HomeMy WebLinkAbout1999-05-25 - RESOLUTIONS - MODIFY ASMT DIST 99 1 (2)RESOLUTION NO. 99-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DECLARING ITS INTENTION TO MODIFY THE BOUNDARIES OF ASSESSMENT DISTRICT NO. 99-1 (VERMONT DRIVE/EVERETT DRIVE IMPROVEMENTS) TO INCLUDE CERTAIN PROPERTY AND APPROVING AN EXTENSION OF THE 30 -DAY CASH COLLECTION PERIOD FOR PROPERTY OWNERS WITHIN SAID DISTRICT WHEREAS, the City Council ("City Council") of the City of Santa Clarita, California ("City") has, by Resolution No. 99-8, adopted on January 12, 1999 ("Resolution of Intention"), declared its intention to order the construction and/or acquisition of certain public improvements, pursuant to terms and provisions of the Municipal Improvement Act of 1913 ("Act"), being Division 12 of the Streets and Highways Code of the State of California, in an improvement district designated as "ASSESSMENT DISTRICT NO. 99-1 (VERMONT DRIVE/EVERETT DRIVE IMPROVEMENTS)" (hereinafter referred to as the "District"); and WHEREAS, the City Council in and by said resolution referred said proposed improvements to the Engineer of Work for the District, and directed said Engineer of Work to make and file with the City Clerk a report in writing containing the matters specified in Section 10204 of the Streets and Highways Code, which report was thereafter filed on January 12, 1999, and was preliminarily approved by the City Council by Resolution No. 99-9, adopted by the City Council on January 12, 1999; and WHEREAS, in accordance with the provisions of the Act and applicable law, the City conducted a duly noticed public hearing on March 9, 1999, relating to said proposed improvements and the levy of assessments therefor; and WHEREAS, all protests and objections were presented to the City Council and duly heard and considered, and there being no majority protest from assessment ballots received, all matters as to the boundaries of the District, the City contribution, the improvements to be acquired, the method and formula of the assessment spread, and the finding of benefits received by the respective properties assessed for the proposed improvements and the apportionment of said benefits were approved; and WHEREAS, pursuant to Resolution No. 99-36, the City confirmed the assessments, approved the final Engineer's Report ("Engineer's Report"), and formed the District; and WHEREAS, a property owner owning property adjacent to the District ("Parcel") has petitioned the City to annex to the District and said petition is on file with the City Clerk; and RESOLUTION NO. 99-84 May 25, 1999 - Page 2 WHEREAS, pursuant to Chapter 4.5 of the Act, the City wishes to declare its intent to modify the boundaries of the District to include the Parcel and to impose an assessment thereon relating to the improvements to be funded by the District; and WHEREAS, the Engineer's Report has been modified by the Engineer of Work to include the Parcel within the District and to reflect the assessment related thereto ("Amended Engineer's Report") and is now presented to the City Council; and WHEREAS, no other parcels or assessments within the District nor any descriptions or improvements previously described or approved in Resolution Nos. 99-8, 99-9 and 99-36 and the Engineer's Report have been affected by said amendment in the Amended Engineer's Report; and WHEREAS, pursuant to Resolution No. 99-36 and Section 10404 of the Act, the Superintendent of Streets is directed to mail a statement of assessment to property owners within the District, which includes information regarding the opportunity and time period for such property owners to prepay such assessments in cash, and it is in the best interests of the City to extend the time period for such cash collection. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: Section 1. The above recitals are all true and correct. Section 2. The petition relating to the Parcel is hereby accepted and approved. Section 3. The Amended Engineer's Report is hereby preliminarily approved and adopted. It is hereby determined and declared that the Parcel will specially benefit from the works of improvement as proposed for the District. It is hereby further determined and declared that it is the intention of the City to modify the boundaries of the District to include the Parcel and to impose an assessment in the amount as shown in Amended Engineer's Report and that the Parcel shall be subject to the terms and provisions of Resolution No. 99-9. For further particulars, reference is made to the proposed Amended Diagram for Assessment District No. 99-1 (Vermont Drive/Everett Drive Improvements) and a copy of the Amended Engineer's Report, both on file with the City Clerk. Section 4. The Amended Engineer's Report shall stand as the final Engineer's Report for the purpose of all proceedings hereto and hereafter undertaken pursuant to Resolution Nos. 99-8, 99-9, 99-10, 99-36 and this Resolution. Section 5. NOTICE IS HEREBY GIVEN that June 8, 1999 at the regular meeting place of the City Council, City Council Chambers, City of Santa Clarita, 23920 Valencia Boulevard, Santa Clarita, California 91355, is hereby fixed as the date and place for a public hearing of protests to the modification of the boundaries of the District and the imposition of an assessment on the Parcel, and any interested person may object thereto. RESOLUTION NO. 99-84 May 25, 1999 - Page 3 Should a protest be filed with the City Clerk from the owner of the Parcel, the City shall abandon the proceedings for the modification of the boundaries of the District and the imposition of the assessment on the Parcel. Section 6. Christopher C. Price, Supervising Engineer, City of Santa Clarita, 23920 Valencia Boulevard, Santa Clarita, California 91355, telephone (661) 255-4961, is hereby designated to answer inquiries regarding the change hearing proceedings. Section 7. The City Clerk of the City is hereby directed to give notice by causing a Notice of Public Hearing and Adoption of Resolution to be published in The Signal at least 10 days prior to the June 8, 1999 public hearing. Section 8. The time period for the cash collection of assessments for properties within the District is hereby extended to end 30 days from the date of mailing of the statement of the assessment, rather than 30 days from the recordation of the Notice of Assessment.
