A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA AUTHORIZING THE ESTABLISHMENT OF A LIBRARY FACILITIES
AND TECHNOLOGY CAPITAL IMPROVEMENT PLAN
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES RESOLVE AS
FOLLOWS:
WHEREAS, the City of Santa Clarita City Council intends by this Resolution to
adopt the Los Angeles County Library Facilities and Technology Capital Improvement Plan
for the Santa Clarita Valley (with a supplemental plan for the City of Santa Clarita) that
was approved by the Los Angeles County Board of Supervisors; and
WHEREAS, the Los Angeles County Library Facilities Capital Improvement Plan for
the Santa Clarita Valley (with a supplemental plan for the City of Santa Clarita) is based in
part on the "Report on Proposed Developer Fee Program For Library Facilities Report" that
was prepared by the County of Los Angeles Public Library in October of 1998 which is on
file with the City Clerk of the City of Santa Clarita.
WHEREAS, population growth associated with new residential development in the
City of Santa Clarita results in a demand for public library facilities in excess of the existing
capacity of the County public library, and the City's General Plan and other provisions of
law require such development impact to be mitigated; and
WHEREAS, existing and future sources of revenue are in to fund
substantial portions of the county public library facilities needed to avoid unacceptable
service levels and related adverse impacts; and
WHEREAS, a library facilities and technology mitigation fee imposed on new
residential development of land in the City of Santa Clarita will generate additional funds
to provide public library facilities to accommodate the library needs generated by such
development; and
WHEREAS, the library facilities and technology capital improvement plan indicates
the approximate locations, sizes, time of availability and cost estimates for all facilities to be
financed with the library facilities and technology mitigation fee, in compliance with the
requirements of the Mitigation Fee Act, Government Code Section 66000 et seq.; and
WHEREAS, notice of a public hearing regarding adoption of such library facilities
and technology mitigation fee was given as required by law; and
WHEREAS, on October 12, 1999, the City Council held a public hearing at which the
City Council considered adoption of the library facilities and technology mitigation fee; and
w WHEREAS, at the public hearing all interested persons were given an opportunity to
appear and be heard; and
WHEREAS, the goal of the library facilities and technology capital improvement
plan is to "preserve the character of the communities and the integrity of the Santa Clarita
Valley by permitting orderly growth through the synchronization of development with the
availability of public facilities such as roads, sewers, water service and schools needed to
support it." (GOAL 1 of the City's General Plan Land Use Element) In addition, the City
has a Policy (1.1 of the City's General Plan Land Use Element) "to develop and implement a
program of Development Impact Fees to provide adequate public facilities and services in a
timely manner."
Whereas, a developer shall pay the library facilities fee at the time of issuance of a
building permit as established by resolution of the City Council to defray the cost of
constructing and equipping library facilities to minimize the level of service impacts on
libraries caused by new development. Such fee shall be referred to as the library facilities
and technology mitigation fee.
Whereas, the City Council in recommending the adoption of the Negative
Declaration by separate resolution under the provisions of the California Environmental
Quality Act, specifically finds that the adoption of this resolution will have a deminimis
impact on fish and wildlife resources. The City Council specifically find that in considering
the record as a whole, the project and including the adoption of this resolution involves no
potential adverse effect, ether individually or cumulatively, on wildlife as the same is
defined in Section 711.2 of the Fish and Game Code. Furthermore, the City Council find
that an initial study has been prepared by the City staff, considered by the City Council,
which has been the basis to evaluate the potential for adverse impact on the environment
and forms the basis for the City Council's determination, including the information
contained in the public hearing records, on which a Negative Declaration of Environmental
Impact was issued and this deminimis finding is made; and
WHEREAS, on the basis of all of the foregoing, the City Council has determined to
adopt the capital improvement plan for public library facilities.
NOW, THEREFORE, the City Council of the City of Santa Clarita does resolve to
and adopt the library facilities and technology capital improvement plan for the Santa
Clarita Valley (with a supplemental capital improvement plan for the City of Santa Clarita),
which is based on the "Report on Proposed Developer Fee Program for Library Facilities —
Prepared by the County of Los Angeles Public Library and adopted by the Los Angeles
County Board of Supervisors," on file with the City Clerk.
That the City Clerk shall certify to the passage of this resolution and shall cause it to
be published in the manner prescribed by law.
