation of new accounts in newly annexed areas, including the North Valencia 1 and Hunter's Green annexations, into the Solid Waste Franchise. IMIXG)"Milft�1, On February 20, 1991 the City of Santa Clarita entered into exclusive solid waste franchise agreements with three local waste haulers (Atlas Transport, Inc., Santa Clarita Disposal and Blue Barrel Disposal) to provide integrated residential waste collection and recycling services within the City limits. All of the franchised solid waste haulers are eligible to provide commercial waste hauling services throughout the incorporated area of the City. For residential service, each of the waste haulers are assigned to a specific geographic area in the City to provide residential collection services. Since 1991 many areas have been added to the City through the annexation process. From time to time areas, both developed and undeveloped, are added to the City through the annexation process. The California Public Resources Code and the City's municipal code require that waste management services are to be made available to all businesses and residences within the City. In the past, the City Council has chosen to add annexed areas to the service areas of existing franchised haulers. No process has been defined regarding how the homes are to be divided among the haulers when annexed areas are added. Staff and the haulers have reached the following agreement regarding how future annexations would be added to the existing item: franchises, assuming that the City Council elects to award the area to the existing franchisees: • If the annexed area is undeveloped then all Solid Waste collections in the annexed area would be provided by the hauler selected by the City. Existing accounts would then be traded to the remaining two haulers in a manner consistent with the market share remaining constant as follows: Blue Barrel — 50%, Santa Clarita — 31%, and Atlas — 19%. Redistribution of accounts would occur during the annual franchise extension process. • If the annexed area is developed then all Solid Waste collections in the annexed area would be provided by the hauler selected by the City. Accounts would then be redistributed throughout the City to the remaining two haulers on a 1 existing account to 1 new account basis. Redistribution of accounts would occur when the annexation is completed. The existing residential franchise boundaries include significant areas of undeveloped land. The haulers have requested clarification from the City regarding how, and by whom, solid waste services to new residences built within their respective franchise areas will be provided. The haulers agree that residences built in their service areas should be serviced by the hauler assigned to that area of the City. The City of Santa Clarita has recently completed the annexation of North Valencia 1 and Hunter's Green. North Valencia 1 annexation would be serviced by Blue Barrel and the undeveloped Hunter's Green annexation would be serviced by Santa Clarita Disposal. As homes are built and occupied waste services would be provided. Once each year during the franchise renewal process the franchise area boundaries would be adjusted to account for the new homes being serviced by Blue Barrel and Santa Clarita Disposal. The number of new accounts created in the undeveloped annexed areas would be redistributed between the three hauling companies on a one - new -account for each existing account basis using the following proportion: • Blue Barrel would receive 50% of the accounts, Santa Clarita Disposal would receive 31% and Atlas would receive 19%. ALTERNATIVE ACTIONS • Redistribution of accounts could occur as homes are built instead of redistributing once each year. • Redistribute Solid Waste service accounts of new residences built within the City limits among the three haulers rather than allowing new residences to automatically be serviced by the hauler who services the area. FISCAL IMPACT The mechanism for determining allocation of new accounts would result in no fiscal impact to the City. Addition of the estimated 2,073 dwelling units would contribute approximately $55,000 in new franchise fees per year to the City upon build -out. In addition, increased commercial service would also increase franchise fees to the City. The amount would be determined by the types and quantity of businesses that develop in the available space.
