HomeMy WebLinkAbout1999-06-08 - RESOLUTIONS - VACATE PUBLIC SERVICE EASEMENT (2)RESOLUTION NO. 99-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA ORDERING THE VACATION OF PUBLIC SERVICE EASEMENTS (STORM DRAIN EASEMENTS) IN THE CITY OF SANTA CLARITA WHEREAS, the subject public service easements (storm drain easements) are no longer needed for present or prospective public use; and WHEREAS, this vacation is made under the authority of Chapter 4, Summary Vacation, of the Streets and Highway Code, Section 8330; and WHEREAS, the description of the easements vacated are described in Exhibit "A" and shown on the map, Exhibit "B"; and WHEREAS, these easements were granted to the City for storm drain purposes when the storm drain (MTD 1356) was first constructed. Due to the development of this area, the existing inlets and laterals were removed. This removal eliminates the need for the subject easements, which can now be vacated (quitclaimed). NOW, THEREFORE, pursuant to the provisions of the Street Vacation Act of 1941, being Part 3 of Division 9 of Chapter 4 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That it is hereby found and determined that the easements described in Exhibit "A" and shown on the map, Exhibit "B," attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, in the County of Los Angeles, State of California, is no longer needed for present or prospective public use, including bicycle paths or trails based upon the following facts: that the easements have been superseded by relocation and there are no other facilities located within the easement. SECTION 2. That the City Clerk of the City of Santa Clarita be instructed to record the attached Quitclaim Deed in the office of the Registrar -Recorder of the County of Los Angeles, at which time the area will no longer be a public service easement. SECTION 3. That the City Clerk shall certify to the passage of this Resolution and shall cause it to be published and posted in the manner prescribed by law.
