CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE: February 8, 2000 City Manager ApproN Item to be presented SUBJECT: QUITCLAIM OF EASEMENTS AND WAIVER OF JUST COMPENSATION OF FLOOD CONTROL EASEMENTS RELATIVE TO LIVE OAK SPRINGS STORM DRAIN - PROJECT NO. M4002 DEPARTMENT: Transportation & Engineering Services RECOMMENDED ACTION City Council adopt the resolution authorizing the granting of the public service flood control easements to the Los Angeles County Flood Control District; and direct the City Manager or designee to execute the related "Waiver of Just Compensation" and "Quitclaim of Easements" documents. BACKGROUND The Los Angeles County Flood Control District has completed the final design for the proposed construction of Live Oak Springs Canyon, Unit 1, storm drain project system. In order to carry out the project as planned, various types of flood control easements currently held by the City along Sand Canyon Road must be transferred to the Flood Control District (see attached Exhibit "B" maps). A Quitclaim is usually executed upon an existing storm drain when construction is complete and the storm drain meets County standards. At that time, the storm drain then becomes a part of the maintenance responsibility assigned to the Los Angeles County Flood Control District. However, the Los Angeles County Flood Control District will be responsible for the construction of this storm drain, and must acquire these easements now in order to start construction, which is scheduled to begin this summer. In addition, due to statutory requirements, the County Department of Public Works must make an offer of "Just Compensation" for property rights it may acquire for public projects. However, in light of the tremendous benefit this project will bring to the City, the County requests that the City waive its rights for the demand of compensation for the conveyance by the District of these easement rights necessary to construct this project. The County is presently compiling the plans, specifications, and estimate for presentation to the City Council on March 14, 2000, for approval and authorization to advertise the project. An easement for flood control purposes acquired by Easement document recorded on July 21, 1937, as Document No. 778, in Book 15065, page 379, of said Official Records.
