Brad Therrien SUBJECT: TRACT MAP NO. 44896-2 - APPROVAL OF THE FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council approve Tract Map No. 44896-2; accept on behalf of the public the offers of dedication for portions of public streets, a City park, easements for sewer purposes, and the restriction of residential construction over open space lots and private streets; make findings as follows: (a) that this project is consistent with the provisions of Sections 66474, 66474.1, and 66474.6 of the Subdivision Map Act and should be approved, and (b) that this proposed subdivision, together with the provisions for this design and improvement, is consistent with the General Plan required by Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government Code; instruct the City Treasurer to endorse the Special Assessment Certificate on the face of the map for Tract Map No. 44896-2, which indicates that all special assessments levied by the City have been paid; and instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 44896-2, which embodies the approval of said map and the acceptance of the dedications shown thereon. BACKGROUND Tract No. 44896-2 is the second of two phases of Tentative Tract Map No. 44896. Tentative Tract No. 44896 was granted approval by the Planning Commission on July 28, 1998, appealed on August 12, 1998, and approved by City Council on October 13, 1998. This phase, which consists of approximately 20.6 acres, is located north of Via Princessa at the intersection of Oak Ridge Drive (Circle J Ranch Road) and is owned by Beazer Homes Holdings Corp., Inc. Of the 60 lots being created with this phase, 46 lots will be used for condominium purposes consisting of 156 units, one 3.1 -acre lot is zoned for industrial purposes, one lot is being dedicated as a City park, five lots will be used for open spaces, and the remaining lots for private streets. The conditions set by the Planning Commission have been met, and fees have been paid as indicated on the attached Fact Sheet. The map has been checked to the satisfaction of the City Engineer. The map is ready for City Council approval and acceptance of the dedications. rpnnonoes Iter; TRACT MAP NO. 44896-2 — APPROVAL OF THE FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION July 13, 1999 — Page 2 ALTERNATIVE ACTIONS No alternative actions that would conform to requirements set forth in the Subdivision Map Act are identified by staff. FISCAL IMPACT All subdivision streets will be privately owned and maintained. However, portions of Via Princessa and Oak Ridge Drive will be constructed as a condition of the parent tract. The maintenance of these streets will impact the City's Street Maintenance budget. The developer is contributing the following minimum amounts for the purposes described (refer to the attached Fact Sheet for details): Bridge and Thoroughfare Fees: This requirement has been met with the construction of the Wiley CanyonNia Princessa bridge. Transit Mitigation Fee: $31,200.00 Quimby Requirement: Quimby Fee requirements will be fully satisfied by the development of a five -acre park. Acreage: Approximately 20.6 acres. Number of Lots: Sixty. Number of Units: One hundred fifty-six units on 46 lots. Developer: Beazer Homes Holdings Corp., Inc Quimby Fees: The Quimby Fee requirements will be fully satisfied by the development of a five -acre park. This park will be located on Lot 13 with this development and a portion of an adjacent MWD right-of-way. Road Fees: This requirement has been met pursuant to the Emergency Access Agreement and amendments with Beazer Homes and the City with the construction of the Wiley Canyon/Via Princessa bridge, a $4.5 million obligation. Transit Fees: A Transit Mitigation fee of $31,200.00 has been paid. Road Improvements: All streets within the subdivision will be privately owned and maintained. School Fees: To be paid at building permit stage per agreement with the school districts.
