Nisich DATE: June 13, 2000 SUBJECT: RESOLUTION SUPPORTING AB 2643 DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council adopt Resolution supporting the passage of AB 2643. BACKGROUND In 1995, the municipal transit operators of Los Angeles County (MUNIs), including Santa Clarita Transit, formed the Los Angeles County Municipal Transit Operators Coalition (LACMOC). The goal was to craft legislation that would ensure that all federal, state, and local funds available in Los Angeles County for bus operations or capital would be shared proportionately among all transit operators. The MUNIs believed that this legislation was necessary because a potential conflict of interest existed: the Los Angeles County Metropolitan Transportation Authority (MTA)is the agency charged with distributing these funds, and its transit operation is the largest recipient of these funds. This effort was successful with SB 1755 being signed into law in late 1996. For the past several months, the MTA has claimed that "Proposition C 40 percent funds" are not subject to SB 1755; therefore, the portion of funds dedicated to bus operations do not need to be shared with the MUNIs. The MUNIs disagree and have attempted to reach a compromise with the MTA. The MTA Board rejected the compromise in February 2000. AB 2643 was drafted to clarify that Proposition C 40 percent funds and any other funds used for bus operations and capital in Los Angeles County be shared proportionately among all included and eligible transit operators. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT If AB 2643 passes, it is estimated that Santa Clarita Transit would receive over $600,000.00 per year of additional revenue. Adopted: -Kc5o - 0 0 -(P 7 Ad r' Item: * RESOLUTION SUPPORTING AB 2643 June 13, 2000 — Page 2 ATTACHMENTS Resolution Supporting AB 2643 Agreement between Municipal Transit Operators of Los Angeles County (available in City Clerk's Reading File) \t=s1ftgenda\m=agr1.dm AGREEMENT BETWEEN MUNICIPAL TRANSIT OPERATORS OF LOS ANGELES COUNTY TO PARTICIPATE IN THE LOS ANGELES COUNTY MUNICIPAL OPERATORS COALITION This agreement is made and entered into by and among municipal transit operators in Los Angeles County, hereinafter collectively referred to as "MUNIs," who have become parties signatory to this Agreement. WHEREAS, each of the MUNIs signatory to this Agreement desires to join together with the other MUNIs for the purpose of promoting legislative representation and advocacy before the California State Legislature, the Administrative Branch, and State agencies and commissions; and WHEREAS, it is the intention of the MUNIs to engage a professional legislative representative who will provide legislative advocacy services in relation to the MUNIs' interest in clarifying existing law and obtaining beneficial transit funding and other issues of benefit or concern to the MUNIs as they are identified; NOW, THEREFORE, for and in consideration of all of the mutual benefits contained herein, the MUNIs hereto agree as follows: 1. Purnose. This Agreement is entered into by the MUNIs for the purpose of entering into a coalition, whose main purpose will be promoting legislative representation and advocacy before the California State Legislature, the Administrative Branch, and State agencies and commissions. By this Agreement, the MUNIs agree to cooperate in the sharing of information developed hereunder. 2. Effective Date and Term. This Agreement shall become effective on January 1, 2000, and this Agreement shall remain in effect until terminated by all of the parties hereto or until December 31, 2000, whichever shall first occur. Any MUNI may withdraw from this coalition at any time; however, it will not be reimbursed its share of the consultant costs. 3. Municipal Transit Operator Representative The MUNIs shall select a committee from their membership to work directly with the consultant in representing the interests of the entire MUNI coalition in carrying out the terms and provisions of this Agreement. Such persons shall carry out the terms and provisions of this Agreement, and shall be known as the "MUNI Representative(s)." 4. Contributions by the MUNIs to this Agreement In order to carry out the terms and provisions of the Agreement, the MUNIs agree to pay their proportionate share of the expenses to procure professional legislative representation as set forth in Exhibit A. These expenses are payable in advance to Long Beach Transit by February 7, 2000. If any unused funds remain at the end of this Agreement period, they will be returned to each contributor based on its proportionate share. 5. Accounts and Records. Long Beach Transit shall maintain such funds and accounts as may be required by good accounting practices. Records of all meetings of the MUNIs and all correspondence shall be maintained.
