CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE: January 12, 1999 City Manager Approval: Item to be presented by: SUBJECT: PROPOSED ASSESSMENT DISTRICT 99-1 (VERMONT DRIVE, EVERETT DRIVE IMPROVEMENTS) RESOLUTION NOS. 99-7, 99-8, 99-9, AND 99-10 DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council direct staff to proceed with the formation process of Assessment District 99-1 (Vermont Drive, Everett Drive Improvements) and to adopt Resolution Nos. 99-7, 99-8, 99-9, and 99-10 making designations and appointments; showing the proposed boundaries; declaring the City's intention to form the district and providing for the issuance of bonds; and giving preliminary approval to the Combined Report of Engineer and appointing a time and place for a public hearing. BACKGROUND In early 1994, residents along Everett Drive and Vermont Drive, south of Powell Drive, approached the City regarding the deteriorating condition of their private road due to surface water runoff. Since that time, staff's assessment consultants have prepared preliminary estimates for constructing storm drain, sewer, and road improvements to eliminate the surface water runoff situation. These costs were then presented to the property owners as part of the formation of an assessment district to be formed to fund these improvements. After several attempts by the property owners to gather enough support, the residents have verbally expressed that they will support the assessment district on the condition that the City contribute $400,000 to the district. This was approved by the City Council on September 8, 1998. This amount is included in the Capital Budget. To proceed, resolutions declaring the City's intent to form a district, designating a financial advisor and bond counsel, showing the proposed boundaries, preliminarily approving the Engineer's Report, and calling for the public hearing need to be adopted. At this time, a date will be set for a public hearing where the first of two opportunities for the public to voice their approval/disapproval of the district will be conducted. ANN, 0 Agenda m PROPOSED ASSESSMENT DISTRICT 99-1 January 12, 1999 - Page 2 In compliance with Proposition 218, assessment ballots will be mailed a minimum of 45 days prior to the public hearing along with notices of the public hearing. In accordance with Proposition 218, the Right to Vote on Taxes Act, all new assessments must be approved by assessment ballots mailed to all property owners of the parcels assessed no later than 45 days prior to the public hearing. Approval will be determined by weighing the ballots received according to the proportional financial obligation of the affected property in the district. A public hearing will be held on March 9, 1999 to tabulate assessment ballots. A determination will be made at that time if there is sufficient support for the district to proceed. Plans and specifications will be prepared. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT To date, approximately $75,000 has been expended by the City, in addition to the $400,000 currently budgeted. If successful, additional costs will be borne by the district.
