HomeMy WebLinkAbout2000-11-28 - AGENDA REPORTS - EMINENT DOMAIN VET MEM SITE (2)CITY OF SANTA CLARITA AGENDA REPORT PUBLIC HEARING City Manager Approval Item to be presbnted by: Terri Maus DATE: November 28, 2000 SUBJECT: RESOLUTION OF NECESSITY FOR EMINENT DOMAIN PROCEEDINGS FOR VETERANS MEMORIAL PARK SITE AND ROADWAY ALIGNMENT PURPOSES DEPARTMENT: Parks, Recreation, and Community Services City Council conduct the Public Hearing and adopt a Resolution of Necessity to authorize condemnation of Los Angeles County Assessors Parcel Number 2831-014-035. BACKGROUND The Veterans Memorial Citizens Committee has been working with City Staff to identify location sites and funding resources for a Historical Veterans Memorial to be constructed in the City of Santa Clarita. The Veterans Committee has identified a preferred site at the intersections of Newhall Avenue, Walnut Street, and Market Street. The site was selected for two primary reasons. 1. This location provides a site of suitable size and community visibility. The parcel can accommodate the construction of a Veterans Memorial Park, while reserving the area necessary to allow for the potential realignment of Market Street/Newhall Avenue intersection. 2. Future road widening and the realignment of Market Street and Newhall Avenue will impact commercial development opportunity on the site. As planned, the roadway improvements would restrict the ability to construct a financially viable project with safe ingress and egress and on-site parking. During the development of the 2000/2001 California State Budget, Assemblyman George Runner was successful in securing partial funding for this project. The final 2000/2001 State Budget appropriated two hundred and fifty thousand dollars ($250,000.00) for a Historical Veterans Memorial in Santa Clarita. The Department of Administrative Services has received the State funds for this project. The City Attorney will cause to be prepared the legal documentation for Eminent Domain proceedings. 2:. The City Attorney will file with the Superior Court the request for an Eminent Domain hearing. 3. The Court will determine the Right of Possession of the Property. 4. The Court will enforce any of its orders for immediate possession by the appropriate process. ALTERNATIVE ACTION 1. Council may direct staff to reevaluate the location for the Veterans Memorial Park and propose another site. 2. Council may deny the request for a Resolution of Necessity. FISCAL IMPACT The estimated legal and court costs for the Eminent Domain proceeding will range from $10,000 to $20,000, in addition to the cost of the land acquisition. The issues which will be considered, are as follows: 1. Whether or not the public interest and necessity require the Project; 2. Whether or not the Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; 3. Whether or not the Property sought to be acquired is necessary for the Project, and 4. Whether or not the offer required by Government Code Section 7267.2 has been made to the owner or owners of record.
