SUBJECT: RESOLUTION INITIATING PROCEEDINGS FOR THE SANTA
CLARITA STORM DRAINAGE FEE FOR NORTH VALENCIA II
ANNEXATION SETTING A TIME AND PLACE FOR A PUBLIC
HEARING
DEPARTMENT: Planning and Building Services
RECOMMENDED ACTION
Adopt Resolution 99-107 initiating proceedings for the North Valencia II annexation Storm
Drainage Fee and set the public hearing for August 24, 1999.
BACKGROUND
In November 1996, California voters passed Proposition 218 — The Right to Vote on Taxes
Act. As a result, the city must conduct a majority protest hearing and a ballot election for
each area requesting annexation into the City to impose the stormwater fee on the
associated parcels.
On February 9, 1999, the City Council approved the Pre -zone for the North Valencia II
annexation. Also on the Council agenda on June 22, is a recommendation to proceed with
the LAFCO filing of the annexation application to allow for parallel processing of the
annexation request and the Stormwater fee.
The project applicant, Newhall Land & Farming has submitted a letter to the City
indicating their understanding that the Stormwater fee election must pass to continue with
the annexation proceedings. Failure of the election will result in immediate termination of
the annexation proceedings and no fees will be refunded.
ALTERNATIVE ACTIONS
1. No other alternatives have been identified by staff.
2. Other action as determined by Council.
FISCAL IMPACT
The anticipated revenue from the parcels within the North Valencia II annexation area is
currently $20,381.23.
