HomeMy WebLinkAbout1999-06-08 - AGENDA REPORTS - WIRELESS COMMUN FACILITIES (2)AGENDA REPORT City Manager Approval Item to be presented by: PUBLIC HEARING DATE: June 8, 1999 SUBJECT: ORDINANCE GOVERNING WIRELESS COMMUNICATION FACILITIES ORDINANCE NO. 99-6 DEPARTMENT: Planning and Building Services RECOMMENDED ACTION The City Council conduct the public hearing, receive testimony, close the public hearing, and introduce Ordinance 99-6 governing wireless communication facilities. On December 8, 1998, the City Council passed and adopted a 45 day Interim Urgency Ordinance governing wireless communication facilities. Under the Urgency Ordinance, all proposed wireless communication facilities must receive approval of a conditional use permit prior to construction, as well as follow design standards. On January 12, 1999, the Council passed and adopted Ordinance No. 99-3, a 10 month and 15 day extension of the Urgency Ordinance passed December 8, 1998. On March 16, 1999 the Planning Commission recommended that the City Council adopt Ordinance 99-6 by a vote of 5-0. Ordinance 99-6 will amend the Unified Development Code to contain development standards and definitions of frequently used terms. Ordinance 99-6 will also require that wireless communication facilities, of any size, receive approval of a Conditional Use Permit when located in a residential area. The Ordinance requires a Minor Use Permit be obtained for those wireless communication facilities proposed to be located outside of a residential area and less than 35 feet in height. All facilities proposed to be 35 feet in height and taller, must receive approval of a Conditional Use Permit. This ordinance exempts wireless communication facilities that have received approval from the Planning and Building Services Department. This ordinance also exempts those antenna structures that are designed to receive over -the -air UHF and/or VHF television broadcast transmission, and AM and/or FM radio broadcast transmission. p�� APPROWEED agenda item:l3 ALTERNATIVE ACTIONS 1.
