M0016 - AWARD CONSTRUCTION CONTRACT DEPARTMENT: Transportation & Engineering Services ECOMMENDED ACTIO City Council award the construction contract for the 2000-2001 Citywide Curb and Gutter Flowline Realignment and Restoration program, Project No. M0016, to Kalban, Inc. in the amount of $145,000.00 and authorize a 15 percent contingency expenditure in the amount of $17,000.00; appropriate $17,000.00 from the Stormwater Utility Fund balance to Account No. M0016456-8001; and authorize the City Manager or designee to execute all documents, subject to City Attorney approval. This project will improve drainage flow into local storm drains, thereby improving stormwater quality by minimizing erosion and improving flow characteristics, and will eliminate any nuisances currently existing. The list of locations (Exhibit "B") was generated from residents' telephone calls received by the Field Services Department and Transportation & Engineering Services Department, and were also areas identified by City staff as needing restoration. Substantial constraints and controls have been established in the construction documents to reduce potential impacts on the local traffic and homeowners during the construction phase. Construction is scheduled to start in November 2000, and anticipated to be completed within 40 working days after the effective date of the Notice to Proceed. Staff will appoint a full-time inspector to ensure proper work performance by the contractor, as well as handling daily field issues. On July 11, 2000, the City Council approved the plans and specifications and authorized the advertisement for construction bids. On August 15, 2000, the City Clerk's office received and opened six bids for the project. On August 16, 2000, the lowest bidder, Pacific Construction Company, submitted a letter of request for bid withdrawal due to a clerical error. After reviewing the associated bid documents and letter, staff concluded that kp0r--% °QV�� AgOnda Item: 2000-2001 CURB AND GUTTER FLOWLINE REALIGNMENT PROGRAM AWARD CONSTRUCTION CONTRACT October 24, 2000 - Page 2 minor irregularities existed, resulting in non-responsive bids by both the first and second lowest bidders, Pacific Construction Company and RID Builder Inc., respectively. After consulting with the City Attorney, the recommendation was made to reject all bids and re -authorize the advertisement for bids on September 12, 2000. The City Council accepted staffs recommendation and directed staff to re -bid the project. Per Council's direction, the bid was opened on October 10, 2000 by the City Clerk's office (Exhibit "A," Bid Result). Kalban, Inc. was the single bidder on the second bid opening. After consulting with the City Attorney, the recommendation was made to award the contract to Kalban, Inc. Kalban, Inc. also submitted a construction bid during the first bid opening on August 16, 2000, in which they were the third lowest bidder. Staff has worked with Kalban, Inc. on previous projects, which they performed to the City's satisfaction. After reviewing the submitted bid, staff recommends that the project be awarded to Kalban, Inc. in the amount of $145,000.00 and authorize a 15 percent contingency expenditure in the amount of $17,000.00. Kalban, Inc. possesses a State Contractor's License and is in good standing with the State Contractor's License Board. The bid submitted by Kalban, Inc. was reviewed for accuracy and conformance to the required contract documents. The references indicated that this contractor has performed work to their satisfaction. Other action as determined by the City Council. FISC—A-i— IMPACT Funds for the Citywide Curb and Gutter Flowline Realignment and Restoration Program have been approved and budgeted in Account No. M0016456-8001 under the Stormwater Utility Fund for Fiscal Year 2000-2001 in the amount of $150,000.00. If approved as recommended, staff is recommending that the City Council appropriate an additional $17,000.00 from the Stormwater Utility Fund balance to Account No. M0016456-8001. The budget, including the requested contingency amount of $17,000.00, will cover the bid amount and other related project expenses.
