HomeMy WebLinkAbout1999-12-14 - ORDINANCES - AMEND UDC (2)ORDINANCE 99-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING SECTIONS 17.16.080.3.a and 17.16.090.B.2 OF THE UNIFIED DEVELOPMENT CODE WHEREAS, the City of Santa Clarita General Plan requires the implementation of the City of Santa Clarita Unified Development Code to be in compliance with the Governmental Code of the State of California; and WHEREAS, the proposed amendments are consistent with and further implement the Goals and Policies of the City's General Plan; and WHEREAS, the Planning Commission conducted a duly noticed public hearing on October 19, 1999 at City Hall, 23920 Valencia Boulevard, Santa Clarita, Ca 91355. At this meeting, the Planning Commission adopted Resolution P99-024, recommending approval of Unified Development Code Amendment Ordinance 9,9-15 to the City Council. WHEREAS, the City Council of the City of Santa Clarita conducted a duly noticed public hearing at City Hall, 23920 Valencia Boulevard, Santa Clarita, Ca 91355. At this meeting, the City Council adopted Ordinance 99-15. NOW THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES ORDAIN AS FOLLOWS: SECTION 1. The following amendments to the Santa Clarita Unified Development Code are consistent with the City of Santa Clarita General Plan and meet the requirements of the Government Code of the State of California: Section 17.16.080.3.a add #4 to read: "Fences. Non -view obscuring fences, not to exceed 5 feet in height, shall be permitted to be located within the 20 -foot front yard setback. Where a non -view obscuring fence is constructed within the 20 -foot front yard setback, and are 5 feet in height, the applicant shall be required to landscape the frontage of their property along the property line that abuts the adjacent right-of-way. Block walls that are higher than T-6" shall not be permitted to be located within the 20 -foot front yard setback." Section 17.16.090.B.2 add "m" to read: "Fences. Non -view obscuring fences, not to exceed 5 feet in height, shall be permitted to be located within the 20 -foot front yard setback. Where a non -view obscuring fence is constructed within the 20 -foot front yard setback, and are 5 feet in height, the applicant shall be required to landscape the frontage of their property along the property line that abuts the adjacent right-of-way. Block walls that are higher than T-6" shall not be permitted to be located within the 20 -foot front yard setback." SECTION 2. That if any portion of this ordinance is held to be invalid, that portion shall be — stricken and severed, and the remaining portions shall be unaffected and remain in full force and effect. SECTION 3. That the City Clerk shall certify to the passage of this ordinance and shall cause it to be published in the manner prescribed by law.
