Nisich SUBJECT: AMENDMENT TO THE VALENCIA BRIDGE AND MAJOR THOROUGHFARE CONSTRUCTION FEE DISTRICT RESOLUTION NO. 99-151 DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION 1. Conduct a public hearing. 2. At the conclusion of the public hearing, providing there is less than 50 percent written protest from the represented area of benefit: a. Adopt Resolution No. 99-151, amending the adopted Valencia Bridge and Major Thoroughfare Fee District. b. Instruct the City Clerk to record a certified copy of the adopted resolution with the County Recorder. BACKGROUND This item is a public hearing to consider amendments to the adopted Valencia Bridge and Major Thoroughfare Construction Fee District. The proposed amendments are necessary to make the City portion of the fee district consistent with the portion of the district within the unincorporated areas of Los Angeles County. This item was originally scheduled for a public hearing before the City Council on September 14, 1999, but due to an error in the public notice, the item was withdrawn from that agenda. A revised public notice was prepared and properly re -noticed for the public hearing on this item at the City Council meeting on September 28, 1999. On January 12, 1999, the City Council adopted the Valencia Bridge and Major Thoroughfare District. This district was developed to provide an equitable financing mechanism for new development to share the costs of providing the necessary roadway improvements. This type of funding district levies an assessment in proportion to the estimated number of vehicle trips generated by the new development. However, following the City's adoption of the fee district and prior to the item being presented to the Board of Supervisors, County staff received additional comments on the Fee District Report that resulted in additional modifications to the district. These changes are detailed below: • Government improvements, such as those for schools, police, fire, and libraries specifically needed to support benefited development have been excluded from paying district fees. The previously adopted fee district assumed that approximately five percent of all future non-residential development would be schools. • The total cost for district improvements has increased marginally due to refined project cost estimates, from $118,412,490 to $118,431,688. • An "inflation factor" was added, allowing the fees to be increased annually based on the Los Angeles Regional Construction Cost Index (CCI). The fees cannot be decreased if the CCI is ever a negative value. • The combination of excluding schools from paying fees and the increased improvement costs has increased the fee rate $135 per Factored Development Unit (FDU), from $9,787 to $9,922. At their meeting on July 27, 1999, the Board of Supervisors unanimously approved the County portion of the Valencia Bridge and Major Thoroughfare Fee District. The proposed resolution would amend the existing City's Valencia Bridge and Major Thoroughfare Construction Fee District by incorporating the above changes, making it consistent with what has been adopted by the County. The City's Transportation & Engineering Services staff worked with Los Angeles County's Department of Public Works staff and several major developers within the proposed Valencia district to develop the technical data for district formation, as well as the proposed amendments. In contemplating the establishment of this district, the City and County have been collecting interim fees for several years whenever new development has occurred. The proposed amendments to the City fee district will make the City and County fees consistent, allowing fees that have been collected to date to be utilized to construct improvements within the new district. Under CEQA Guideline 15378(b)(4), the establishment of the district fee does not constitute a "project," and therefore does not in itself create any environmental impact to be mitigated. Reject the proposed amendments to the Valencia Bridge and Major Thoroughfare Construction Fee District. 2. Direct staff to prepare an alternate report utilizing changed or modified criteria to amend the impact fee district. 3. Other action as determined by the City Council. FISCAL IMPACT None proposed by this action. However, if the City does not adopt the proposed amendments to the district and continues to collect the originally adopted fee, a $525,000 shortfall would occur in the Valencia District. The proposed amendments are necessary to make the City portion of the fee district consistent with the portion of the district within the unincorporated areas of Los Angeles County. Since the City approved the District in January 1999, the fee report has been revised. The proposed fee rate is $9,992 per Factored Development Unit (FDU), an increase of $135 per FDU. The establishment of the District, located in the City of Santa Clarita/unincorporated area of Los Angeles County, sets a fee to be levied. against future subdivision and building. permit activity for - purposes of constructing bridge and highway improvements. Existing developments are not subject to the fee. The proposed District is generally bounded by Interstate 5 to the west and Bouquet Canyon Road to the east. The northern border is formed by the Angeles National Forest and the southern boundary is shared with the Via Princessa B&T District. The hearing will be held in the City Council Chambers, 23920 Valencia Blvd., First Floor, Santa Clarita, California, on September 28, 1999, at or after 6:30 p.m. Proponents, opponents, and any interested persons may be heard on this matter at this time.
