HomeMy WebLinkAbout1999-05-11 - RESOLUTIONS - TOBACCO ADVERTISING AGMT (2)RESOLUTION NO. 99-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA SUPPORTING THE DECEMBER, 1998 NATIONAL ASSOCIATION OF ATTORNEY GENERALS MASTER SETTLEMENT AGREEMENT WITH THE TOBACCO INDUSTRY THAT PROMBITS CERTAIN TYPES OF OUTDOOR ADVERTISEMENT OF TOBACCO PRODUCTS WHEREAS, the City of Santa Clarits. has a substantial interest in protecting and promoting the general welfare of minors of the City of Santa Clarita exposed to advertising of tobacco products; and WHEREAS, the Supreme Court has repeatedly recognized that children and minors deserve special solicitude because they lack the ability to assess and fully analyze the information presented through commercial advertising; and WHEREAS, California Business and Professions Code section 22961 prohibits tobacco advertising on any billboard within 1,000 feet of a public or private school or public playground; and WHEREAS, RJR initiated the Old Joe Camel advertising campaign in 1988 and in just three years, Camel -brand cigarette's share of the under 18 years of age market rose from 0.5% to 33%. One-quarter of all Camel sales in 1991 were to minors; and WHEREAS, children's recognition of some tobacco product brand logos rivals their recognition of Disney characters; and WHEREAS, IN EARLY 1997, California state health officials reported that statewide there has been a 22% increase since 1993 in the number of fifteen- to seventeen -year-olds who are addicted to smoking. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Santa Clarits, strongly endorses the initiative undertaken by the National Association of Attorney Generals in negotiating the Master Settlement Agreement with the Tobacco Industry. Pursuant to the 46 states adjoined to this Settlement Agreement, the Tobacco Industry is required to provide $206 Billion for public education efforts, public health programs and reimbursements to Medicare for funds expended to treat health issues related to the use of tobacco products. BE IT FURTHER RESOLVED that, the City Council supports the provision of the Master Settlement Agreement that required the Tobacco Industry to remove thousands of outdoor billboards as of April 23, 1999, and make such billboards available for anti-smoking messages. BE IT FURTHER RESOLVED that, the City Council applauds the outdoor advertising ban and the ban on the use of cartoon characters froin the Tobacco Industry's ads as an important victory in the war against teen smoking. The City Clerk shall certify to the adoption of this Resolution.
