A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA ESTABLISHING A LIBRARY FACILITIES AND TECHNOLOGY
MITIGATION FEE
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES RESOLVE AS
FOLLOWS:
WHEREAS, the City of Santa Clarita City Council adopted pursuant to Ordinance
No. 99-7, a Library Facilities and Technology Mitigation Fee, and a Capital Improvement
Plan (Resolution No. 99-38; and
WHEREAS, the mitigation fee for the City of Santa Clarita is based upon the "Report
on Proposed Developer Fee Program For Library Facilities" and was prepared by the County
of Los Angeles Public Library and adopted by the County Board of Supervisors in October of
1998 which is on file with the City Clerk of the City of Santa Clarita; and
WHEREAS, that future residential development within the Santa Clarita Valley will
result in public library facility requirements in excess of existing capacity, and the City's
General Plan and other provisions of law require such development impacts to be mitigated;
and
WHEREAS, notice of a public hearing regarding adoption of such library facilities
mitigation fee was given as required by law; and
WHEREAS, on October 12, 1999, the City Council held a public hearing at which the
City Council considered adoption of the library facilities and technology mitigation fee; and
WHEREAS, at the public hearing all interested persons were given an opportunity to
appear and be heard; and
WHEREAS, that in the absence of this resolution imposing a library facilities and
technology mitigation fee upon new residential development, existing and future sources of
revenue will be inadequate to fund substantial portions of the county public library facilities
needed to avoid unacceptable service levels and related adverse impacts; and
WHEREAS, that the library facilities and technology mitigation fee will provide the
additional funds necessary to provide the public library facilities required to accommodate
the library needs generated by new residential development of land in the City of Santa
Clarita. That the library facilities and technology mitigation fee is a fair and equitable
method of distributing the cost of public library facilities among the developments which
will generate the increased library needs and usage; and
WHEREAS, the goal of the library facilities and technology mitigation fee is to
"preserve the character of the communities and the integrity of the Santa Clarita Valley by
permitting orderly growth through the synchronization of development with the availability
of public facilities such as roads, sewers, water service and schools needed to support it."
(GOAL 1 of the City's General Plan Land Use Element) In addition, the City has a Policy
(1.1 of the City's General Plan Land Use Element) "to develop and implement a program of
Development Impact Fees to provide adequate public facilities and services in a timely
manner"; and
WHEREAS, the City Council in recommending the adoption of the Negative
Declaration by separate resolution under the provisions of the California Environmental
Quality Act, specifically finds that the adoption of this resolution will have a deminimis
impact on fish and wildlife resources. The City Council specifically find that in considering
the record as a whole, the project and including the adoption of this ordinance involves no
potential adverse effect, ether individually or cumulatively, on wildlife as the same is
defined in Section 711.2 of the Fish and Game Code. Furthermore, the City Council find
that an initial study has been prepared by the City staff, considered by the City Council,
which has been the basis to evaluate the potential for adverse impact on the environment
and forms the basis for the City Council's determination, including the information
contained in the public hearing records, on which a Negative Declaration of Environmental
Impact was issued and this deminimis finding is made; and
WHEREAS, that adoption of this resolution is in compliance with the requirements
of the Mitigation Fee Act, Government Code Section 66000 et seq.
WHEREAS, the library facilities and technology mitigation fee is hereby established
on the findings of the "Report on Proposed Developer Fee Program for Library Facilities" in
the Santa Clarita Valley; and
WHEREAS, the library facilities and technology mitigation fee is hereby established
at $580.00 per dwelling unit due to a cost of living increase approved by the Los Angeles
County Board of Supervisors on July 1, 1999; and
WHEREAS, the library facilities and technology mitigation fee shall be reviewed
annually by the City and/or the Los Angeles County Librarian and adjusted as necessary by
resolution of the City Council.
NOW, THEREFORE, the City Council of the City of Santa Clarita does ordain and
adopt the library facilities mitigation fee and negative declaration prepared for the project.
That the City Clerk shall certify to the passage of this resolution and shall cause it to
be published in the manner prescribed by law.
