HomeMy WebLinkAbout2000-12-12 - AGENDA REPORTS - OVERSIZED VEHICLE PARKING REGS (2)CITY OF SANTA CI.ARITA AGENDA REPORT UNFINISHED BUSINESS City Manager Approval: Item to be presented by: -en Strinlin DATE: December 12, 2000 SUBJECT: OVERSIZED VEHICLE ORDINANCE — ADDING CHAPTER 12.94 TO THE SANTA CLARITA MUNICIPAL CODE REGARDING OVERSIZED VEHICLE PARKING REGULATIONS DEPARTMENT: City Manager's Office City Council adopt the Oversized Vehicle Ordinance adding Chapter 12.94 to the Santa Clarita Municipal Code, with an effective date of April 2, 2001, and a policy establishing that the ordinance is to be enforced on a complaint basis. On September 12, 2000, the City Council heard a presentation on the Oversized Vehicle Ordinance, received public testimony and closed the public hearing. Subsequently, the City Council passed the Ordinance to second reading and directed staff to report back to Council on December 12, 2000, with an evaluation of available storage spaces. In the original survey presented to Council on September 12, 2000, staff found that although there were over 20 storage facilities in the Santa Clarita Valley, with the exception of a few, almost all of them indicted they had no spaces available. In fact, the original survey showed that there were approximately 159 spaces, most of which were at Country Girl RV (100 spaces). Therefore, in the present survey of storage spaces, staffs assessment focused on storage facilities that expressed intent, when the prior survey was conducted, to expand their facility in the event that the oversized vehicle ordinance was adopted. In conducting this survey staff visited three facilities that indicated they had spaces available to determine whether their figures were accurate. All three indicated that the expansion of the spaces is dependent upon demand. All three facilities are gated and provide overnight security. Therefore, based on these data it appears as though storage space is sufficient to meet the demands should the ordinance be enacted. It is important to note that staff did not include spaces that are in the process or in the planning stages for development. As it is unknown when these spaces will be completed and available for use. In addition to evaluating the availability of storage spaces, staff has also worked closely with the Sheriffs Department to develop a procedure in which the ordinance is to be enforced. As you may recall, the ordinance will be complaint driven. This means that the Sheriffs Department will only tag a parked oversized vehicle if a "verified affected neighbor" files a complaint. 'Verified affected neighbor" is defined as any individual that lives or works within two blocks of the parked oversized vehicle. In order to determine whether an individual is a "verified affected neighbor" an Oversized Vehicle Complaint Form must be filed with the Sheriffs Department. These forms will be available at the Sheriffs Station, City Hall, City and Sheriff web site, Community Center, and the Sheriffs Storefront locations. In order to fairly determine the "verified affected neighbor" status, telephone or anonymous complaints will not be taken. All complaints will be held confidential from outside inquiries. In the event that an individual calls the Sheriffs Department and demands that a Sheriffs unit be sent, a deputy will be dispatched only if the individual making the complaint agrees to meet the deputy upon arrival. At that time, the complaining individual -will be given an Oversized Vehicle Complaint Form that must be completed before the deputy tags the designated oversized vehicle. City staff would communicate with Sheriff personnel on a weekly basis and provide them with information on oversized vehicle permits issued. Staff is recommending that the City Council allow a four-month amortization period that would make the Ordinance effective April 2, 2001. This period of time would allow owners of affected vehicles time to make arrangements for storage. Additionally, during this time period, 21 signs will be installed at City gateways. A public information campaign would also be developed to ensure owners are aware of the new regulations. FISCAL IMPACT The cost for materials and installation of 21 signs at City gateways is estimated at $3,500. The wining cost factors include staff time, materials to issue permits and the distribution of informational brochures. There is no expected increase to the Sheriffs budget for enforcement of the ordinance. ®I.TER9ATEVE ACTIONS 1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADDING CHAPTER 12.94 TO THE SANTA CLARI TA MUNICIPAL CODE REGARDING OVERSIZED VEHICLE PARKING REGULATIONS The City Council of the City of Santa Clarita, California, does hereby ordain as follows: $ACTION 1. Chapter 12.94 is hereby added to Title 12 of the Santa Clarita Municipal Code to read as follows: 12.94.010 Definitions. "Oversized Vehicle" shall mean any motor vehicle, boat or trailer, which meets or exceeds at least two of the following criterion, exclusive of fixtures, accessories or property: 1. twenty-three (23) feet in length; or 2. eight (8) feet in height; or 3. seven (7) feet in width. 12.94.020 Oversized Vehicle Parking Regulations. Penalties. Appeals. A. The parking of oversized vehicles, as defined in Section 12.94.010 of this ordinance, shall be prohibited on any public street. This section shall not apply to any oversized vehicle: 1. Parked on a public street during the weekend (Saturday and Sunday) or a national holiday; or 2. Parked for the purpose of, and while being, loaded or unloaded for a maximum period not to exceed forty-eight (48) consecutive hours in any calendar week (Monday through Friday); or 3. Parked for temporary maintenance or emergency repairs not to exceed forty- eight (48) consecutive hours within any calendar week (Monday through Friday); or 4. Parked for the pickup or delivery of goods, and merchandise; or 5. Displaying a current valid State Department of Motor Vehicles issued disabled person license plate. B. The prohibitions set forth in this Chapter shall not apply to the parking of commercial vehicles. C. Any violation of the herein stated provisions pertaining to the parking of oversized vehicles shall be subject to penalties as established by a schedule of fees adopted by resolution of the City Council. D. Every person who is issued a notice of parking violation pursuant to this chapter may request review of that notice under section 40215 et seq., of the California Vehicle Code. 12.94.030 Oversized Vehicle Parking Permits. An oversized vehicle may be parked on any public street if the City issues an Oversized Vehicle Parking Permit pursuant to the following: A. Purpose. The purpose of authorizing the issuance of Oversized Vehicle Parking Permits is to give owners of oversized vehicles an opportunity, for a limited time, to park their oversized vehicle on a public street. B. Requirements for Oversized Vehicle Parking permits. Any person may obtain an Oversized Vehicle Parking permit to park a designated oversized vehicle on a public street, for a limited period of time, as described in subsection (D) of this section. C. Issuance of Permits. The City Manager or designee shall issue Oversized Vehicle Parking permits, pursuant to the following: 1. Each person desiring an Oversized Vehicle Parking Permit shall file with the City Manager or designee a completed City application form containing the following: a. The name, address and phone number of the registered owner and applicant of designated oversized vehicle; b. The license number, make and model of designated oversized vehicle; C. The dates for which the permit is requested pursuant to subsection (D) of this section; d. The dates and duration of any and all oversized vehicle permits issued to the applicant within the immediately preceding ninety (90) day period; e. Additional information the City Manager or designee may require; f. The applicant must sign application under penalty of perjury. 2. Oversized Vehicle Parking Permits issued and approved by the City Manager or designee shall include the license plate number of the designated oversized vehicle, the date of issuance and the day of its expiration. 3. All permits shall be placed at the lower driver's side of the windshield of the oversized vehicle to which it relates so that it is clearly visible from the exterior of the oversized vehicle. Should the oversized vehicle not have a windshield, the permit shall be affixed to the front portion of the oversized vehicle in a location that is plainly visible from in front of said oversized vehicle. 2 4. All Oversized Vehicle Parking Permits shall be issued at no expense to the applicant. D. Permit Duration and Renewal. An Oversized Vehicle Parking Permit shall be valid for a period not to exceed three (3) consecutive weekdays (72 hours). Upon expiration of an Oversized Vehicle Parking Permit issued under this section, the applicant may apply for and be granted additional Oversized Vehicle Parking Permits, if the applicant still qualifies under the conditions set forth herein. In no event shall any person and/or designated oversized vehicle be issued more than three (3) Oversized Vehicle Parking Permits within any ninety (90) calendar day period. 12.94.40 State of Emergency during the pendency of any state of emergency declared to exist within the The prohibitions provided in this chapter shall not apply to the parking of any oversized vehicle by the City Council. GENERAL Chapter 12.94 of the Santa Clarita Municipal Code prohibits oversized vehicles from parking on any public street. This ordinance defines "oversized vehicle" as any motor vehicle, boat or trailer, which meets or exceeds at least two of the following criterion: twenty-three feet in length; or eight feet in height; or seven feet in width. The restrictions do not apply to oversized vehicles parked on the public street during the weekend (Saturday and Sunday) restrictions s national holiday. Exemptions are also given to oversized vehicles being loaded or unloaded, or in emergency repairs, hours.
