SUBJECT: TRACT MAP NO. 52276 - APPROVAL OF THE FINAL MAP AND
ACCEPTANCE OF OFFERS OF DEDICATION

RECOMMENDED ACTION
City Council approve Tract Map No. 52276; accept on behalf of the public the offers of
dedication for public streets, easements for sewer, storm drain, Landscape Maintenance
District, and for sight visibility purposes; make findings as follows: (a) that this project is
consistent with the provisions of Sections 66474, 66474.1, and 66474.6 of the Subdivision
Map Act and should be approved, and (b) that this proposed subdivision, together with the
provisions for this design and improvement, is consistent with the General Plan required by
Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of the Government
Code, or any specific plan adopted pursuant to Article 8 (commencing with Section 65450)
of Chapter 3 of Division 1 of the Government Code; instruct the City Treasurer to endorse
the Special Assessment Certificate on the face of the map for Tract Map No. 52276, which
indicates that all special assessments levied by the City have been paid; and instruct the
City Clerk to endorse the Certificate on the face of Tract Map No. 52276, which embodies
the approval of said map and the acceptance of the dedications shown thereon.
BACKGROUND
Tentative Tract 52276 was granted approval by the Planning Commission on
October 7, 1997. This tract, which consists of approximately three acres subdivided into 14
lots, is located at the southwest corner of Via Princessa and May Way, and is owned by
Pacific Bay Properties. All 14 lots being created will be used for single-family residential
units. The conditions set by the Planning Commission have been met, and fees have been
paid as indicated on the attached Fact Sheet. The map has been checked to the satisfaction
of the City Engineer. The map is ready for Council approval and acceptance of the
dedications.

ALTERNATIVE ACTIONS
No alternative actions that would conform to requirements set forth in the Subdivision Map
Act are identified by staff.
FISCAL IMPACT
The subdivision street being created by this tract will be dedicated to the City. The
maintenance of this street will impact the City's Street Maintenance budget.
The developer is contributing the following minimum amounts for the purposes described
(refer to the attached Fact Sheet for details):
Bridge and Thoroughfare Fee: $78,400
Transit Mitigation Fee: 2,800
Quimby Requirement: 30,059
